The plaintiff claims the defendant damaged his vehicle's bumper outside a hospital, so the plaintiff is suing. The defendant says the plaintiff is making this all up and just assumed he caused the damage.

Only two states, Illinois and New Hampshire require a road test (at age 75). A road test may be administered at age 75 in the District of Columbia, but it is not mandatory. Pa offers a senior driving course if I remember correctly.

lol unfortunately they only make you retest after a situation like this. Once police report gets in system he will be sent something from DMV. My grandpa lost his license at age 90, when he got into two accidents in a month. Taking away your parent’s license is very hard.

In the Netherlands everyone who turns 75 has to take a driving test again. If you pass, your drivers license will be renewed for maximum 5 years and then you must take it again. This can be hard on some people, but it is simply irresponsible for those who just don’t have the reflexes or sufficient insight into traffic situations.

It was quite the opposite here and I think it was insane. Just a few years ago seniors no longer had to renew their license. So many crazy things started happening and i just saw they changed the law. An old guy crashed into a car right in front of me while I was visiting my friend, his car blew up right next to my friend's, it totaled her car from the fire damage and the car he hit. He did not pay for the damage and she had to file a claim for her parked car, I think her insurance later sued him.

@@modernretroradio993 Of course everyone has the right to travel...but, driving is a privilege not a right...one can travel by other means. Human safety is the top concern, that's why there is mandatory licensing and insurance in most civilized countries.

I am 67! I have told my family that if they think, at any time, that my driving seems to be a problem, I will stop driving. I will hate it, but I will do it. I could not live with myself if I hurt somebody because I should not have been on the road. My state renews licenses for 8 years at a time. I believe that at 65, they should only renew for 2 years at a time and have to actually take a road test to renew it. People always think they are fine driving, but that actually might not be the case.

I've worked with seniors for years. 100 percent of them have delayed reaction times and severely reduced spacial awareness. They would hit curbs and parking blocks. Not because they couldn't see them, because they couldn't SENSE exactly where they were. They may pass the eye exam, doesn't mean they can safely judge distance. Also, he can't hear and barely can answer questions in his own. There needs to be a specific DRIVING TEST for seniors. Not just eyesight and written. It sucks to get old.

Age doesn't matter. Defendant would have denied fault at any age. If you're a jerk at 20, you'll be a jerk at 89.

Each state should have a mandatory driving test for 65 and 70 years old and above . Folks are in denial of their reflexes and capabilities when driving while elderly. There are many incidents where elders have medical episodes or just plain lose control while driving and usually wind up killing someone else.

I know of an independent lady of 92. She lives alone, cooks (big meals during holidays) and drives. Sadly, I know of other 92 yr olds that can't even maneuver a wheelchair!

My granddad was 84 when he backed his car into a cement block wall and knocked it down with two blocks riding on his truck and when he got home he called my dad and said why did you put the blocks on his car dad took the wheels off his car.

Sadly, the defendant shouldn't be driving at all. He caused the damage to the plaintiff's vehicle and should have to pay. I could see that this one was tough for Milian once she sighed because to me she didn't want to rule against him but had to follow the letter of the law.

We can certainly agree to disagree. Milian doesn't always follow the letter of the law however when it comes to black people. My beliefs are my beliefs based off what I'm presented in these court cases. You're free to think and believe whatever you do. The sigh from Milian in this case signified to me that she didn't want to rule against him but knew she had to based off the law! She even invoked her very own father which even confirmed my line of thinking.

Driving should definitely have age restrictions; the annual testing over a certain age as others pointed out is a good idea too. People get really up in arms over their perceived ‘right’ to drive. But it’s a privilege; however its dangerous and lives are regularly shattered by accidents If he can barely communicate with the Judge in a quiet, mostly still courtroom - how on earth can he effectively handle the roadways? Absolutely not.

Elderly driving = drunk drivng. Its equal in impairment and in denial from the person. I've seen some pretty scary elderly drivers on the road. I couldn't imagine being so stubborn about something that's naturally going to happen, that i could potentially kill someone.

I re-took my written and driving test a few years ago when I was 70. The only mistake I made was looking at the backup camera while parallel parking. The Trooper said, "All the kids do that."
