As I wrote in the response to blackbeltbarrister is that this law forcing you to comply with the TV licensing officer to aid them in finding out if he was watching television. I have seen videos before where someone was forced to show the license officers potential evidence of him violating that law. But IMO this level of forced complication ought to be seen as a violation of the human rights any person ought to have. If one of these capita goons arrives with the police you have to let them in, fine, but then you have to comply with the capita employees to prove you do not watch TV. Well Fudge that, letting them in, fine, a judge signed off on it but after that it is down to Capita and the police to prove you are able to watch live TV. As a suspect of violating the law, the European human rights state that any suspect has the right to remain silent and does not have to aid in the investigation of the crime he is accused of. So no person who is confronted by these goonish figures should be forced to help them in their investigation but that is approximately what blackbelt barrister stated because of you refuse to comply with the capita goons your penalties go up.

@@petervandervliet640 As I understand it, it is not enough that they prove "you are able to watch live TV". They have to prove that you do or have watched live TV without a licence.

Yeah they would rather arrest people who make edy jokes online than do their actual jobs😤 I'm referring to the scottish youtuber "Count Dankular" who was arrested for making his dog do a nazi salute to piss off his girlfriend. The Scottish police literally went out of their way to find a jewish person who found it offensive just so they could fine him (it took them multiple weeks to find one) not only that but in their court case they stated that they are ALLOWED TO IGNORE CONTEXT despite the fact that he stated it was just to piss off his girlfriend at the beginning of the video 🤬

The license is for watching 'live' TV. There are so many repeats on tv, so 100% of what you're watching does not require a license. ergo, you are being overcharged... they should do as sky does, a code is needed to get access 😊😊😊 - sorted...

No he handled it terribly. He blocked a search warrant. He would have ended up in court. The BBC do not want to get involved with forcing entry to homes for PR purposes. So a fine for blocking a warrant is seen as a win too.

​@@nevermind824 the search warrant was fraud. It can be easily proven in court because they went from heresay to obtain the warrant instead of actual proof. A person must either admit to watching live TV or video evidence to that fact to lawfully obtain a warrant.

@@nevermind824 I don't think so, otherwise the flatfoot would have entered the property but he didn't. I doubt any such "warrant" entitled the goon and the pen-pusher to enter the property - that's not how criminal search warrants work. Of course, it's quite possible that "criminal" proceedings could occur and the householder might end up in court, but it would reflect nothing less than abuse/corruption by the judicial authorities which, unfortunately, have a long history of doing whatever they like, in total disregard of actual, true, justice.

That was the only thing he did expertly. The copper shut up after that. But he's still in big trouble for failing to assist in the warrants execution and had the agent decided to execute, the bloke would have been arrested for not keeping the peace. As it is, he will now receive a court summons instead.

from other videos I've seen them do a lot of 'assisting' - one solution I saw was put the camera their faces and insist they answer the question: 'can you confirm that you are acting under your oath in this matter/at this time' that scared them off.

@Trixie K Absolutely. TV license warrants are issued under section 366 of the Communications Act 2003 and it only gives the power for "people authorised by OFCOM or the BBC" to enter a property. Police have ZERO rights under this act and if they're actively assisting the goons then they're acting outside their powers and opens them up to a civil claim.

He is being a smartypants. That was a valid search warrant, so he's now committed a crime and will likely have to pay a fine of thousands of pounds. He was also a smartypants for arguing about the law on the first visit. For those of us non-payers who are honest, just say "No thanks" and close the door. For those who are watching without a license, if you have it on and the person hears it, I would accept you blew it and pay the fine, though you could try claim it's YT like this guy but then permanently disconnect it after that visit. Why are you watching the BBC anyway? It's poor quality and a deep state mouthpiece

Australia quit issuing tv licenses over 50 years ago. It is totally ridiculous requiring a license just to watch television.

Be careful what you wish for - ABC is funded by the Australian Govt (i.e. Aussie taxpayers). The same applies to several other countries where there is no TV license, and it has been suggested that such an a pproach be taken here in the UK. This means you pay whether you watch or not, through direct and indirect taxation. Accordingly, you don't have a choice about whether you pay or not. We do, so thanks to Jon I don't watch live TV or iplayer and I don't pay the licence fee.

