The balloon stunt, is just an excuse to rally Americans to hate Chinese people, like we did with Muslims/ Arab, shocker they aren't mutually exclusive , or Japanese, or Vietnamese, or whoever we want to justify war with, we simply just make shit up to rally hate.

The rosewell "weather balloon" was actually a nucellar detonation detection device (to monitor detonations across the world in Russia). Document recently unclassified revealed this. fun fact!

@@78Mathius Well, it's the easiest way to make an unmanned aircraft with not too many moving parts. The Japanese even tried to use balloons launched from submarines to cause forest fires in the US. Didn't work luckily, but still. Add to that the severe (but not completely unreasonable) Cold War paranoia, and you have nations very quickly eliminating all possible loopholes that one could use to either spy on eachother or launch a sneaky nuke. Don't think that the same people doing goofy experiments with psychic powers and truth serums never considered balloons as a potential threat. While we're on the subject of nukes, anyone who joined the "It CoUlD bE uSeD tO sEnD aN StEaLtH nUkE" conversation really doesn't get radar. It's a massive, slow moving balloon with lots of metal parts. Just because the general public didn't know about it until it reached the mainland doesn't mean that it went unnoticed. That thing probably lit up like a Christmas tree on every long range radar post.

Honestly I don't get why this would even be a question. It's American airspace and unauthorized (unlike planes). Over American airspace, American laws are counting. So if the government decides to shoot it down, of course it's legal. They're the one making the rules lol

Biggest hole in the "civilian balloon" that drifted into US airspace is that they didn't even try to notify the US that the balloon was drifting. It and several previous balloons were kept secret as long as possible. If your balloon drifts out of the planned path it would seem common sense to let the people it is drifting towards know about it.

I'm from South Carolina. The sheriff in my county issued a tweet asking people not to try and shoot this balloon down since it was at 60k feet and they couldn't reach it with their guns.

It makes me curious that it's even a consideration if shooting a spy balloon is legal. I was under the impression that most countries's national law bans spying and it is usually an offense against diplomacy between the countries. Obviously everyone does it, but you're not supposed to get caught.

Aside from legal issues, balloon can fly at high altitudes beyond anything riding on air, so it is difficult to reach it. It is also difficult to target it as the inside is just another air of helium. This balloon was filmed by a regular guy named Chase Doak in Montana, and he post it on the internet, then it's no secret anymore and it became all diplomatic.

Me, suddenly remembering what I was taught in my air law class: But in all seriousness, the balloon was in controlled airspace. All airspace between 18,000' and 60,000' AMSL is Class A airspace, within which aircraft can only enter with clearance, and even then only under IFR. Not only is it a credible matter of national security, but also for aircraft navigation. Not having a transponder, it would not appear on TCAS, and therefore presents a definite threat, as per the published NOTAMs at the time.

@@orbitalpotato9940 Class E is not uncontrolled airspace, though. That would be Class G. Class E is, by ICAO standards, controlled airspace not classified as A, B, C, or D. It is generally less controlled, but it is still controlled airspace from FL600 up to the Karman Line.

And if I remember correctly, you don't need clearance to fly in class E airspace even though it is controlled airspace.

And I imagine the DoD knows how to tell the difference between a meteorological and a surveillance balloon. There's probably hundreds to thousands of weather balloons that fly over our country every year, and I think it's safe to assume that they don't go shooting down every one and we just don't hear about it.

It was as large as 3 buses in volume, but filled with air. It could not weight more than 100 kilos.

The F-22 is well described as a plane without a mission. It was designed to be the world's best air to air superiority fighter. But by the time research, development, and production was complete the US was done fighting near peer adversaries. The US hasn't needed to shoot down enemy fighters in a while now. Wonder if the F-22 will see use in the next 15 years against Russia or China.

NOTE: The Open Skies treaty was not a thing during the 1st Cold War (being signed in 1992). Incidents like the 1960 U-2 flight that was shot down, along with a lot of other Western recon incursions into the USSR, were absolutely illegal under international law at the time. But as with pre-school playground rules, responses varied. At some point it was understood by both sides that, to a certain extent, these recon ops were permissible without much fuss.

And Russia still makes military over flights of Alaska; the US sends a fighter up and they run away. It is and remains a game that both sides still play. We test our radar and response systems, and they test it as well - a win/win. We could easily ambush and shoot their fighter(s) down but that serves no purpose and defeats the purpose that both sides gain from the game. So, not exactly been one sided on violation of airspace solely by the US.

Also a "surprise" mission like this wouldn't be allowed even if China were an Open Skies signatory. The equipment used has to meet specific resolution and spectral band limits and has to be approved by all countries before being deployed. And each country planning a mission has to notify the country being flown over first, who is allowed to inspect the equipment before any imagery is collected and has representatives on board the aircraft during the mission. Then the images are required to be shared with any other countries in the treaty that request access.

During WW II there were pilots assigned to shooting down Japanese baloon bombs over the Pacific. My brief Google search did not reveal of there was a specific "victory marking" for baloons. I would assume so. Several people died on Oregon when one of the bombs landed at a picnic. It may sound like a booring job, but navigating far out to sea with the technology available was no small matter. (The British also used baloon bombs against Germany early on the war, but is is less well known.)

TL;DR: You can do what you want on your own territory regardless of whether or not it's authorized, notified or civil, because international law is weak. It's all political.
