An ice cream shop owner in Orangeburg, South Carolina, a majority black town, is unable to remove a Confederate flag that flies over his business, but is located on land he doesn't own. CNN's Victor Blackwell reports.

The Civil War started with the objective of preserving the Union as the rebelling (Confederate) states seceded before Lincoln's inauguration because they were afraid of slavery being abolished. The war started because they wanted to bring the southerners/Confederate states back into the Union. Lincoln needed enough of a victory to issue the Emancipation Proclamation (all slaves in/from rebelling states are free) which happened to be the Battle of Antietam. As a result, this changed the Northerners' objective of the war - to free the 'freed' slaves. 2. Lincoln only freed the slaves within rebelling (Confederate) states to keep the border states at his side. Note that the border states had slaves. Yes, you could say it's war tactic. The Northerners did need better morale or idea to fight for. Yes, he technically did not have the power over Confederate states, but he had a problem: runaway slaves fled to the Union from the Confederates. By issuing the Proclamation, this made runaway slaves from the south in the Union FREE, allowing them to participate in the army. Again, he needed to keep the border states at his side so he only freed slaves from the Confederate states. For clarification (thanks to brett knoss), Lincoln did NOT free slaves within the Union during this time, the 13th Amendment did.

@@frostedbuds The past serves as a reminder to us all. A reminder of our past mistakes, so that in the future, we do not make the same mistakes. It's not being "stuck in the past." This is why we teach history. We can't just erase the history we don't like, else we are doomed to repeat it.

here's my take on it as a black man. in America, we have rights. the flag in this case is someones right for what they believe in, they are expressing their beliefs as i express mine. i am not in agreement with the confederate flag, nor do i have to like it. however, forcing someone to remove a flag is as bad as forcing someone to believe what you want them to believe. this is our freedom in the US, if this freedom were not there, i would still be a slave today. i have the freedom to not have to agree and i can shop wherever else i want. i believe EVERYONE who is an American citizen has this right.

You don't have a right in this country not to be bothered. It is a free speech issue. The owners of the flag have every right to fly that flag. Doesn't matter. Just ask the Jewish survivors of the Nazi camps that lived in Skokie, IL . The ACLU went to court and represented the Nazis and won them the right to march through Skokie. It was their free speech rights. People need to suck it up and get on with their lives.

I'm sure moving never occurred to him because he has 60 IQ. And I'm sure he didn't move just because he's stupid, not because he has another reason, right? Like people who didn't read the declerations of secession where the confederate states explicitly said that they were breaking away due to a desire to preserve slavery? Or people who don't realize that the "they were just defending their homeland!!!" argument is bullshit because during Bleeding Kansas people killed each other over the legitimacy of Slavery even though they weren't living in Kansas and just migrating there to fight? Or people who don't realize that most Confederate statues were put up DECADES after the civil war during the peak of the KKK as a method to intimidate Black Americans? Or people who don't realize that although only 30% of white southerners owned slaves at the time, a vast majority of them supported the social hierarchy of having blacks as lesser humans? Or people who don't realize the South was incredibly hypocrital about "muh states rights!!" because the Dred Scott ruling said that slaves were still slaves in free states and therefore the states had no say in freeing Black people, and white southerners rejoiced? Or the fact that the South wanted to annex Cuba to expand their slave empire, not just content with keeping it within the South proper? Or people who choose to glorify the five most brutal, racist, and hypocritical years of an otherwise culturally rich and beautiful region of our great country? Probably because it's sickening to them, and they don't want to have to look at it while paying to eat right there. When I was a kid somebody opened a Spaghetti Warehouse within smelling distance of some stinky slaughter processing plant, and it went out of business because people didn't want to smell that while they were eating. It's not too hard to figure out.

It's been an issue for years. The confederate flag had flown on top of the SC State House starting in the 1960's as a protest from the SC government for the Civil Rights Act(which btw blows a huge hole in any argument made towards the flag being about heritage) and then the flag was taken down from the top of the State House in 2000 after years of debate. The flag was then moved to the grounds in front of the State House, and still debate continued and even a boycott of the state that was active until it was removed last year.

Sadly, Mr. Daras closed his business in early 2019. He decided the harassment and legal battle was no longer worth it and moved away from Orangeburg.