@@user-bo3mp8un6c well considering the officer there, isn't a special crimes officer clearly by uniform, as most burglary investigation teams operate plain clothes or smart attire, so he's a regular patrol officer or probably a neighbour hood officer, so he gets assigned this. All the investigation a regular officer does for a burglary is take a statement and arrange forensics and then write up a report and then pass it onto the other team not much investigation to be done. Only really matters when you know who committed the burglary. Most Police are required (if asked) to attend a call from bailiffs and or TV enforcement agents if they are executing a warrant on behalf of the courts. All I see in this video is a TV enforcement agent, who probably always asks for police to come as he's had a lot of problems (wonder why) a random bloke can't remember why he's actually there and an officer that's literally just standing there. So much force 🤯.

You seem to be struggling with the use of force in this context to describe their presence. The dimwitted and often poorly educated police officers don't know enough about their job to question the BBC abusing it's powers so they just go along with it and only act in protection of the agents' rights, not the tenants. You seem to take things too literally. Do I think those exact officers should be investigating a burglary? No. Do I think the wasted funds should be put towards better use such as actually getting on top of real crime. Definitely yes. Don't be such an aspie about it and try considering the purpose of my argument.

Actually a JP (Justice of the Peace) has the power to sign a Search Warrant. They are the "go to" people who authorize warrants. Judges (District Judges, Circuit Judges, High Court Judges etc, rarely issue a Search Warrant)

No, that's not how that works. A warrant privileges the holder entry without consent to find evidence of a crime. If they needed consent, that wasn't a warrant. If a justice of the peace had the authority to issue a warrant, then consent was not required. Either they were not issued a warrant, or the issuer did not have authority to issue one.

@@Fightladsnet To issue a warrant to someone who is not an officer of the law? They tried to enforce a court order without getting a proper warrant. The homeowner recognised that what he was looking at was not a search warrant, which is a very specific document. If this had been a legal search warrant, it would have been served by the cop and he would have been the one responsible for its execution. Instead he was, by his own admission' just there to keep an eye on things.

There is NO way anyone can say anyone is watching Live TV unless they break the law by being on the property & looking in a window. Nobody in their right mind invites these guys inside. He was doing exactly as I would do & as he said the Warrant isn't valid as it was not signed by a judge. The constable with them should have been more informed than he seems to have been as it takes a Judge NOT a magistrate/Justice of the Peace to sign a warrant like that.

A Justice of the Peace is a "magistrate" when on a bench in the local magd and is empowered to make a lot of orders including a search warrant alone as long as he is independent of the investigation and convinced beyond reasonable suspicion. This disinformation about a Judge needing to sign it in a certain colour of ink blah blah needs to stop. You won't care what's on your committal warrant when you're sentenced to 3 months for obstruction. Also, the point of a warrant is to override your permission to enter a property. The police are only there to prevent a breach of the peace. Nobody ever DIYed an acquittal for TV licensing.

He also drew attention to himself by writing to Capita refuting whatever contract about receiving live TV. They base their suspicion on witnessing him live sport on TV through the window...that's reasonable suspicion. They weren't trespassing when anyone is allowed to seek entry by implied consent such as a door bell and wait a reasonable time to be received and whatever they witnessed in that time on his TV. Giving them an ultimatum about proving him watching live TV there and then is the reason there is an ordered process called a trial. If he wants vigilante justice then the nearest lamppost was just metres away from what I saw. He's the kind of neighbour who follows and insists on the rules when in suits him. He's the tenant who refuses to respond to an eviction notice until default judgement has been given against him despite adequate notification from the courts. He'll bring up things at a tenants' committee that suit him when he's a duck of a neighbour an the first to call the police over a noise complaint (not videoed or any other evidence unless it suits him like this encounter)

overseas they had a TV Detection van driving around taking Radio Frequency readings... your TV gives off very small signals of a certain frequency.... once detected, they would drive around the block, take some more readings and triangulated the source of the signal........ drawing lines on a map and identifying your house as the source of the signals... proving that a TV set was switched on and working. (They couldn't detect whether you were actually watching it). They has the list of all currently licensed addresses. If you were not on that list of paid up license holders, you would get a visit soon after from the TV License Authorities.... but different jurisdictions had different rules, so I can't comment further on the British way of doing things. In my country a JP, or District Court Judge... or a Court Registrar may sign a warrant.

