Michael Cohen testified Monday he secretly recorded Donald Trump in the lead-up to the 2016 election, discussing plans to buy a Playboy model’s story about having an affair with the then-candidate.
Cohen - who worked for Trump for more than a decade - told jurors in Manhattan Supreme Court that the Sept. 6, 2016, conversation, taped on the Voice Memos app on his iPhone, was the only time he surreptitiously recorded his former boss.
“So, what do we got to pay for this? One-fifty?” Trump could allegedly be heard saying on the nearly three-minute recording played in court by Assistant District Attorney Susan Hoffinger.
The conversation centered around plans to buy the rights to former Playboy Playmate Karen McDougal’s story about having an affair with the married Trump from the National Enquirer, according to testimony.

What does this have to do with criminal activity or the law? The audio recording is completely vague and lacks any degree of connective context. This could be a conversation from literally anything about paying money for literally anything.

Recording conversations is based on what state you're in. NY is a one party consent state. So the conversation recording is legal. You may say "Well Cohen was his lawyer". Nope, if you're committing a crime together, they can't be your lawyer. That's out the window. Remember that when you ask your lawyer to "take care of problems".😅😂

Paying someone hush money so they don't hurt your presidential campaign is a violation of campaign finance law. Prosecutors saw the payments as illegal campaign expenditures. Trump's lawyer, who was the one who actually paid out the hush money, pled guilty to this, but Trump himself wasn't charged. It's a New York state crime to falsify business records. This is what Trump is being tried for currently, because he reimbursed his lawyer for the payments, but in his books he apparently listed them as being for legal work, which they were not. Edit: This would ordinarily be just a misdemeanor by itself, but doing it to conceal another crime (the campaign finance violation) would make it a felony.

One party consent laws protect your right to record someone w/o their knowledge. It depends on the state, though. Not to mention, he wasn't even president yet when this was recorded.

In the state of New York, a one-party consent law is in effect. This means that an individual may record a conversation if they are a participant in the conversation or have obtained permission from one of the other parties involved. This applies to both telephone conversations and in-person discussions. The individual currently facing trial is being prosecuted for the alleged crime(s).
