But unless we knew about this loophole first, we are kind of screwed if we accepted less hours, for example, because the restauraunt decreased it's hours of operation due to Covid. Is that right?

Would an employee have to get with a lawyer? Or just file that with a workforce commission in their state?

That's a good question, Garry. Unfortunately, because our firm doesn't currently (as of May 2021) practice employment law in the United States, we can't provide an answer. We practice in Ontario, Alberta and BC, Canada.