All this argy bargy about 'it needs to be signed by a judge' and 'he needs to prove he saw what he says he saw' will cut no ice with the court. They'll accept the witness statement and he's getting fined. His refusal to allow them access to his property was impressive, but it's not going to make any difference at the end of the day. It's like those videos of people successfully resisting bailiffs. What they never show is when they come back mob-handed on day 2 and lash them out into the street.

You don’t need evidence to execute a warrant, you need to to get one issued. Once issued it should be executed. If it was sworn on false testimony then that’s a serious matter of (I believe) perjury and for the court to deal with.

And totally illegal. The right to enter a property only refers to the path to reach the door. Once that entry has been rescinded by the man all three of them should have left the property and as he said conducted the issuance of the warrant at the gate. The warrant is to search the property and force can only be used to enter a property if a crime or suspected crime is in progress. Not having a TV licence is not a criminal offence any more

@@geoffsmith5563 I have 5 CCTV cameras covering the front of my house from all angles, 3 with audio recording at the door. I can video from the gate to the door, record any conversation at the door, one camera gives an overall picture of the street to note any cars parked and which house they go to and the final one shows any one looking into the front window deviating from the path. They’re not specifically for the TV licensing authority but to prove who delivers Amazon parcels or not and record callers when I’m out. They have been quite useful when “discussing” lost parcels, and whether or not a tradesman has called as arranged I.e calling between 8am and 12 noon then being told they called and no one was in. Plus I have a CCTV in my lounge that records audio that picks up the TV program when ever I’m watching TV. All cameras date dated and timed to prove when the TV man calls and claims I’m watching live TV, I can prove what was on my TV. Not that it matters as no TV is connected to the Aerial. But The B……………d hasn’t turned up in 6 years 😀😀😀😀

No, he had a legit reason to walk up to the door under the assumed right of access. From there if the TV was visibly on then he should have taken a photograph or short video showing the date/time on the photo/video as evidence to back himself up. Without that photo any decent judge should throw it out of court as it's just hearsay.

Several years ago (late 1980's)I lived on a council estate that suffered a "purge" by these TV licence goons.. It started with letters being sent out on a very regular (weekly) basis to all the houses on this estate that did not have a tv licence. I was one of them, but as a single man at the time who spent most of his time either at work or in the pub, I actually did not have a tv set in my house. I usually dealt with the TV licence letters addressed to "the occupier" by writing "not at this address" on the envelope and putting them back in the post box. Sadly I was not at home when the goons called en masse one evening, had I been there I think I could have had a lot of fun. One of the things that struck me was that in this video the goons were adamant that one of them had seen a tv in use through the window. Is not that kind of behaviour illegal in some way? But returning to what I was saying, one of my neighbours was a young mother who struggled to make ends meet and she was targeted. She showed me the statement that the goons had given her and I was astonished... This was in the days when you could buy a black and white tv licence, but on the statement it said that she opened the door and the "officer" heard a colour television.... So the sound is also in colour? But I also gave kudos to friend of mine who was one of the few who did not incur what was a £75 fine at the time when then goon who knocked on his door on his first floor flat, after being refused entry said " I have a right to enter this property" received the reply "and I have the right to throw you off this balcony if you try"

Nice account, and I have only had one visit, some years ago, none since. I do as you do, post back the letters. Now I no longer get any letters because I laid down the law to them, and that was that. It isa criminal offense to harass someone, in this case for monies. When a warning letter came, I informed them that aside from harassment I would take them to court for demanding monies with menaces, because that is what they were doing. I do not have a tv, and love one of them to come here with the fuzz, that would be funny.

Well done. I stopped paying my licence because I don't watch (as a policy - too propagandistic) and informed the BBC once just to be fair. I've have since received 4 or 5 letters becoming more and more threatening, but I don't respond because every letter sent my way is a cost to the BBC and hopefully they will also pay Capita to send someone to my address, at which point in time I will simply say "No thanks" and close the door.

