So DCF takes kid’s away from parents who don’t abuse their children but leave abused children with their abuser’s and sometime’s they are killed by the abusive parent they were left with ⁉️⁉️

Unfortunately, that is so true. They don’t protect the ones that need to protection but yet they’ll take away children that don’t need it. Something is wrong with the system. Some Foster care, parents abuse the children too, they do nothing about that too😢

Yep, & they - CPS/DCFS - damn well know that by them waking that 3 yr old in the middle of the night & taking him, he will have SEVERE trouble sleeping all his life, PTSD, & most likely a very hard time healing from the trauma of that.

I stand for the placenta because I came in hell Jesus style and my teachers didn't even believe I was related to my brother or sister unfortunately it doesn't even matter in our situation because there is only room for one woman's attitude per house regardless of birth style considering Timothy's daughters were all set to walk the streets with broken noses and I bought my daughter a house because she wanted to be a teacher not a plumber like her mother was forcing on her. Women get all the feelings or support so I was destroyed once for not allowing my daughter to be used as a Ritalin guinea pig and when everyone was worried about my step sons penos size I was worried about his osgood-schlatter.

Apart from Justfied Externants CIrcimstances were there is Direct Evidence & Serious concern for other childrens welfare as in the Frank Childrens case.. there was no Warrent or paperwork but their was the Physical evidence & testimony of R,F the boy who escaped!! And Cops did enter & Search Jodie Hildebrants house due to life & death & concern for other childrens welfare.

Boy you know if itd been a government officials kid that immunity stuff would slide, they'd say you have the obligation to yourself and the community to not act on illegal orders. soldiers don't have to obey orders to kill they just have to understand that their beliefs can land them in prison. if a commanding officer gives you an order that's illegal its your obligation to not follow that, this is an over used trope but the nazis were just following orders they said, doesn't mean its ok...

It’s qualified immunity not blanket immunity. The qualification is that it’s something done in the commission of duties. Going rogue and taking a child without paperwork or orders is outside of their duties.

The laws in most places allow DCFS to come, without a warrant, litterly bust into your home and take the kids with no cause other than their suspension. They have the authority to violate constitutional rights and are protected from arrest or lawsuit under qualified immunity, which basically protects public workers like police, fire, ems, ect from being sued for actions taken during the normal course of their duties. DCFS hides behind laws designed to protect first responders like the cowards are.

I had my newborn baby ripped out of my arms two hours after giving birth by CPS. They said I had meth in my system. I couldn’t believe it. I’ve never done drugs. I had myself re tested, the placenta tested etc and it all came back negative. No drugs. But it was too late. CPS already took my baby. Took six months to get my baby back. I had to strip naked 4 times a week for 6 months and pee in front of random people to be drug tested. Every time I was clean. I never did it to begin with. When I finally saw the judge she apologized and gave my child back the same day but what good was that? I lost my baby. He came back bruised and abused and now he’s 7 and has many emotional issues and I know this is what caused it. It’s so upsetting.

Those poor parents, not to mention the trauma to the kids. Social workers are disgusting. I was a foster carer for 7 years. Half the kids I fostered should never have been removed. The social workers made horrible disparaging remarks about he biological parents, calling them demeaning names. One social worker made fun of the name of two siblings in my care. That whole system needs to be looked at closely and rebuilt from the ground up. They need to train people with discernment and empathy.

Poor parents? Nobody uses common sense anymore? The 3 year old had an almost healed broken rib! Imagine how much pain he had, and the parents didn't take him for a check-up? I thank the police they acted! Possible that the parents don't know how it happened so I'm not claiming child abuse but this is definitely child neglect!

@@Messier45_Pleiades It's not possible to not to have pain with a broken bone. Our body is designed to have pain. It's a signal for you to pay attention. What do you mean by 'snapped back'? If it was broken to that degree, there's no way he could had walked like everything is normal. Also grown ups don't jump, run and roll on the floor like 3 year olds! I'm sure your friend was in pain but ignored it. He can do that as a grownup. But not taking a child for a check-up? I applause the police to act. They should have done it with a warrant though.

@@letiziapassanisi9967 qualified immunity is an immunity provided to state/government officials so that when they break the law and are prosecuted, it basically says if what they did was reasonable or ought to be seen as generally reasonable conduct they should have immunity from civil court claim. Illegally raiding a home at 1AM to steal children without court order is not reasonable. It was highly illegal. Felony level crimes were committed against this family.

