In an 8-1 vote Wednesday, Phoenix’s City Council approved a $650,000 settlement payment to the family of a man who died in Phoenix police custody in February of 2019. The mother of Casey Wells had been suing the City of Phoenix alleging Phoenix officers of wrongful death and using excessive force against her 40-year-old son in 2019.

From the department retirement plan. Officers that are the responsible party should then be able to retire with only the remaining percentage of what the city did not have to pay.

I think you misunderstand what qualified immunity actually is. It has nothing to do with the money coming from the cops themselves as opposed to coming from the General budget from taxpayers directly.

@@iMatti00 I think you mis-understood. Qualified Immunity protects government official from being sued individually; they are protected UNLESS they act outside the law so blatantly. They need to have their own individual liability insurance paid for by them just like medical professional must carry malpractice insurance. Paying these suits out of taxpayer dollars has got to end.

A good first step. However, the only problem with that is you're assuming there's such a thing as a good cop. These cases show that no good cop ever steps in. These departments shouldn't even have access to these funds.

Yep, there's a reason that judges don't want any cameras in court rooms - they don't want the public to have any objective record of how they conduct business. Ultimately it winds up being the same reason that judicial "oversight" is done in private without any kind of transparency to the public - the judicial system is *incredibly* corrupt.

This has nothing to do with the courts, they settled out of the court room. The unions are the ones that dont want them to go to court and actually have police testify. I know it sucks but victims needs to stop taking the "hush" money, they need to be held accountable for their actions. That is why every time they say "this settlement/payment doesnt admit any wrong doing" because that was part of the settlement! The government is bypassing it own justice system by settling these cases

@@dingowingo7977The problem with juries is there are too many bootlickers that think any action by a cop is justified. Even the most egregiously criminal acts. Attorneys will recommend clients take settlements like this because it is a sure thing. Whereas with a jury there is a gamble that even if they win they only walk away with some slap in the face amount. Then they still have their attorney fees to cover. So no real justice for going to trial. I agree with you on everything you are saying. Unfortunately we don't have a consensus of accountability when it comes to law enforcement. The vast majority of people would say that cops should be held to a 'higher standard' of accountability. Departments themselves always claim that their officers are held to a 'higher standard' of accountability. Has anyone actually seen cops EVER held to any standard let alone a higher standard?

It should be standard policy that any officer who is found guilty criminally or civilly of a crime is fired and decertified without the ability to resign first to go work somewhere else. If same if the city has to pay out a settlement with the addition of stripping them of qualified immunity. This particular case demonstrates a clear lack of training when dealing with someone experiencing a behavioral health crisis. All first responders should be required to take Mental Health First Aid training before being given a gun or taser and refresher training throughout their careers.

The Police do not care at all - they don't have to pay for these any of these settlements, so why would they ever change? Additionally, they are often rewarded with a fully paid free vacation (aka paid administrative leave), as a reward for committing these violent crimes and violating citizens rights.

Start suing the union,the police training and standards board for holding corrupt, crooked, thugs in position and not revoking the certification of them as co-conspirator aiding in covering up for thier activities and failing to Intervene to prevent future incidents would help greatly. Insurance companies should drop departments for not correcting the problems. Tobacco companies learned of thier involvement cost them too..unions and POST are just the same. Clean house..decertification works.

Residents there & everywhere that have a city settling lawsuits need to WAKE UP. Chunks of their property taxes, utility bills & state taxes are going towards what I call WAR CHESTS but they call it insurance. And that's what pays lawsuits, a little from each resident & they should watch for increases in these bills because the city is hiking them to pay these lawsuits. If the police union wants to have input & defend their officers/deputies then they should pay 80% of these lawsuits. Because they're the ones refusing to change.

'INSURANCE' should be removed by LAW and by the citizens. The city doesn't have the right to commit crimes against is people. We don't need 'insurance' for the government, we need 100% accountability. Sadly, while 12.5 million dollars sounds like a lot as compared to the city's 6 billion dollar budget, it is really not that much money. The only way to fix this would be to require the police to take settlements out of their department budget.

I was in Phoenix like 6-7 months ago and I was harassed by a police officer on PRIVATE PROPERTY. The officer threatened me multiple times, I even called the city and the mayor's office to file a complaint and THEY NEVER ACKNOWLEDGED OR EVEN TRIED TO CONTACT ME!!! Phoenix police are some of the scummiest people and police I have yet to come in contact with. I was gonna move to Phoenix and the harassment happened so I didn't bother to move there. That's how they treat people visiting, look how they treat people that live there.

Make police officers carry their own insurance policies, once they cant be insured anymore because of the max out,they cannot be officers anymore, anywhere...there is no reason citizens should be required to pay taxes just to be abused...

Saying that the insurance company pays the rest is stupid. Taxpayer money still pays for the insurance. Take away all immunity, pay out their own salary, pension. Grantee 99% of all this will stop. Having immunity means they don't care what they do because they know nothing will happen.

Of course they want to settle. They add the clause of "no wrongdoing admitted". This basically screws over the next victim who could have filed a monell claim against the city for pattern and practice. Don't have anywhere to hide after a jury says they screwed up. Just look at the number of settlements. Think there is no case for a pattern and practice?

Just think of how corrupt and incompetent a police department must be to spend $12 million of taxpayer dollars IN ONE YEAR in legal settlements. Unbelievable. If I lived in Phoenix and my tax dollars were being wasted like this I’d be pissed. The citizens should do everything they can to clean house and start over, including the police chief and the next 3 or 4 in line and the mayor and/or city council if necessary. Enough is enough.

Its unbelievable how they can continue to believe there's nothing wrong with this agency! They were acting in good faith when they ignored positional asphyxia training a d murder the guy! The family settled for way to little! They also have prosecutors who are unwilling to hold them accountable!

Police don't stop crime or reduce crime. At BEST they show up AFTER the crime and take a report. It's rare they get to a crime in progress. If they do, it may not matter (Uvalde).

End qualified immunity for all law enforcement, judges, state/district attorneys, and all cops.....from county, state, and federal....they are out of control and I for one am sick of hearing ....we investigated ourselves and found our officers acted within our policy....policy aint frigging law !
