Becomes difficult, sometimes. Example, if you’re pregnant. Hard to hide until due date! Chronic illnesses? Some can be hidden while others…not so much.

One good thing about companies firing people over Zoom is that you can have proof "Word for word" of what they say. It makes them extremely liable for what they say.

Nop, a lot of states are one party states when it comes to recording. Meaning only one party, you, has to be aware of the recording. You can also say something like "fyi I record all my zoom/phone/etc conversations" and proceed.

I know someone who had something similar happen. She disclosed she was pregnant and less than a week later she was made redundant. Here in Australia this generally isn't legal and she was protected under the law. Ultimately the employer had to pay more than 12 months of salary for wrongful termination and damages.

I hope they were able to take all the time they needed to give birth and found a better job after. The way people treat pregnant mothers is disgusting at time, you don't have to enslave yourself to them but jesus a bit of compassion makes the world function.

The trouble is a lawsuit costs money and you're in a position of not having any income. Its never as simple as you put it.

@@TerribleFire theres plenty of attorneys who will take a case on a contingent fee basis, in which their fee comes only from any money recovered. In other words, no up front costs. Furthermore, most states have statutes that govern employment disputes and many causes of action in such statutes will provide for costs and attorneys fees. When in doubt, talk to a lawyer. If they think there is a strong enough case and an ability to recover damages they'll definitely let you know.

@@TerribleFire These types of suits don't cost plaintiffs anything but time in most cases. Attorneys will take these cases with the understanding that they collect like a 3rd of any settlement or damages awarded at trial (if it comes to that but cases rarely get that far).

This is a slam dunk open and close case. The moment they advertise the same position available that they laid a person off for no longer having . They needed to offer the role to the person they laid off to first then advertise for if the person couldn't come back. This was stupid and illegal for the start.

This happened to someone who worked at one of my old jobs, she was 'made redundant' and then her sister who also worked there noticed a sign on the wall saying they were hiring for the same position immediately after, she took a picture and showed it to her sister and she sue'd and won.

I was fired from my job as a teacher (middle school). My boss told me I couldn't marry my non-Catholic boyfriend or get fired if I did. Being cowed by authority is not new to me but she glared at me. I was in fact fired at the end of the year. Like everyone, I work to live not live to work. My husband and I have been married for over 20 years.

The first thing the boss says this will affect your work and showed clear unhappiness/contempt for the news. Then on call with HR first thing she says is this has nothing to do with what you told me last week that seemed to indicate she hadn’t told HR about his family position which also seems backed up by the fact the HR girl seemed caught of guard when he told her. She has clearly constructed a way to get rid of him

I had a manager basically call me into a meeting under the guise of it being a check-in, turned out I was being fired, and then he ducked out of this meeting and left the poor HR person to deal with it. Complete chickenshit move

It was quite scary though as I am OLDER and knew I was much less likely to be perceived as valuable. Turns out I found a company that values experience. There is no reason to be rude. And another coworker who got downsized the same day had just bought a home and had a baby on the way. A third was pregnant. And I guarantee you that is EXACTLY why she was let go. She was a HIGH PERFORMER. The other person in her position was ABSOLUTELY, RIDICULOUSLY, NOT. They kept a $hit employee and downsized a good one BECAUSE SHE WAS PREGNANT.

Some bosses/companies are that bad; they don't want people taking time off or costing anything in benefits. They are letting the employee go and not saying "fired". Watch them try to deny unemployment pay.

I was recently almost off-boarded by a company. I received an email from management claiming that i was being off-boarded due to performance issues and concerns. This caught me off guard as i was never spoken too about the quality of my work nor did i ever recieve any feedback. So i emailed the director and they investigated. Turns out i was correct and they reversed their decision. I'm looking for alternatives now as this has somewhat soured my work experience with them.

We’re looking through the cultural lenses of UK where we’ve been afforded generally good protections due to EU employment law. The fact is that [small] companies in the US don’t want to pay someone maternity leave. You’re paying someone while they’re not there. Companies will avoid employing young women who are likely to be having a child for this reason. And in the UK it is illegal to reject someone’s application due to being pregnant for that reason. That said; this type of discrimination against a young man whose girlfriend is the one who’s pregnant, it absolutely mental.