It's a little hard to explain, and the law in this area is a bit complicated, but Qualified immunity is a legal doctrine invented by the Supreme Court that prohibits lawsuits against government officials for violating your constitutional rights unless a federal appellate court in the same circuit has _previously_ ruled in a previous case with identical facts, that the exact behavior by those government officials was unconstitutional. This doctrine allows cops and other government officials to get away with the most outrageous behavior simply because such behavior hadn't previously been disapproved by a federal appellate court in the same circuit in which the current case is pending. The cruel irony is that the worse the police misconduct, the more likely it's protected by Qualified Immunity, because it's less likely to have previously occurred and therefore less likely to have been specifically prohibited by a prior federal appellate court ruling. As a result, you have cases like _Jessop v. City of Fresno_ (2019), where several police officers were accused of *_stealing_* over $225,000 in cash and rare coins from a homeowner, and the resulting lawsuit was thrown out because there had not been any prior appellate court rulings saying that *_theft_* by police officers in the course of searching a person's home was unconstitutional. I kid you not. This is what's wrong with Qualified Immunity and is why it needs to be abolished. It's unjust, un-American, and it defies common sense. The Cato Institute has a series of informative articles on Qualified Immunity, if you're interested. Just do an internet search for "Cato Institute Qualified Immunity". Then contact your congressperson and senators and tell them to abolish Qualified Immunity.

It’s basically legal kidnapping in the end. No one should be allowed to take a kid without a proper warrant, and allowing a case to be opened to see if the kid is really in danger or not. There are foster families who abuse the kids and use them for money, all while the system sits back and does nothing about it.

Yep, like the huge bunch of kids that got abused by their parents and when finaly it came out were put in foster care and some were abused there... as i remember one worker told one of the abused kids "what are the odds you got abused by your parents and your foster family? Without proper paperwork, it is *NOT* legal, they just happen to wear uniforms or have jobs where they think that they do not have to follow due process. Those cops should have told the worker(s), no paperwork, we aren't backing you, and if you try, we will arrest *YOU* for break and enter and attempted kidnapping. You know, due process, enforcing laws, all that stuff that is *SUPPOSED* to happen.

If they didn't have the court order to take the kids then it wasn't legal kidnapping. Also the case was open and they were investigating. Which is what should happen. But you have to wait for the investigation to finish before you're taking people away..

Laws are different in every state. In Utah, for instance, if there are "exigent circumstances" you don't need a search warrant. Believing a child is in danger would count as that. My opinion is I would rather they err on the side of child protection, but I haven't followed this case to know enough about it.

I'm in Canada, but it is the same. They took my exes kids (before we were married) over made up stuff the judge ate up with a spoon despite catching the social worker lying in court, gave him a verbal minimal warning and carried on listening to his made up stories. Meanwhile, the guy next door had his kid by the throat off the ground against a wall in front of a worker, and all they did was offer *more help* and let it continue. Oh, I forgot to mention, I was even accused of child sexual abuse and was interrogated for hours with the lawyer having to remain in the hallway. Eventually, we offered a polygraph, and after a long wait, it turns out they didn't even have enough so-called evidence to even make up polygraph questions!! The one officer *still* had to make parting shots about the file never going away. Moron...

my mom got her degree in social work and after doing her volunteer time in her final year she finished up her degree knowing she wasn't going to use it. She had worked with dept of children's services for a few months getting to know things and she realized this was not what she wanted to be involved with and that was back 25 years ago... can't imagine what its like now.

A relative of mine got their daughter taken away because she couldn't keep food down. She ended up needing a feeding tube because of her condition. They knew it wasn't neglect, and still refused to give her back. Despite her being diagnosed with a condition. She got returned with her parents at age 10-13. I don't remember well. It was only because something happened in the foster home. The lady, I believe, lost the right to foster. The system doesn't help those it should!

DCF is one of the largest trafficking rings out there. They destroyed my family. My brother, who was stolen from us and given to another family, was treated horribly. After having my daughters, I would get anxious about these people finding any excuse to take my daughters. All it takes is for one false accusation, and they are at your door like leeches ready to snatch your kids to give to another, especially from low income families. All my brothers were coerced to say stuff...those years were a nightmare for us. I still think about that day when they came and forcefully removed all my brothers.

No one. There were no orders signed by a judge in this case. That's why the parents are suing and why the police and CPS workers do NOT qualify for immunity

Pa resident here. As a Grandfather, decorated combat Veteran and productive citizen- If ANYONE, police, child services,etc- showed up at my home with no warrant and tried to take my Grandkids..........Qualified immunity wouldn't really apply to them afterwards...........

They took my kids in yolo county, California to help my husband get a divorce without paying child support. The gov and judge ruined my life, destroyed my relationships with my kids, torturing and abusing me and the children. The cops assaulted and handcuffed me, to take my kids. There was no abuse or neglect they could name, but it didn't matter. If you're poor or forced into poverty, there is NOTHING you can do to fight back. I filed a lawsuit in federal court pro SE, and had it dismissed with prejudice. DCFS needs to be shut down. They are trafficking kids.

My son used to ride his bike down a steep hill and slam into the back of the neighbors house, came home with a bloody nose countless times, rode his bike up ramps and soared through the air. He was a rough boy! I wouldn't be surprised if kids get an occasional cracked rib as a part of typical childhood. But to take someone's kids away because of it? Get out of here!

