If it's a Friday, the judge could leave early for the weekend or not come in at all, thereby the person stays until Mon., unless that Mon is also a holiday..

A citizen walking into a public municipal building should be treated with respect. Recording their own visit and interaction should not be met with hostility.Any public servant failing this reasonable principle can no longer serve the people.

Since he doesn't have the right to film, and in fact the judge has issued an order that says he not allowed to do it why should they be respectful or treat him with respect when he's doing something that he knows he's not supposed to be doing? They can serve the people all they want, but they're not required to do it the way you say because that they don't work for you and you're not the boss

@@gorge6180 Now, but the judge's order is enforceable and final. You would need another judge to override that judge's order before you would have permission to film. If you went in there filming in defiance of the order you would be arrested, and you would be going to trial. What you fail to understand is the only place a judge actually has to allow filming is in the immediate public area of the lobby. Beyond that they can restrict filming as they see fit You don't agree? That's unfortunate… The judge doesn't answer to you and doesn't care what you don't like or don't agree with. Their authority within the courthouse supersedes your opinion And before you go down that road… No, the Supreme Court has never made a ruling that says you have the right to film in the courthouse. It's never happened. Not that one or any other. In fact quite the opposite.

In fact, if you were to defy that judge’s order to not record there, he could sentence you on the spot to between 30 and 90 days in jail.* *Thats long enough to lose your job and default on both your car and house payments, so it’s even **_worse_** than just getting arrested.* *But go ahead and push it if you want- see what happens.*

In this day and age, you would think law enforcement would at least watch one youtube video and learn the law. The fact they can still violate and keep their jobs is amazing to me. If they learn the law, then they would lose qualified immunity on just about all cases. As long as they can play dumb they’re protected. It’s the only career in the US that you don’t actually have to know how to do the job to keep all the perks.

It never ends. No matter where you go, conduct an audit or video of our government. They hate transparency. Sean, you are right. We have a country of sheepeople who will follow the rules of their bosses or supervisors without questions despite the moral implications or ethics. I worked for the County of Los Angeles Dept of Mental Health for almost 20 years, and it's the same thing. There is such a huge waste of money on training that is not implemented or adhered to by staff that most don't understand or ignore. HIPAA training every year, and some staff give patient information to anyone who calls and claims to be a friend or relative. I didn't know our rights until a few years ago and began watching KZfaq. Now I have books and case laws. This subject isn't taught in school and should be. Thank you, JR Boise

He knows the difference, they know the difference, it's why they keep trying to call arrests detainments. They can legally get away with more if they call it a detainment. Until police started getting sued on the regular for illegal arrests detain wasn't even in their lexicon.

IF a person is detained for more than 20 minutes, and then taken to jail, it's an arrest, regardless of what the police call it.

It varies by jurisdiction. Rhode Island allows up to 2 hours if RAS _of a crime_ has been, is being, is about to be committed. Unbelievable. Further, _'The police may demand that person's name and address, and may inquire about that person's activities. If the person fails to identify himself or herself and explain his or her actions_ *to the satisfaction of the police, he or she may be detained for further investigation.* _This detention is not considered to be an arrest, and at the end of the period of time the person must be released unless charged with a crime.'_

I would say "yes" but I think the rude ones are the exception. My postal lady is one of the nicest people I've met. The people at Social Security and Access were also very nice. It's the triggered people, like in this video, that ruin it for all of them. (And cops are especially bad.)

I live in RI and have been in this courtroom unfortunately. My wife was arrested because she got pulled over as a foreign exchange student and the officer didnt know her foreign license was valid in the US. Dumb ass cop got put in his place after we fought it in court because he didn’t know reciprocity laws. All cops should need a masters degree or more!

The immediate hostility of Paula and the officers is so telling. They are used to bossing people on probation around, knowing those folks on probation have put themselves into the precarious situation of having less rights, which the public servants clearly are happy to leverage and exploit. When the officer would not discuss anything further and would not let you read the order inside while threatening (rather gleefully, I thought) to put you in a cell and imprison you for several hours even no crime was committed, he showed exactly what type of tyrannical group these characters belong to. Really disgusting public “serving”!

You have the chance to go do it "right" then... Legally, the threat of arrest is just as damning on them as an actual arrest, so there is no benefit to getting arrested. It also gives them chances to go back on that and later claim they decided not to arrest then which could hurt his case

I'm sure we've all noticed that more public buildings that happen to also have a court room are having judges designate the whole building off-limits to recording, not just the court room and secure areas. This is a disturbing trend.

I'm not sure its corruption, its more insidious, its cowardice. The law is all about nuance. Yet they seem to not care about the nuance of protecting our civil rights. They usher in the tyranny of a police state, which they themselves won't like when it ruins life for all of us including the people in there own family's. Most LEO, in their own personal lives, while off duty are constitutionalists, they lack the courage to hold themselves and their superiors accountable. They are scared of the same police state they are helping to usher in. Its a vicious cycle that must be stopped by we the people.We can do this by holding them to the higher standard of oversight by WE THE PEOPLE. With peaceful exercising of our rights. Especially at a time when our rights are being ground to dust. The soft tyranny of a police state is quickly replaced with total hard dictatorships and usurpation of liberty. The cowardice is palpable. They are pathetic. They must be able to tell the difference between a lawful order and an unlawful edict! And they must feel WE THE PEOPLE have their backs, so they have the spine and backbone to have the courage to do what is difficult, protect civil liberties and rights.

LAW ENFORCEMENT is different from POLICY enforcement. Policies must conform to the law. LAWS must conform (not oppose) the CONSTITUTION . Wow isn't this neat (educational) stuff that should be taught in the academy and the POLICE departments? !

Personally, I would have loved to see a judge try and explain that one. I'd gladly sit in a cell for a few hours if it gets the staff reprimanded, or uncovers another layer of corruption

Orders from Judges are ruining our rights in courthouses around the county. Bad part is that even taking the issue to Federal Courts will not likely help because they have that rule as well in Federal courthouses. The court system is our least transparent branch of government and it needs to change. I do thing the judicial orders can be challenged successfully but in the long term I believe that no recording in courthouses will be codified soon after.

Instead of looking up the actual statute about no recording in "the court rooms" they would rather detain or threaten to detain you if you don't comply with their misunderstanding. Why? Because of accountability. Where is the penalty for violating civil rights?

I've been trying to wrap my head around why public servants despise being videotaped. The best theory I can come up with is that they don't want the public to have easy access to how blatantly our tax dollars are being wasted. Out of sight of the taxpaying public, out of mind of the taxpaying public.
