Steven Owen Scotland does not need permission. Section 30 is just important because it commits both sides to accept the result. The matter has never been tested in court although is currently on its way as we speak.
@ycylchgames
@ycylchgames 4 жыл бұрын
@@samantha-janehood5045 Yes it does, due to the nature of Section 30 Scotlands parliament doesnt have the power to hold a referendum on it's on independence. It was only able to vote last time because the UK government passed the Section 30 order, that essentially temporarily lifted any restrictions on Scotland's ability to hold its own referendum. Scotland could attempt to hold it's own referendum but this would merely be an advisory election and not legally binding. The reason being is that Holyrood can't legislate on ‘reserved matters,’ which are the responsibility of the UK Parliament. Paragraph 1(b) of schedule 5 of the Scotland Act 1998 states that “the Union of the Kingdoms of Scotland and England” is a reserved matter. This means the Scottish Parliament could hold it's own election but it would merely be that, a referendum. I couldn't then go on to declare independence even if it a majority voted in favour of it. A good example of how a non legally binding referendum can turn out is the 2017 Catalonia Referendum, we all know how that turned out. And they wouldn't do this anyway as Nicola Sturgeon has already stated she wont do this, she wants a legally recognised vote. Also, there was no legally binding rule in the section 30 order that stated only one vote could be held in any set timescale, only that a vote had to be held in 2014. That's a popular myth. The Section 30 Order was part of the 2012 Edinburgh Agreement, which was essentially just a basic break down of how and order would play out, the only mention of any timescale was that the vote had to take place in 2014. That's it. Plus all the Section 30 order is, is an order that just temporarily grant's Scotland the power to vote on matters beyond the agreed scope of the Scottish parliament. It's been used 16 times and whether or not the order should be granted is supposed to be democratic and passed in parliament. Basically whenever Scotland asks for the right to use thr Section 30 Order for something, it's supposed to be voted on by MPs in the house of commons. The last time Scotland wanted to vote on Independence it asked Westminster if it could do so and Westminster voted yes. Now, however the UK government wont even allow this vote to take place! The second time Scotland asked Theresa May didnt even let Westminster vote and simply refused, which is exactly what Boris has done again this. Basically, if the Order isnt presented to parliament to be agreed on (which is kind of illegal by the way) there's nothing Scotland can do besides going to court and trying to legally argue that it has the right of to hold a legally binding election itself but I'm pretty sure it would fail since that's not ever been agreed upon by the terms of the union.
@samantha-janehood5045
@samantha-janehood5045 4 жыл бұрын
Steven Owen Hahahahaha. You we’re doing so well until you said it would fail. Its tricky for the Scottish Parliament to take this to court because they are the “parliament” not the “people. We have the Declaration of Arbroath 1320. I dont know where we would be without this Declaration and thank god King Robert the Bruce created it. This declaration declares the people of Scotland are sovereign above any parliament and above any Queen/King. Which means we have the right to a referendum if we so wish. A campaigning group (which im a part of) called Forward As One. Has gathered funds of over 40,000 and currently has hired a QC On the “Peoples” Behalf to take this to court. So it is already there. The “People” can challenge this refusal as we can use the declaration of arbroath however Nicola cannot. There is very very little chance we would be refused as WE the PEOPLE of Scotland are Soverign. She could, however, swoop in last minute when this is ruled lawful and use this to move forward on holding another referendum.
@ycylchgames
@ycylchgames 4 жыл бұрын
Look I'm not against Scotland having a referendum, you could vote for independence tomorrow if I had my way. But the reality is that the current system sadly doesn't allow for it.Plus trying to use the treaty of Arbroath to justify it is pretty flimsy, its centuries old and written in Latin so its extremely difficult to translate and interpert. I'd image the first problem would like be that the document states the decision is up to the people of Scotland but at the time when documents said 'the people' they were talking about the only people they considered important, that is to say the nobility not the people of Scotland as a whole. That's a modern understanding of the word people.

