If you have $3k to pay for car rentals but not $200 to pay for the rest of the car something doesn’t seem right. Not to mention refusing to communicate when you would be able to resume payments is an issue. Personally I feel like they were just trying not to pay for the car. And why is he calling his foster family “fake family” like they are literally your fake family but seems to me like you want to be around them because that’s a choice.

Agreed. He wife tried to be his word-coach. Nevertheless, their verbal skills used here in front of the judge are a not favorable. I sure don't want to hear the way they talk amongst their friends, family, and frenemies. Ghetto behavior is not in someone's favor, neither is trash-talk as overheard when she was sifting through the vehicle. Also the physical fights amongst each other is another sign of a very low educational level and environment. Remember, how you present yourself is how you will be judged. We all are humans, not one of us is NOT NON-JUDGMENTAL. We see, listen, hear, feel, we judge. End of story.

"Fake family"? He cared enough about them to be visiting with his foster family that day, I think that Mrs. Boston is a meddling mess. She should have been ashamed, between the video of her in her undies, and the mess that car was in, she needed to sit down! I agree with Judge Schlesinger, there has to be humor for those rough patches, and learn to fight fair as well. Never, ever say anything you regret later. Its worked for 35+ years for me and my husband, nice to see another couple in the high double digits!

Judge Milian is (once again) wrong. If you were late for a payment, and the dealership called, and you went over to the dealership and FOUGHT THE OWNER, they ABSOLUTELY would repossess the car. It's called a repudiatory breach of contract. Meaning the defendant had a good reason to believe that they WOULD NOT FULFILL the remainder of the contract, constituting a breach. It would also be applied if one or both of them went to jail.

And I agree. $800 for the time they had it is really cheap, that’s what she’d say. That she didn’t get cleaning fees is absurd too. If it was that easy, many people would do it. It costs money to relocate and many folks who live in underserved areas have very little savings and resources. Many might be working retail and service jobs that pay very little. Additionally, housing is exponentially higher in "better neighborhoods". So I wouldn't assume that folks are choosing to stay in the hood.

Even if they're only $300/each and I could make it across the country and survive until I secure another job and make it to my first check. I can always reestablish myself. But I am profoundly aware that MANY people cannot do anything even close to that. I get it. I understand. I moreso wonder where people's fighting spirit is, but I also understand that can be beaten out of a person or stolen away.

@@shelbygreen5132 I feel you, and I appreciate your genuine and respectful response. I alsonaalute your drive and determination. I do believe that the fighting spirit can be beaten out of people. Some folks become hopeless. But there's another thing at play, I think. I honestly believe some people don't know they can do better. Their entire lives have been circumscribed by the neighborhoods they live in. They don't realize that there's another way. Did you ever watch the HBO show The Wire? It's a gritty but realistic portrayal of drug use and poverty in Baltimore. There's this one scene that sticks with me that relates to the discussion we're having. One of the main characters has lived in a housing project his entire life. One day he has lunch in an arboretum and can't even locate where he is. He think he's in an entirely different city because he can actually see trees and hear birds and appreciate a quiet that isn't marred by gun shots. He's LITERALLY a few blocks from his home and can't tell because it feels like he's in a different world. So I, I agree with you: not everyone has the drive to move someplace else. But I also think some people don't have the perspective to imagine a "someplace else". I didn't mean to write so much, lol. But thanks for the discussion.

the judge is right but it has me remembering when my bank repossessed my car when it was paid up and the next payment wasn't even due yet. YES, this really happened. Had to get an attorney & I got the car back within 2 days. Was never late with a pymnt and never missed a payment, plus the bank themselves were pulling the pymnts by auto pymnt. Affinity Federal Credit Union in Basking Ridge, NJ....I should have taken that as a red flag because they also held my mortgage & fucked that up too by not applying my pymnts properly for my house, they wound up foreclosing on me & selling my house without any notice, took them to court and WON.

I don’t agree with the final verdict. These people put mileage, normal wear and tear on a vehicle that continues to depreciate for free. They can afford a $3000 rental car expense but can’t afford a $1,000 vehicle??? It’s beyond my comprehension.

You disagree with the final verdict because you don't like the fact the plaintiffs drove her truck for 3 weeks essentially for free. My point is that if the defendant didn't want that to happen, she should not have repossessed the car after 1 day. She should have just sued for the remaining balance to ensure she got ALL her money for the vehicle.

But, she accidently admitted that she didn't do it for that, she did it for revenge bc of the fight, and that is what messed up her case. If she would have remained silent or just said she repoed for breach of agreement, she would have for sure won. This is why the judge was asking her questions in a certain way.

They shouldn't have gotten the full $800, because they did have use of the car for a few weeks, so it should have been a prorated amount deducting for the amount of time that they did actually have the car. The defendant should've countersued for the damages to her car from the hit & run if that really happened.