It's just a flag. Nobody is "obligated" to take down anything. You should be able to display whatever you want on private property. But no, apparently the freedom of expression is "problematic" and "racist." America was built around freedom. If you don't like it, then America is not the place for you. I suggest Germany. It's a nice place with way stricter speech regulations, if you like that sort of thing.

The flag is part of history, *SO IT BELONGS IN A MUSEUM* .Lots of the defenders of the Confederate Flag use “i’m an American” or “it’s only American” or “it’s part of America” somewhere in their argument, which i find ridiculous because the Confederacy SECEDED FROM AMERICA. In reality, that flag represents not just a nation, but a nation and a people who were against equal rights and was very pro-slavery. It’s like the Nazi swastika; nobody still waives the Nazi flag on a flagpole because “it’s a part of history”. Nazi flags are in museums and personal collections. The Nazis were a people focused on oppression and persecution of Jewish people, just like the Confederacy was a nation focused on oppression and enslavement of African people.

They didn’t secede from America. They seceded from the US. America is a continent not a form of government. They were still part of America since they were officially call the Confederate states of America. Also we still have the right to fly any flag we choose on private property. Just because it’s public view does not mean it’s public property. You may not like it but you still gotta respect their rights to fly it. My neighbor fly the Irish flag and I hate that flag due for the Irish Republicans killing my people and I’m sure they don’t like my British and Ulster flags flying but we still respect each other rights to fly them.

connor watson Okay first, I’m using America and the US interchangeably and playing semantics weakens your argument. Second, the difference between your problem with the Irish flag and the Unite States’ problem with the Confederate flag is that Ireland is not a country that represents the murder of British people. The countries had beef in the past, but they make amends and continue on as allies because the countries are not inherently bad. It’s the same with the US and UK. The Confederacy on the other hand, was founded to continue the practice of harsh African slavery and as retaliation at the election of Abraham Lincoln, in other words in retaliation against the US’s representative democratic election process, one of the key parts of America’s government.

I'm from South Carolina where Maurice Bessinger founded Maurice's BBQ, and even though I have mixed kids and did not agree at all with anything that man stood for, about 20 years ago when my two oldest children were still babies I got a job there, because I needed a job. Maurice was still alive then. He was the most racist cruel person I have ever met in my life. He had just written that book not long before I worked there I believe, but he would have not hire you unless you were willing to have $25 taken out of your first paycheck to purchase his book, seriously. I didn't work there very long because he ended up seeing my kids one day because we just happen to have a flat tire right next to the restaurant and I took my kids inside to wait on someone to come and change Tire bc it was hot outside. From that moment on I had major problems so I quit that same week. But anyway this was the most shocking s*** I have seen so far, this man was so f****** evil that he went to lengths that after he was dead and gone which he has been for quite some time now that those f****** Flags still can't come down. That is so ridiculous. When he first put the big flag up at the first Maurice's which was the one I worked at in Cayce South Carolina, there was debate about him having the flag there and I don't know all of the details, my grandmother said he ended up having to pay $1,000 a month to be able to hang the flag there and paid it. Right before he decided to put that flag up his business was starting to expand to the point that he had his own chain in all of the grocery stores even outside of South Carolina, selling frozen meals and his sauces. But after he put that flag up, they took all the stuff out of the stores, no one would sell it and no other state would let him put restaurants in their state so it never expanded outside of South Carolina. I always said when he died that his children would probably take the flag down and expand the business and become much more wealthy, but I didn't know until just now why that never happened. I bet he was the most stubborn motherfuker to live with in existence because he was a stubborn a******* about his racist beliefs and didn't give a damn what anybody else had to say, even the customers. He used to play the same to Confederate battle songs on repeat all day in the restaurant, and some customers asked if they could turn it down because it was really loud, and he said nope if they don't like music than they can leave smdh

Doesn’t seem like this owner didn’t have an issue when he bought the store, only when he started receiving backlash. Why else would he still purchase the land if he knew he didn’t have control of the flag pole? I wouldn’t go there for that reason.

Congress did not recognize Confederate Soldiers as war dead. It made increased pensions available to Spanish American war veterans and widows and children of US Civil war veterans and children and widows of Confederate Veterans. Their is no pardon included but a Confederate soldier could seek a pardon by applying for one some time after the civil war as was legislated by Congress. General Lee asked for one and got one but that didn't make or allow him to become a union soldier nor did he get to collect a pension.