@Jack The Film Fanatic "That’s bollocks..."? No, it simply is not. Every comparative rating of countries by per capita GNP, GDP, or GNI has consistently placed the Republic of Ireland(RoI) in the top five countries in the world, while the UK struggles to make it into the top 30. "The U.K. bailed Ireland out not so long ago..."? The UK contributed LESS than 10% of the Irish bailout, and that was solely to protect the British financial sector from the risk of systemic collapse because too many British banks had followed the rest of the lemmings and became over-exposed to the Irish mortgage market. More than 90% of the Irish bailout came from the EU, the IMF and the European Central Bank(ECB). "...and the U.K. is still a much bigger a economy than Ireland"? Of course it is. The UK has a population of about 65 million. The Republic of Ireland has slightly less than 5 million. Interestingly, while we have less than one twelfth of the UK's population, our economy is about one sixth the size of the UK's. So we are, relative to population, about twice as rich/productive as the UK.
@shanehughes3511
@shanehughes3511 4 жыл бұрын
@Jack The Film Fanatic eh ye bailed out Irish banks you idiot. Irish banks that held a lot of UK debt that you didn't want to reach the UK. Ireland paid back all that money to the UK too I should add plus interest. You do know the UK lives off borrowed money? You borrow from the rest of the world and pay back every day. Ireland has 5 million people and has a GDP of 340 billion. England has a population of 57 million and a GDP of 1.8 trillion. Seems we are the ones doing better by that math. We also have better living standards and are growing much faster. Simple fact is the mistreatment of Ireland was the beginning of the end for the union. Ireland always has 1/3 the population of the British Isles. But in the 19th century as Ireland reached 9 million and England 13 million, England realised the Irish and Scots together would take power away from the English in the Union. So ye let us starve to death. I'm not bitter it was a long time ago. But causing Ireland population to fall to 3.5 million in the years after and to then deny home rule in 1912 was the first nail in the coffin. If the English didn't keep the other food we had in plenty in ireland from the poor Ireland would have industrialised, become a major player in the UK and today would have 20 to 25 million people at least. That would make the modern Union a very fair one with Ireland having 25 million, Scotland 5 million, Wales 3 million. So about 40% the population being non English. Instead Ireland left and shrunk. You kept northern Ireland which was too small to be self sufficient and alienated smaller Scotland, Northern Ireland and Wales. Even in 2019 the Union is unfair as it upholds English power and dominance in politics and referendums etc. No fair system in place. The UK should have become a federal union in the early to mid 19th century with a huge England and huge Ireland balancing the Union. But England stopped that. The future will be a united Ireland of 7 million, an independent Scotland of 5 million and maybe but not gauranteed a free Wales of 3 million too. All 3 states in the EU and competing against England for investment and growth. England has shot itself in the foot and this century will be the death of England's role in the world other than in London. A celtic confederacy in the EU between Ireland, Scotland and Wales seems more possible now than Scotland and the other small nations staying in the EU. I'm Irish and can tell you Scotland being a similar nation to us will do just fine and the EU would support Wales and Northern Ireland too. The EU is planning for both irish unification and Scottish independence in the future. I should also add the island of Ireland will have 11 million by 2050 vs England's 62 million. So even our population is booming faster.

"Every comparative rating of countries by per capita GNP, GDP, or GNI has consistently placed the Republic of Ireland(RoI) in the top five countries in the world, while the UK struggles to make it into the top 30." Please note the 'per capita', as in 'per head of population', or 'economy divided by population'. Economists use this metric when comparing the relative wealth or affluence of different countries. I live in London having been born here in Newham, one of the most deprived areas of the UK. But I have lived for many years in Chesterfield and Yorkshire. I have heard this 'London gets all the money' debate a million times before. But the simple fact is that it's not true. London gives away far more money that it generates, whilst also generating over double GDP than Scotland (this includes the north sea oil & gas). The education levels are far lower in London, having experienced both London and northern schools personally. I recently moved to a new area with my girlfriend this year, and 7 months after applying for various GPs, I am still on the waiting list. In Chesterfield and Yorkshire it took a day and the hospitals are far better. I live in a 1 bedroom flat, which is about 3-4 times more expensive than a similar size property outside of London, but my wage is the same. All the fancy houses and buildings you see here are privately owned (a lot by people who don't even live in London), not government funded. Although our transport is great, members of my mum's family died building the Tube in the Victorian era as it was a dangerous engineering project in those days.

Brexit has sometimes been portrayed as being largely about England and Englishness: Scotland and Northern Ireland voted clearly for Remain, while within England those whose primary national identity is English rather than British were much more likely to vote Leave. Wales rather inconveniently muddies this picture. It also voted Leave - an act that severely damaged the political self-image long cherished by much of the Welsh centre-left. The idea that the Welsh were more politically progressive and internationalist than their English neighbours was a shock to the Labour Party. The Welsh Valleys all supported Brexit - in many cases by clear margins. Yet the Valleys are notable for their strong Welsh identity. They have been staunch electoral bastions for Labour for nearly a century, and the Welsh Labour party was almost unanimous in supporting Remain. Valleys Leave voters also continue to be very sceptical of the idea that their communities, or Wales, had benefited from the UK’s membership of the EU. One final lesson to come from our discussions with Leave voters in the Valleys is not to expect many to change their minds when the Brexit process continues to be difficult, or even if it causes significant economic pain. Many of those spoken to thought that their communities were already in dire straits, and that it would be difficult for things to get much worse. Some short-term pain is already expected - but we ( the WELSH )think that it will be worth it for the long-term gains of enhancing the UK’s sovereignty and independence.