Its not just small companies in the US, its most of them. No statutory maternity/sickness. Also maternity leave isn't maternity pay. In the UK statutory maternity pay is mostly paid by the government not your employer. About 90% in UK And talking about paying for people who aren't there ... Employers are required to provide thier staff a living, if you don't want to pay for the absences/costs that are apart of life, then you pay for a contractor and the associated uplift in rates so that the individual can provide the insurances/savings that cover life events that require time off, holidays, sickness, pregnancy, retirement. Well that's if you want to live in a world where people and children are valued and not serfs to simply create profit for the elite. I get it is difficult for very small business and most very small business have exemptions from some things.

They have really sneaky ways to find out if interviewees have a partner, are planning a family, or have kids already. They do it conversationally by bringing up their own families.

@@mattyboy8270 If you look closely the word "we've" is used. This means we have indicating it is in the past tense. Also while they were not required to follow EU law they retained a lot of EU laws until they were recently repealed (thank you Liz Truss you rancid bitch) though ironically the UK actually had better protections in some areas than EU law required.

​@@mattyboy8270 Are you referring to laws no longer in effect because of Brexit? Apologies - I'm no expert (perhaps you know more) but my understanding is that no EU laws were directly in effect in the UK when we were in the EU and, instead, our UK laws were implemented to reflect the EU laws imposed on our Government as part of EU membership. So whilst EU laws are no longer being imposed on the UK, we still have UK laws, such as employee protection, that reflect the EU law at the point it was put in place. The same is true of something like GDPR, where it was EU regulations that kicked it off but we now have UK GDPR that reflects the EU laws it was originally built on. Basically - yes, we're no longer in the EU and no longer have to enforce laws based on EU laws, but we also have hundreds of UK laws still in place that were a reflection of EU law (if nothing else, deconstructing them at this point would be a lot of work). Don't know if there's something specific you're aware of with employment law, or if I've misunderstood, so worth asking 🙂

I once was an assistant manager (no power but all the responsibilty) at an awful company. They hired a woman into my department who announced 2 weeks later she was pregnant. The brass all felt she must have known and & only hired on for the "benefits." Word came down from my manager to document everything this woman did in an attempt to fire her. This wasn't the only shady thing they did. I quit not much after that so I don't know if the new hire survived.

It appears this takes place in the US. The laws are different here. A redundancy does not require all the steps you mention. However, he has a very good claim for retaliation.

Pregnancy is protected under the Equal Employment Opportunities Commision, a government entity. All that would have to be done is the recording submitted with the complaint and bam. Federal lawsuit.

Yep - in the US they can absolutely lay off anyone at any time without giving a reason, in most cases. They are certainly not required to give people a chance to make their case for someone else getting laid off instead of themselves. I’ve never heard of a company doing this. HOWEVER, in a case like this where there seems to be ample proof that this is retaliation for disclosing the partner’s pregnancy, means he probably had a valid lawsuit, and most employment lawyers would work on a contingency basis in this case. There’s an American employment lawyer on YT who points out all the time that judges and juries aren’t stupid - especially with this video evidence he’d be likely to win a wrongful termination suit. I hope he brought one.

I was working for a fundraising company, they fired me on the last possible day of my two years, getting full employment rights. This was back in the nineties. I already had another job to go to, I'd watched them do this to a lot of other people. I was deliberately making it awkward for them.

The HR rep said fired and then changed that to laid off. This manager fired him and came up with a BS reason and used HR for the fall guy. When layoffs come down to teams Managers will look at metrics and team cohesion. The fact that they denied using performance in a layoff is a MASSIVE red flag to me.

@@MikhailScottKy really? The description of at will employment is literally the ability to dismiss an employee without reason or warning… I.e. “at will”. If the business’s employees have a union, they may have bargained that there must be a ‘just cause’. I just looked up the Supreme Court of California’s 2001 clarification.. “…presumption that an employer may terminate its employees at will, for any or no reason. A fortiori, the employer may act presumptively, arbitrarily, or inconsistently, without providing protections such as prior warning, fair procedures, objective evaluation, or preferential reassignment.” It then goes on to say that any deviation of that is between employer and employee at a contract level.