I thought of that, but it wouldn't work as the pole is directly adjacent to a public sidewalk. The restaurant could possibly block it from view on their side of the parking lot (although at significant expense, given the height of the pole) but they would not be able to put any blocking structure on the sidewalk or the two cross-streets from which the pole is adjacent and clearly visible. As a PoC, when I see the confederate flag on a car, home or business I see it as a sign that I am not welcome or safe. So based on the close proximity of this flag to his business, I would not venture in to check and see if he condones the flag or wants my business.

@@finaltwo I am hopeful that he figures out how to disassociate from the flag in some way, but until it was removed I would not feel safe and not shop there. I guess I lost my mind the first time that I was spat and called the n-word by a classmate who had rebel stickers on his binder. I guess I lost my mind when traveling in Arkansas and when entering into a gas station was greeted by the rebel flag and told that I did not belong there and was refused gas.... I have many more stories.... So in order to keep sane, I avoid potentially traumatic situations. It sucks that his business is not thriving, but the inclusion of a sign that says all are welcome and going to a few community and church meetings might change his neighbors perception of his business.

Christina Marsh I mean I sympathize with you, I’ve been a victim of a hate crime. I avoid people with “good old boy” mentalities. I very recently (last two years) got educated on the rebel flag, but and would understand why not knowing someone wouldn’t shop there. But knowing the owner doesn’t want that flag up, it’s not his flag, and wants it down should matter also. Unfortunately in America we have laws that are outdated and almost impossible to change. But this could literally happen to anyone, this racist made sure that flag would fly even after his death. The current owners livelihood is on the line because of forces outside of his control, I think that should be under consideration. It’s also like if the Westbro Baptist Church was out with a “God Hates Fags” sign in front of a restaurant. I know that they are not affiliated with the restaurant, if I want to eat there I’ll walk right past the bigots.

He purchased the parcel of land knowing that there was another parcel of land next to it flying the flag. He has no legal basis to demand them to remove the flag. The best thing he could do would be to put a sign up on his property near the parcel with the flag, explaining the situation.

you should NEVER say that flag is fine. there is NO context outside of recreations that the flag is appropriate. they were traitors who wanted to own people and they lost. there is nothing honorable about what the south did.

@@theurbanexperience6787 the civil war belongs in a museum, it's over, it's history. the south fought for slavery and they lost. let the past die. when asked about a proposed gettysburg memorial robert e lee himself said "i think it wiser not to keep open the sores of war but to follow the examples of those nations who endeavored to obliterate the marks of civil strife, to commit to oblivion the feelings engendered." okay, so it was a battle flag flown by people who thought it was okay to own other human beings. i just looked it up and yeah, that flag was just one of MANY flags the south flew during the time they shed blood for the right to own actual humans as slaves. the current usage of the flag really only became popular during civil rights, y'know, that period of time when we decided that, yeah, we should treat black people the same as white people. well, a bunch of southerners thought that treating black people the same was bad so they started flying that flag and putting up statues of famous traitors who failed to uphold slavery. why do you use SJW as an insult? why is social justice a thing to be derided? do you not want to live in a just society? that flag means slavery to the majority of the people who live there. a tiny minority of the population don't want it there. if it was voted on, it would go down. democracy demands it.

So the flagpole and the land it occupies are owned by someone else. Fine. But it is surrounded by the store owner's property, so how do the flag owners access their flag without trespassing on his land? Do they have an easement or a right-of-way agreement?

Freedom of speech is a protected right, so they wouldn't win that court battle. They'd instead be paying 842's lawyer fees.

@Derek Mitchell Wrong. The Supreme Court has ruled that freedom of speech (or expression if you will) extends to far more than talking. For example, art work, photography, signing, words on cake, etc, is all considered freedom of speech.

You have grown adults acting like little children over something like this. People need to grow up and move on. Refusing to shop somewhere just because of a confederate flag is dumb. I fly it proudly and thanks to the group who keeps that flag flying

When I was in the army in the 80s-90s I had a black squad leader who had a Confederate flag tattoo on his arm. I asked him why? He looked at me as if I was stupid and said "Because I'm from Georgia and my ancestors fought for the south...even if they were made to, they fought."
