Does supreme court in sane countries meddle into monetary policies of the fed reserve Bank or Central banks? So if CBN MPC raises MPR, state govt can go to SC and stop it. Chai! Nigerian Supreme Court is for the highest bidder. The governors in Nigeria were able to secure judgment from Supreme Court in three days but they couldn't sue the federal government for lake of petroleum products. The Supreme Court declared a judgment for the release of Nnamdi Kanu, but the government said no. This same Supreme Court declared Lawan the candidate for senate when he didn't participate in the primary election. Nigeria is governed by a criminal syndicate and the result is what you are seeing.

Mr. Falana should understand that there is nothing supreme about the Supreme court because the court has reduced itself to a mere tool in the hands of APC government. They are using the court "any how" The Supreme court was used by APC government to remove a democratically elected governor of Imo state and imposed a fourth positioned candidate in the election on the state. It is not surprising to note that the same APC government can back the CBN governor to disregard Supreme court. So whatever Supreme court sees today is a self inflicted harm

CBN has every right not to listen to the Compromised "Supreme" Court of Nigeria. The Supreme of Nigeria is a disgrace to the judiciary system in the whole world. In the first place, the supreme court has no jurisdiction over monetary policies of the CBN.

Monetary policy is taken by by the federal government, not just cbn. That is why the supreme court has jurisdiction. Cbn is just an agency if it's principal which is the federal government. Cbn can only be added as a joiner as the case proceeds.

Its been 4 months and counting since the redesign of naira notes was announced. Arrangements could have been made for them to ease things. How were you getting naira to them before?

I disagree with the SAN. Does the Supreme Court has jurisdiction or not?, not does it assume jurisdiction. Does it have jurisdiction or not? The answer is NO. The Supreme Court was clearly bought. This, at its root, is a constitutional issue. This case doesn't fall within the original jurisdiction of the Supreme Court.

Falana is correct on his first position-that CBN should have respected the Supreme Court's interim order. However, he ignored the fact that Nigeria's Supreme Court is corrupt, politically partisan, and has incompetent justices. A Supreme Court that brazenly installed Hope Uzọdimma as governor of Imo state and crowned Lawan the winner of a senatorial primary of which he was not a candidate should not be surprised if it is reviled by Nigerians or that its rulings are ignored. Falana is wrong in minimizing the importance of jurisdiction on any matter, jurisdiction is the ground upon which all court decisions stand. If a court wrongly assumes jurisdiction on any matter, its decision on that matter is ideally as null as if the case did not go to court. Is Falan suggesting that had a Housing Court made this decision it must be respected even though a Housing Court would have no jurisdiction on such a matter? Nigeria sometimes operates like a zoo.

@@blacdadi2023 The Supreme Court is not the enforcer of the law of the land, it is the interpreter of the law, which the executive enforces. If a Supreme Court asserts jurisdiction over a case it has no such jurisdiction, it violates the Constitution, so any decision from such a case is a nullity. By no means am I emphatically asserting that the Supreme Court has no jurisdiction on this particular case, I don't know that for a fact, I am only arguing against Falana's pronouncement, that once a court asserts jurisdiction on a case, the court's decisions must be obeyed.

They do, even over a president. If a president failed to follow that supreme rule, the president will face the music once he/she becomes 'EX'. Nigeria runs a Democratic system of Government based on three Arms of Government which are Excecutive/Presidency, Legislative & Judiciary. Each One is independent of the other.

Pls tell me if we have rule of law in a multiple nations claimed to be one nation, one Nigeria. We are all deceiving ourselves. The rule of law being practiced is one sided. I think the scale of justice must be balanced????

To move to cashless society will only happen if its more convenience and easy for people to have anothe mean for transaction betetr than use cas as the cxash is more risky with carry costs. That could not be forced people to do it!

It was the President 's idea in the first place to redesign the currency for the reasons enunciated. Now that things have come to a head vis-a-vis the Supreme Court's pronouncement, why is the President not expressly giving the CBN a directive to comply. After all, some have argued that the CBN is an agent of the President and take orders from him, notwithstanding the CBN Act and the autonomy conferred on it by the Act.

Falana did not answer the question of who is going to enforce the supreme court order which is not obeyed by government. I was waiting for answer but he evaded it intelligently like dubious politicians would do.

More importantly Cashless economy is not absolutely compulsory. Cash and Cards are being accepted in the so called developed countries. Therefore either it is monetary policy or not, it is illegal to force it absolutely. This development has set negative precedent in the country with respect to: 1. Supremacy of Supreme Court in all matters according to the constitution 2. Banks decline customers withdrawals on funded accounts 3. Banks rejecting legal tender currencies while matter is in court and status quo supposed to be maintained.

Like Mr. Falana said we are running a secretive Government - how much did CBN gave the banks we should know. You can only get 2 new notes from 20k dispensed directly from the ATMs to even get the chance to withdraw is like a war, long and unending queues is the other of the day. Confusion

He did answer the question. He said the plaintiffs were responsible to enforce it. We know the plaintiffs were the state governors which are part of the whole government so the federal government needs to enforce it but chose not to because it supports CBN decision. Bottom line is Nigeria does not obey the rule of law but cherry picks what favors them

If you noticed some governors had already put the laws in the hands by closing down supermarkets because of the Supreme Court’s decision but the state governors do not have the power to close down supermarkets without going to courts. But this is what Falana was saying, if you fail to enforce or obey the law, it would lead to anarchy. Federal government is in charge of security, so they need to obey and enforce the courts ruling but chose not to

Lawlessness is the "cake" of Nigeria. Supreme Court order not obeyed by the government..Let the government get rid of courts and Lawyers duties in Nigeria. All universities in Nigeria should stop offering law courses. The president /cabal makes the tyranic laws. Corruption fighting corruption with the "cashless " policy. It appears the military is coming up to rule Nigeria again.

It is all a ploy from the presidency and CBN to take down the Bismarck in Nigerian presidential race. But, it is too late. The massive vessel is out already, and its seeming leisurely cruise to victory is the instance for this ruffling of the waves against his glide.