Israel has a law regarding the pregnant woman. If she has been at the same workplace for six months. We must tell the employer in the fifth month of pregnancy. Then an employer who wants to fire has to get special permission from the government. Otherwise it is simply a violation of the law. By the way, there are three months from birth that the state pays for, and I can decide to divide this time between me and my husband. There are many more things that need to be fixed here regarding children. This is our first pregnancy, week 25.

What I just don't understand is, it's clearly because his girlfriend is pregnant. We've all experienced having our jobs threatened when we are pregnant, but the fact that he's the father, and not the pregnant person, it seems very much the woman manager's feelings toward this man.

She starts meeting saying this has nothing to do with what you told me last week Also she made comment may affect work comment and does that explain the drs appointments. Also why do hr need to know? The fact that her immediate reaction was to say " oh that may affect your work" and then ask if that's why he had doctor appointments tells you that she has no intrest I'm this guys personal life and is only worried avout the company and her own well being. I hope life deals her the same kind of cards that she's handing out to others.

When i came back to work after being absent for a week due to my granddaughter's murder, my employer started making changes to my job to cause me to quit. I had seen them do it to others so i knew the signs and since the place was horribly mismanaged and high stress anyway, i put in a few more months, then retired. Their tactics included switching your duties to working on an old DOS computer program, having IT change product code numbers without telling you so your reports wouldn't balance, then making it your fault, etc. When i turned in my notice, the HR manager, a young woman who regarded the rules loosely said to me: well this is what we've been expecting. I replied: Oh really?!, letting her know i knew their game. She fell all over herself trying to back pedal. Had I had the heart and energy for it, i would have pursued a legal settlement. A co-worker did and was awarded a tidy settlement paid to her.

I had a boss who would fire any women who was pregnant. After he let go the first woman who got pregnant, we advised the next girl not to tell him until she was ready to leave. However I know he wouldn’t have sacked a guy when his girlfriend was pregnant, he wouldn’t have given extra time off.

The manager gave herself away right off the bat. Why on earth would her first reaction to this news be: "Oh, wow, that's going to affect work. Does that explain some doctor's visits? I'm not going to tell anyone except HR." Firstly, how does SHE know that his girlfriend's pregnancy is going to affect his work production? Secondly, it's NONE OF HER BUSINESS what his doctor's appointments are about! Thirdly, why does anyone in HR need to know UNLESS his work production has ALREADY been affected by the pregnancy? He needs to save this video because he has good evidence of discrimination for a lawsuit!

The rules for firing that Ben is talking about, is that in the context of the UK? Because I know here in the states, employers generally don't have to provide a reason for firing you.

You have to know that's not correct. They can fire you for any reason as long as the reason is not illegal, they do have to have a reason though.

@@purplefood1 On paper, yes. But in practice, they can and do fire people for illegal reasons. As an employee, the onus is on you to make sure you get EVERYTHING in writing, because it'll be your job to prove in court that your firing was unjustified. Employers savvy enough at skirting the law will already have built up a list of grievances against you if they want to cut you loose, regardless of the impetus that eventually kicks off the process. Case in point: a coworker of mine got injured on the job. She suffered fractures in her spine that rendered her unable to lift things anymore, which had constituted the majority of the work she did. The timing of her dismissal let everyone know in the facility that the company was cutting her loose because (A) they didn't want to continue to pay her health costs, and (B) couldn't use her in the same position anymore. They all of a sudden produced a list of times that she had clocked in to work thirty seconds or so late on about a dozen occasions, and used that as justification to fire her. She was too poor and beaten down by the medical care and costs to afford either the money or time to pursue the matter legally, and her employer knew that would be the case. The imbalance of power between employer and employee was always great, but in 21st century America, it's a chasm of distance that basically leaves employees with very little options to seek justice. Unless they have the wherewithal and time to find an organization or attorney to take the case on pro bono, they know that all they can do is try to find other work and just take the injustice on the chin. I used to work for a busy mutual fund department of a financial institution. When the 2007-2008 subprime mortgage financial crisis occurred, we became less and less busy. Made sense as people no longer had money to invest as they did before 2007. When staff left, they were not replaced. Occasionally, staff was left go, but it was obvious to everyone why those staff members were being let go. It was a combo of continual poor performance couple with reductions of available work…or the weakest links. End of day, everyone was nervously about their jobs. When I started in 2003 there were roughly 25 staff members. I transferred out in 2009. When I checked in around 2019-2020, there were about 5 staff members left.

