Cops can’t arrest anyone they want, which is why if an arrest is wrongful they can be prosecuted in COURT, and if you’re innocent that doesn’t give you the green light to resist or fight them, if you do that you are now in the wrong and made it much more difficult for the officer to be prosecuted, if you’re so against police you’ll let them do what they’re gonna do and prosecute later so they can be held accountable, resisting just tells me you love police and want to ruin your life while also allowing them to keep their job

They could have been taking him somewhere to play target practice with him for all he knew. I understand that it may be the law but it is a very messed up law when you expect a person to fight their humanly instincts to survive. And then to go on to take him to jail anyway was just down right inhumane and I don’t know how they sleep at night.

It was a lawful arrest. He committed a traffic offence and was pulled over. They thought he was a felon, we’re concerned for safety (proved right as he had a gun) and it is well established police can order you out of the car. Dude brought it upon himself and his life cratered for no reason. Sure it was a mistake / but if he had gotten out and spoken calmly to the police officers it would all have been sorted out.

@@jpevans01Owning a gun, in Texas of all places, is not unlawful. They assumed he was dangerous because of a mistake that should’ve never been made. Put yourself in his shoes. You are driving home, you possibly commit a simple traffic offense. Police officers try to drag you out of your car and say you have a felony warrant. You don’t. In my opinion it is not only his right, but his duty, to repel this invasion of his privacy and his rights. None of this mentions the obvious fact that he is black. He has a valid reason, more so than most, to be afraid of the police. To be apprehensive. What the officers and the DA did is wrong. There isn’t any way around that fact. If that’s a lawful arrest, the law is broken.

Audit the Audit, as well as several other channels, and even several lawyers, have stated that if it gets down to it, you pretty much have to let the corrupt police officer have his way with you and fight it in court. Shit happens, and cops were wrong, but how hard is it to just comply? Just because you are innocent doesn't mean you get to resist. Shut your mouth, comply, and it will be over with in 5 minutes, and you'll be on your way. Plus you get to file a lawsuit and get lots of money if you are in the right.

Shame on the Dallas police and the district attorney for dragging this out for 14 months. Yes he did not submit like a dog as they wanted him to, he resisted because he was innocent! Cops and Sergeant proceeded to press bogus charges agents him causing him to loose everything (his gun was legal and charged him on illegal possession to rack up charges). How does anybody come back from the trama Dallas put on Silverster. The guy lost his job as a security guard because his employer thought he was as guilty of criminal charges, he lost his income and ability to support, lost his home, lost his ability to gain employment, he was humiliated and disrespected because two cops and a sergeant could not just let it go on their mistaken identity! I hope he gets redemption in his lawsuit! PS: The security company should apologize for not giving him the benefit of the doubt and the wrongfull dismissal now that the truth is revealed!

There is a odd philosophical/ethical conundrum that occurs w/ regards to types/amount of rationalizing for/against certain things...especially in regards to a 'relied upon system' such as gov... - I'd posit that it is no longer a 'legal system' but in fact a authoritarian regime, a la the 'inverted democracy' sort. There is a set of logic fallacies, thought traps, and conditioning that sees people think "the court needs to correct this", when in fact its all 1 system working together. The moment bureaus, independent agencies etc broke the very strict 'separation of powers'/checks n balances doctrine(s)...the system broke entirely, 100%. - The Constitution is not a 2-party agreement (state/fed), but a tripartite agreement. State(s), Fed Gov, and This is because it is a republic founded in representation (as a convenience only), and that the Liberty/Rights (of citizens) are sole reason other two parties exist or are granted power by The People. - IF the system sets aside 'exceptions' in majority of legislation ONLY for gov, almost never for Citizens...Its tyranny, the law is a arguably a convoluted front and subterfuge: meant to convince people "because it was passed into law, its legal BUT also moral/ethically sound". In fact if the law is non-uniformly applied (in gov's favor), then its restriction freedom of citizens + empowering authority, hallmarks of authoritarianism.

As a Norwegian I am appalled by the lack of communication and de-escalation skills I see in the American police force again and again. Had they just told him why they wanted him out of the car when they first asked, he'd likely be more understanding of the cops' situation. I mean, are they afraid that he's going to just act out? If that's what they're afraid of, they obviously got that from him, by not communicating to the guy why he's being detained.

Basically, uniform cops are not taught the techniques of an investigation. They throw around the words "my investigation" without having any idea about the methods of an investigation. I trained officers in the techniques of investigation and an arrest should not enter the equation until facts are learned and there is probable cause to make an arrest. Most calls and complaints can be resolved without making an arrest by knowing how to investigate instead of puffing up and end up to make unnecessary arrests, usually false. Bad cops become the adversary before they ever arrive on the scene and find out the problem. Unless the responding cop requests backup, other cops should not arrive at the scene. If and when backup arrives, the backup keeps his moth shut and listens. All too often the backup escalates the situation. Watch the videos for what I have pointed out.

fighting with the cops is a crime, that makes you not innocent. once the cop informs you that you are being detained, you are now at their mercy. even without the mistaken identity, he was stopped for a traffic violation and refused to exit the vehicle which the supreme court has determined is within a cops right on a traffic stop.

The City is the one pushing it though, they are the ones losing money in the court cases after all. If the police can find something, anything, to make the issue 'muddy' then the following civil court against the local government is a lot harder for people to win. If the cop accepted responsibility, which dismissing could be considered a sign of, then the civil case would be a lot easier for the innocent parties to win. A cop that costs the city money has what sort of carrier? We call this a perverse incentive, police interactions are filled with them.

I had a similar thing happen to me when I was in my 20's. Pulled over for a minor infraction, When they ran my ID, It came back with a warrant for a man with the same name with same middle initial (not name) and a DOB 13 days after mine. Though it took 45 min's (late 1980's) to clear it up, I was never handcuffed and the MSP troopers clearly explained why they were checking my ID. Over the years after, I have had problems with this guy's criminal activity including him using my family info to try and get social services benefits.

Why did ATA edit out the beginning of the interaction? Silvester was very compliant and even joking around with the cops in the beginning. They even had his information. This makes it seem like Silvester was combative right off the bat when he wasn’t.

I love how officers can use force, throw you around and tie you down, before even saying why your being detained. Yet HOW DARE YOU try and protect yourself even a little bit by pulling away or bracing yourself from them throwing you around.