@@tomben6180 there are more London has 73 MPs (Soon to rise to 80); Wales has 40 MPs (Soon to be reduced to 32) - tell me again how Wales has MORE power? English MPs in London alone can outvote Wales on any matter it wishes - including to abolish devolution.
@tomben6180
@tomben6180 3 жыл бұрын
@@jimidave6281 Are you really asking me why a region of 9 million people has more MP’s than a region of 3 million? The reason you have more of a say is purely because of your devolved parliament and the fact they can manage budget purely in the interest of Wales, on a much more local scale. You get another vote for a further representative in this parliament. So not only do you have a local MP, acting on your behalf, you also have another in the Welsh parliament. When I only have the one MP. If it was remotely fair there would be no devolution or regions of England with devolved parliaments, one for the south, midlands and north. England has a population of 56 million, yet Wales with a population of 3m, and Scotland 5m, both have devolution whilst the English don’t.... then they fucking spend all their time moaning about it.
@jimidave6281
@jimidave6281 3 жыл бұрын
@@tomben6180 read what I wrote - I questioned no such thing. It's clear why there are more MPs - and in population terms, England has such a numerical advantage that it can vote for whatever it wants, with or without the consent of Wales, NI or Scotland. That isn't "moaning", it's simply pointing out a fact. Your point about localism is fine - but only when applied to England as individual regions. England as a whole, does whatever England wants. None of the other nations (even combined) has enough political power to stop it. English MPs could vote to dissolve the devolved administrations tomorrow.
@tomben6180
@tomben6180 3 жыл бұрын
@@jimidave6281 You’re looking it as a perspective of the English being one entity that are dictating their views on everyone else, whereas from an English perspective, we see the UK and Westminster as the parliament for the whole Union, with the other 3 home nations having local control we do not have in England. England hasn’t really existed as a political entity since the Union of Crowns, it’s been centuries since England has been its own country politically and Wales has only really had political autonomy, as a country, since devolution very recently. Wales has been a part of the Kingdom of England from about 900AD to 1707 when it became a part of the UK. So me, being an Englishman in the North West, I am just one British citizen in 66 million, but I don’t have a devolved local parliament for England or the north of England, that can represent me and budget for more local issues. I only have my MP in Westminster, covering my constituency, which you do too. The difference is you have your representative in the Welsh parliament. I agree that dividing England into regions and having devolved parliaments there, is a smarter move, than having one parliament for 56 million English people. But overall, it’s not as though the Welsh and English really disagree that much, is it? Both voted to leave the EU and both vote for parties close to the centre ground of politics. Taking Welsh vs English identity politics out of the equation and there isn’t really a problem. Personally, I’d scrap devolution entirely and would see the UK treated completely equally across the board. It wouldn’t be Welsh vs English vs Scottish vs Northern Irish. It would just be British.

“Cymru am byth “ “Wales forever “ As an Irish person , I can strongly recommend going the independence road .( you will never again look back and you’ll think “ why did it take so long “ Of course the answer to that is , It was mostly Westminster stogies who ran everything with their eyes fixed firmly on Westminster and what “title “ they may get if they towed the line . Ireland had been occupied by the Westminster ruling elite for many years. and then in 1800 the government in Dublin voted to become part of the UK ( yet not one true native Irish person had a right to vote at that time and it was Westminster appointed stogies who agreed to the union. It took us many years to throw off Westminster’s iron grip from most of our country . It was also during this time ( mid 1800’s ) that Ireland suffered one of the great atrocities of Western Europe , “ an gorta mór” ( famine) , when millions died and emigrated , even though there was plenty of food in the country .but pure capitalism ( the markets) couldn’t be interfered with according to the rulers . ( if people must starve to death because of this rule , so be it .”according to Westminster..” So yes , it will take courage , but you will be an independent small fish along with many other small fish , (Ireland , Scotland, and lots of other small countries..) It was only when Ireland joined the EU ( EEC) that we finally managed to shake off the jackboots of Westminster’s enforcers and manipulators The living conditions for everyone improved beyond recognition.. There are of course the usual ups and downs of modern open economies , ie 2008 but Ireland bounced back very quickly again and is once again booming because it was able to make and take decisions for itself in Dáil Éireann. When we were under Westminster rule , it was what was best for the southeast of England and tough on every other part of the “ union” Now , I’m sure that their may be some English people reading this and I want to assure them that we don’t hold the ordinary English people accountable for the dreadful acts of Westminster . Perhaps , some day England will be truly free and independent, not part of any union EU or UK . I do have a feeling however that the England ( land ) we know of today will need to divide into two ( at least ) separate countries as there are too many differences between the north ( more Celtic influences) and south ( more Anglo Saxon influenced) .

All the talk is about legislation and taxes etc. but nobody wants to mention our WELSH culture, something that has been drastically lost amongst years of United Kingdom nationalism and war time rhetoric. It is not about diminishing or even distaste towards the UK, but rather a longing for our own country with it's own vibrant culture and language making decisions on what is best for our country. As it stands Wales holds around 5% of seats in the house of parliament. Our welsh assembly is far from perfect but at least it is ours. It is not about segregation but about localised governing bodies that can better represent its constituents.