He had better pray that there is something wrong with the warrant, beyond his misguided opinion that it needs to be signed by a judge! True, but if a TV is visible from the public street or on a direct route to the front door while using the implied right of access it's unfortunately fair game. A goon isn't allowed to divert and peer through the window however. A defence that it wasn't live TV on KZfaq is a good one, they'd have to prove it wasn't. This person helped them obtain a warrant in the 1st place however by breaking the golden rule, he not only engaged with a goon, but he caused further suspicion by using the invalid defence that an Act isn't a law. I know all about the common law and statutes argument, but whether we like it or not, it simply doesn't stand up in court and trying to use it often works against you.

Handled 100% effectively and appropriately. In all cases where people make claim against you it is important for you to say, and write, that you disagree and that they must PROVE IT. I had a rogue debt collection company after me for twenty quid £20. I didn't owe it. I wrote to them disagreeing their claim and asked them to prove it. They've continued to harass me by text and email which is a criminal offence of actual psychological and physical harassment. If they end up loading their claim against me with costs I will tell them to take me to court where I can produce my evidence of their physical and psychological harassment after providing no evidence and I can also produce their made up energy bill invoice which is in dispute which clearly states readings are only an estimate. Ive already proved to myself that these bstds are nothing more than thugs so I'm happy to go to court and see them shamed. It will be my pleasure. Stand up to thuggery and tyranny folks. Know your rights and don't allow yourself to be a victim.

@@shaunpatrick8345 the company went bust before my contract with them began. No documentation. No switch over date. No communications from them. The administrators appointed dealt with all debtors as they should. They then sold the database to a rogue debt collection company portraying as Solicitors. Thats when the abuse started so I wrote to them to supply evidence of their claim, a prove it letter, and to not intimidate me with psychological harassment by way of texts and emails. They sent a piece of paper with a made up estimate on it and continued the psychological harassment. This is where we are with matters and I await their continued psychological harassment daily. I hope it all ends one day but it will only ever end in front of the judge. BSTDS!!!

Handled calmly and factually. Legal systems operate firstly in fact. Their ‘warrant’ was purportedly based on a fact. That ‘fact’ had not been put before a judge and was not proven. Therefore their warrant was invalid. My God, that was very good to watch. Well done that guy!

Well done, what evidence did they present to the court to obtain the warrant? They claimed that the court accepted the word of an enforcement officer, but what made him suspect that live TV was been watched. The fact that they backed off makes me very suspicous.

That's the first thing that came to my mind, firstly the homeowner is not going to admit watching a TV, and secondly the licensing goon's would have needed to look through the homeowner's window to observe him watching TV, therefore they would have no legal grounds. I wonder what evidence was put before the court to issue a warrant!!

The BBC do not want to get stories in the news of forcing entry to single mums who can't pay their tv bill (It is mostly single mums who get caught for some reason) and it is bad PR. So they take refusing entry for a warrant as the next best thing. He would be in court. Capita are happy to take refusal of a warrant as a win. They get paid either way.

This is how i stopped that tv license bs: Dear tv licencing, im requesting that you stop transmitting your tv signals into my home. I have a tv set and its hooked up to a dvd player and i use it to watch movies in the privacy of my home. You must cease and desist the transmitting of your tv signal into my home immediately as you do not have my permission to pollute my home with your tv signal and i dont want it. Theres never been anymore problems coz this worked. God bless you.

the policeman had a right to speak. In fact he was asked questions and was expected to answer. Same as you having a right to speak. And yes, police do often assist with search warrants. Sometimes bailiffs. It depends. Nothing unusual about that.

You shouldn't be! You simply don't speak to them when they call at your home. Close the door. Without evidence that you were watching live TV or recording it, they cannot apply to get a warrant. The man in this video made the mistake of conversing with the licence checker during the first visit. I gave up my licence in 2014 (legally - don't watch or record live TV), and I have never even had a visit in nine years. I haven't informed their records, either, to state anything.