I want to point out that in the US a lot of states are "At Will" which means you can be fired or declared redundant with no notie and employers do not have to give you a reason.

This is really simple. Her reaction to the pregnancy news wasn't enthusiastic because she knew she was laying him off next week. She knew she was going to have to crush him, the decision had already been made.

In my old part time job while I was young, going to college and serving in the military, I told my boss I was getting deployed to Afghanistan. A week later we had a new employee and the next day, I was told they were “trimming the fat” and I was being let go. Even though they hired a new guy for my position the day before.

Yeah, the US has almost no protections at all for layoffs. Most of the stuff he describes just doesn't apply.

@@alexandrezani This is false it is federal law you cannot fire someone because of a pregnancy. this company will be sued into oblivion. there is about 24 reason why you cant fire someone. such as race gender religion pregnancy whistleblowing etc. Juries are not stupid if firing happens in a short time period after something like this than the company will lose. Because this will be handle in civil court where you dont have to proof beyond a reasonable doubt you just have to proof it is more likely than not. A call with a manager where she puts in video that she is not happy with the pregnancy because will affect work. the expressing concern for taking PTO for medical reason. then firing him as soon as he comes back is pretty much open and shut case.

I agree with the people who say that, reading between the lines, it looks like they'd already decided to let him go, and he told them this news before they had a chance to tell him he was being fired; that explains the manager's complete unenthusiasm for what should have been a happy announcement. It put the company in the position of "we were going to fire him, but he told us this before we had the chance, and now anything we do is going to look like it's a response to his situation."

The whole response to the pregnancy news is so odd to me as well. She isn't happy for him, she immediately considers how it might affect his work, she is surprised saying 'I wouldn't have guessed that for you' meaning she thinks this is a bad thing. She also says go take a 'mental break' meaning she truly believes that this is bad news. They probably hired him and asked him shady questions like 'do you plan to start a family soon' in the interviews. This is all so shady. Hope he wins a lot in court with this evidence.

When I was in the UK I got hit with an unlawful redundancy. "Restructuring" BS. It came out of the blue, called to HR, told the news, and urged to sign papers then and there (I did not!) The thing of it was, I was the secretary working for two managers, and one of them hogged 90% of my time. It was unfair to the other one, and I tried to manage that rock and hard place as best as I could. Also, in the building were many similar roles filled by temps, and I was permanent. Completely bogus redundancy. After many months of back and forth via employment lawyer, in which the company outright lied about several things, it was about to go to court and I did settle on their offer at the time (an additional four month's pay, I had received one month's pay at termination). I only took that offer because I had just started a new and much better job, and did not think it a good look to take time off to take my former employer to arbitration. One of the things that I remember being shocked by, was from the end of that day, I was never to set foot on the premises again. Sounded like a firing to me!!

They obviously fired him because they thought he would be asking for time off when his gf gave birth. They made up a restructuring plan simply to can a man. Absolutely pathetic. I would've given them the riot act and told them straight to their faces that I KNEW why they were firing me and that they should be ashamed of themselves. I hope he sought legal counsel. They should be doubly ashamed seeing as they are women and are showing zero empathy to a couple dealing with a pregnancy. A pox on both their houses. As others have said: Don't EVER talk about your private life with fellow employees or bosses. Your life is none of their business.

Ok, fair or not, I get this especially if it's a smaller business that can't cope with holding positions open for paternity leave. What I have absolutely no clue about is why the BF/husband would be getting let go for his partner's pregnancy. I do get that men *qualify* for paternity as well, but a) I didn't see any indication that he asked for time off, and b) there can be solutions found for key personnel. This whole thing just reeks of stupidity from the employer.

When an employee's wife is having a baby, the employee will ask for more work, more responsibility and therefore more money because he has another mouth to feed. I'd keep such a motivated employee no matter what.

"Redundancy:" Most states in the USA are "right-to-work" states, which basically means you can quit at any time for any reason, and the company can fire you for any reason. Or none. No explanation necessary.

You really have to document everything in those states. They can't break actual employment "laws" but they will wrangle things to make it appear someone is fired for other reasons. You can get them, but workers need to keep tabs of every single thing that happens.

