Hello everybody out there in social media land, it’s your personal injury attorney, Derek Bernstein here to answer an important family law question is can a mother stop a father from seeing a child? So, this is an important question I get, and it's really two problems. So, one there's the assumption, do you have a parenting plan in place? Have you already had that done? If that is so, and you have a parenting plan that says, dad gets him every other weekend, can a mom stop him? Then the answer would be, no. It would be inappropriate. Say if they're behind on child support, just making you angry, you don't like things, you still have to allow the child to see both parents. So, you have to allow them to that. If you do not, the other parent could bring motions for contempt and enforcement, bring it to the judge, the judge is not going to be happy to hear that you're withholding the child and using them as almost like a punishment for either issues between you as parents or money issues.
Don't let money issues get in there. If you need to adjust and modify the parenting plan, because there's an issue there's a proper way to do that. Reach out to your family law attorney to handle that on a modification of the parenting plan. But on the second one is if you had a child with somebody when you were not married and paternity has not been established with the courts, maybe their name is on the birth certificate in Florida, but they have nothing there, then yes, technically you can withhold from the father because there are no parental rights been established. Therefore, you as mom have all the rights, you can withhold dads out there, if you have a child with somebody when you're not married, this is some old archaic looking ways to do things and stuff like that but that's the way it is. So, if you have a child with somebody and you're not married, you need to go to the courts and establish your parenting. So, it's your personal injury attorney and family law attorney here.