If you don't watch TV, you have nothing to fear. This was not a normal goon visit where you just send them on their way with a sneer. They had a court warrant, which they get few of. He had to have let them have sufficient evidence to put before a court to get a warrant. In refusing them entry he sets himself up for a fine for obstructing the fulfillment of the search warrant. If you are going to not pay AND watch, then don't leave the TV on in full sight of the street outside when the goons come round. If you don't watch. No worries.

Years ago in the 1970s I was arrested for not having a TV licence. A woman police officer and two licence men. When I was read my rights I laughed. The policewoman said it was no laughing matter and I said Yes it is. I am not a criminal. One of the licence men was particularly unpleasant and just looked at me as if I was dirt. I was 18 at the time. When I attended court ,the court was packed. Every one in that court room was there for not having a licence. When asked if I had anything to say I told them I was being victimised for being poor. I was still fined. At that time there was only BBC1 and 2 and ITV . The TV was just a black and white picture. I think there was colour TVs around but I didn't have one.

@@robwilde855 They were able to pick up who was watching TV and then check if that house had a licence . They drove around in a van so I suppose they had some sort of equipment in them able to pick up the signals. When I was in the court a lot of people denied using the TV but as far as they were concerned if you had a TV you used it. Also most people where I lived rented their TVs and whoever did the rental was required by law to inform the licence people.

Thanks. We know now that those vans were just for show - they had no way of checking, it was just a big con trick. However, as you say, in the age before computers and internet, they assumed that if there was a TV set in the house then it must be in use; therefore in effect abusing the law by convicting with no real evidence. ​@@jennifercogzell748 The 'Detector Van' was a clever lie to fool people into imagining that they could 'detect' you watching telly, but in fact all they had was one or two tellys in the back of a van and they would try to match the changing light pattern of a BBC channel with the changing light in your front room (or wherever you apparently watched tv). They did not have any sophisticated fbi-like equipment to 'detect' anything. And these days, because you can literally be watching ANYTHING on a screen, they STILL have no way to detect if it's live tv, unless they use the old 'light' trick. So never ever let them tell you otherwise - they are GUESSING, so don't fall for it!

The officer should only be there to prevent a breach of the peace not as he said to "assist" with the warrant. had the home owner asked if the Officer was acting on his oath I am sure the answer would of been quite funny. I am also fairly sure a complaint to the IOPC against the officer would have a rather interesting result as the police are supposed to be impartial and not assisting corporations make money.

Sadly, the IOPC are about as much use as a chocolate kettle. They always back the coppers or look the other way. They are definitely NOT independant. One Friday afternoon two coppers knocked my door over a very old affair concerning someone else. I was asked if I would attend a police station for a voluntary interview. I declined, whereupon the two coppers told me that they could arrest me and take me into custody and, as it was a Friday afternoon, I would find it very difficult to get a solicitor to represent me before about Sunday. My reply was, "Well you'd better arrest me then." At that they left. I complained to the IOPC and the next thing I know some Inspector or Superintendent or somebody or other paid me a visit. He said they'd investigated the matter and they felt sure that I WAS OVERREACTING somewhat. He said the police don't behave in that threatening manner anymore. He said that was a tactic from the 1970's that was unacceptable nowadays. When I'd stopped laughing hysterically in his face I showed him the door with some less than reassuring words on his and his police force's credibility. The IOPC were not one bit interested in following up my complaint about HIM.

I would have loved to have asked the officer after they left “you said they had a warrant to enter the property, and you were here to enforce it. So either they lied about having a warrant (as they’ve left) or you don’t know what a real warrant looks like?” Well something to that effect anyway.

no Ben you're wrong, he did state he was there to execute a warrant to enter the property, if all of us with our youtube degrees know that the warrant needs to be signed by a judge then he should know in his position. The police officer instead was clearly on the side of TV licensing without checking properly first, instead of assisting these goons the police should fact check first before trying to intimidate members of the public by insisting these people have a right to enter the property.

He not there to back up a warrant. The warrant is between the TV People and the man. The police is there as an independent party. But he has power of arrest if violence or breach of peace occurs. A warrant is warrant. He can complain later if he has the grounds.