That's not true. At all. It's one of the biggest myths in the US. You cannot let someone go/fire someone for discriminatory or illegal reasons, of which there are many, and discrimination against pregnancy is one of them.

Welcome to American workplaces. You can get the pink slip/fired for anything that you do. This is why you shut your mouth, do your job and get out when it's time to go home. The boss will use "any excuse" to get rid of you, do not give them that.

The problem is that in America, there are many states that are known as at-will employment. In these states, companies are allowed to dismiss you without any consequences. To get unemployment is even more ridiculous because your former boss has to actually approve it in many states. If they turn you down there is nothing you can do. Plus, you have had unemployment insurance deducted from your paycheck but you are not entitled to it unless the former boss approves it.

Never had unemployment insurance deducted from my paycheck- just social security and medicare. Unemployment Insurance is 100% an employer expense. The more people your company lays off, the higher your rates are. So employers do their best to fire employees for cause, or force them to quit, because then they don't have to pay unemployment benefits. Your former employer doesn't have to "approve" unemployment benefits. You are entitled to them if you're laid off.

Several states in the US are at-will, which means the company can fire you at any time for any reason, or no reason. It's not the same as being laid off... in the state where I live, employers will often fire people for no reason, and you can't receive unemployment if you are fired, but you can if you are laid off. It is incredibly difficult to prove wrongful termination in at-will states. It sucks, but there you are.

A lot of the "you can't just do this" type of information Ben is mentioning is of course not applicable to the US. Companies eliminate roles and re-hire people for those roles quickly quite frequently. Example, I was recently laid off and told my position has been eliminated, along with many others on my team. That same day job postings were posted to refill the positions in other countries.

you should seek an attorney because, even in the US, they need to get "creative". Saying that the role is eliminated AND posting job offers ARE WRONGFUL TERMINATION, even in at will states. So, seek an attorney and you can, at least, secure your unemployment benefits. MAKE HR WORK FOR THEIR MONEY

Lots of states have at-will-employment, so you can be let go with little to no notice and you can leave with little to no notice, however, there are federal laws that protect you from being let go for certain reasons like pregnancy. It's complicated, though, since a company can find reasons other than explicitly your pregnancy to let you go and you then have to prove that that was in retaliation over your pregnancy and you might not be in a position to go looking for a lawyer that will take on your case with a payment structure that you can afford.

But, again, we don't know the backstory. Perhaps he and the girlfriend were on the rocks and he had been put through the wringer and everybody at his work knew it. Or perhaps his girlfriend is very ill and a pregnancy is going to really complicate things. That might explain the manager's initial reaction.

Nah, lol. Never say it. Just do it. Make sure the evidence is in the hands of your legal representation and try to be the fly on the wall when they're served notice. Telling them what you're doing before hand lets them cover their tracks and destroy evidence

In a job decades ago I worked for a very 'precious' and sheltered middle aged maiden lady. If you've ever seen Hinge and Bracket you'll have some idea what I mean. Except in real life she was no joke - I could never figure out why she hadn't been fired years before - she was losing staff hand over fist. If you were young, female, and pretty, you were in for one hell of a time. I'm male and not so pretty - worked for her for 6 months, which I later found was a record. The average was a month, and more than one assistant had walked from the job on the first day. I ended up in HR fighting the women not on my own account, but because she was determined to fire a (married) female colleague because she was... was... well you know... she's... er... um... I mean... what if the public see her...? At the top of my voice, I yelled, "The word - woman - is PREGNANT! Something YOUR mother should have taken more care about!" I swear to god, she fainted on the spot! The pregnant lady handed in her notice, along with a promise of litigation. I handed in mine - not in support, but simply because I could see no future with an employer incapable of ridding themselves of a shockingly bad manager.

Im not sure if im correct or not but wjere i live hr will NEVER give you amy information or speak about the whys or howsbthe layoff occured. Atcleast in my experience and iveen laid off 6 times in my life. My guess is that employment protections are so strict that you can suenthem for basically anything. Which sucks because if there something i could have done to have kept my job i wouldnlike tovknow socthat i can fix any problems i might be blind to. Butvive only ever had great feedbacl from my bosses. Maybe the issue always was bad luck in getting hired just as the outside consultants were brought in.
