Robert Durst stands trial for the 2000 murder of friend Susan Berman. The trial began just before the pandemic in early 2020 and was halted two weeks in. The restart happened on May 17, 2021, with the same jury panel.
The defendant’s wife Kathleen McCormack Durst went missing in 1982. Evidence and testimony would show that Robert Durst killed her, the prosecutor said. The defendant allegedly told Berman it was an accident and asked her for help. She served as his alibi.
Berman, 55, was shot execution-style at her Beverly Hills home in 2000, and the prosecution suggested that it was because of what she knew about Kathleen’s death and disappearance. As defense lawyer Dick DeGuerin would have it, however, Durst is innocent. His client only came across the body, panicked, and fled, he maintained.

@@discoparty7989 Yes, indeed. He made an analytical description of the case, as a prosecutor but he covered what it was missing in this suitcase, the presence of experts in body language and human behaviour. In my opinion, this is a huge missing of this trial and in generally.

Durst practiced his dismemberment first on his dogs, and the college student in Vermont who disappeared after last being seen by his health food store. It seems he genuinely enjoyed killing people and chopping them up when he felt they threatened him.

Agreed! If it weren’t for his money to keep him comfortable… I believe he would have killed to gain money from others … we’d be watching a trial of someone who’d be considered a serial killer rather than a trial of a rich man who killed a few people.

The avarice was stronger. He could have gotten divorced and paid the alimony, which would not have hurt him financially at all. If what is written about him is correct that he owns 65 million dollars.

The hairdresser had become her friend and I think he said she hadn’t paid him in something like 2 years? (I’d have to check, but I do recall it being years.) There’s also a difference between not having money for big things (like possibly thousands of dollars a month in rent, given the location) and having enough to spend $50 every other month.

Late watching this, but this was the best close I've ever witnessed, and I've witnessed a lot. Sadly I think the entire D fam lives like this. "I'll do what I want to whomever." Bobby just had more time on his hands. Douglas, "you're not successful" to Jarecki from Jinx.. God have mercy on their souls..

I think Balian has passion. But I feel like he’s unsteady with his closing. Same with Milius was much the same. They convey the information well, but make frequent missteps in their words and phrasing. I look forward to Lewin’s closing. He is much more confident in what he says because he has such an AMAZING grasp of every detail of the case.

Can someone explain why double jeopardy did not apply to this case? It kinda cheapens the system to know it does not apply suddenly in that the purpose of it has become less effective due to this biased judges ruling. Kathi would have been enough for Susan’s murder. It seems corrupt and it does indeed feel like a rogue governmental body doing whatever the heck they want. It was also highly inappropriate for the Judge to say bad things about the defendant on the record, which he has done more than once. The jury is not sequestered and it’s just another example that they can do whatever they want outside of the ethics of law. Bullies and a judge who kisses the butt of the biggest bully in the room.

Double jeopardy does not apply because he’s not being prosecuted for a crime he’s been acquired of (murder of Morris). And he’s not ever been tried for Kathy’s death. So there is no double jeopardy at issue. The prosecutor can bring up the other crimes or suspected crimes because they are the motive for this one he IS being prosecuted for.

@@kyletevis That makes even more sense so thank you. I have never seen a connection between Morris and Susan. Where is the evidence there was. I think he is just murderous and Morris made him mad personally. It has felt like Lewin has something on this Judge all along since the Judge seems afraid of him. Something fishy within a governmental unit. Not surprising there.

I object to the audio/visual presentation during closing arguments. Closing Arguments should be verbal only. It is up to the jury to recall the testimony/evidence.

@@PosthumousAddress The joke telling. They should stand at a podium and ask a direct question. They demonized the defendant and that is how they got their conviction.

@@themonalisa5614 that’s not how trials work? You may not like it, but demonstrative tools have always been allowed. It’s just mostly digital now. The closing arguments are to sum up the evidence. The jury has the actual evidence to use in their decision, these are just tools, and the jury doesn’t use them in deliberations. They are not basing their case on demonizing him. If you don’t see the evidence, I don’t know what to tell you, but if they have demonized him, it’s only by showing what his actions and statements are. Which means he’s demonizing himself.