@@randomperson5817 it definitely sucks!! This baby who was 4 months old who had the broken rib, there’s a chance the child can be suffering from brittle bone disease. Just picking up someone, just moving the body can and will snap bones. Ribs are more common fractures in babies with this with arms and legs right behind. The parents next step would be making an appointment with their child’s pediatrician to see what is going on, and get some blood work done as the child could be lacking some sort of protein or another form that can cause his bones to fracture.

Agreed. When I was still in K-12 more than 30 years ago, there were several obvious cases of physical and emotional abuse going on that I myself as a 13-17 year old reported to the police yet nothing was done. In two of those cases, the child in question ended up seriously and permanently injured before the police intervened and I was interviewed by the police as to "How did I know that there was abuse going on?" I didn't mince words: The physical abuse was obvious because the kids had 'strange' bruises on them that they said came from 'falling down the stairs' (a red flag when anyone says that) and the emotional abuse was obvious because the kids were always acting like scared rabbits thinking that someone was going to hit them.

I had CPS show up at my house in the middle of dinner last year. They didn't take my kids but they showed up with some bogus claim that my oldest son (who was 5) had a plan to murder his newborn brother. They came in and interrogated my 5 year old like a criminal who was traumatized and heartbroken that someone would say he'd want to kill his brother whom he takes amazing care of like a second mommy to him. The CPS workers seemed shocked when I let them tour the house. As if they expected it to be dirty and gross. But instead it was clean and full of toys and love. They actually kinda paused in shock and went "uh. . .wow. . ." That was that, they left. But the whole thing has continued to haunt my 5 year old who thought we needed to pack our bags and run away because they were gonna take his baby brother away. He still thinks, a year later, that the cops are going to arrest him for "being bad". It's horrible

Instead of the millions being wasted on a failing child protection departments, we need to be supporting struggling families. The agencies are secretive, arrogant, and deceptively protected by the appearance of being on the side of right and law. Instead, children are still being inadequately monitored in homes KNOWN to be abusive, while simultanously overreacting in cases where the families are simply poor. The studies done have proven that the money spent on foster care and group homes would have a massively more positive impact if were redirected to supporting struggling families with safe affordable daycare, housing, food, and job training and parenting education.

Many DFACS workers are ignorant, abusive, and take great glee in going after good parents and ignoring children who are being abused. It is almost as if they enjoy going after good parents-,sometimes seems as if the DFACS workers are avenging their own horrible childhood.Truly wierd and corrupt how they will go after- and as a friend noted- laugh at the misery of caring good parents. But the judges go along with them; so glad this couple got an intelligent judge not corrupted as so many are now.

It's crazy how little effort goes into investigating situations by CPS workers. You see kids go back to homes where they end up murdered, molested, beat etc. then good homes get children taken away. Me and my sister went thru a similar situation where there was no warrant or paper work and they just took us. My parents sued CPS since they were placed on a registry and ultimately won their case, taking it to the highest court. It's so corrupt tho. Judges tend to be on the side of the social workers and also the police officers. These people have way to much power and there's no one to put them in check when they over step boundaries

DCF should also be reimbursing this family for any private mental health care and trauma support that these parents choose for their children. Not another public offering that may take months and years to navigate the broken system of, but any private psychologist or team they find to be the best fit for them.

It's not just that the kids were taken away, it's how it was done unannounced, in the middle of the night, without documentation, and after hours of questioning where no indication was given that the kids would or could be taken away in the first place. It's like DCF waited until the family had their guard down and literally had no idea what was going on, being woken up in the middle of the night and all, and struck! There was no opportunity to handle the situation civilly and decently, and most importantly legally. It's like DCF was daring the family to fight back in all the commotion and mayhem and maybe score the city an arrest in the meantime. This sullies the name of an agency that otherwise is supposed to actually protect those in need.

They were lucky to have the resources to get their children back. I don't know how bad things are in the Boston area, but there are foster care systems and family courts that are being manipulated by abusers. The ridiculously expensive court system, and all the delaying tactics that the police use to "win" (even when they are wrong) can make the legal system a disaster for kids.

When my daughter was 2 I almost lost her, she had vasculitis. We didn’t know that at the time, she started swelling up, she could barely move without crying. We took her to the ER and after a dozen nurses a few doctors. Countless blood tests they were stumped and talking to social services, then by pure chance a specialist just happened to be in the hospital. He heard about what was going on and came down to the ER, he took 5 minutes to check her out and knew right away what the cause was. If it wasn’t for that I’m sure child services would have taken her and had us arrested. She really did look like she was beat up, she was showing bruising while at the hospital. Now she’s 21 and healthy.

Good on the Judge for making the right call. So often they don’t anymore. That Hospital needs a lawsuit too. They should only report IF there is reason to suspect abuse, not just an injury. Kids get injured, people get injured, they need to have a strong reasoning for this.

Unfortunately, sometimes the doctors are just as tied up in the law. Years ago my dad examined a little kid and found he had what is well known as a toddler’s fracture, nicknamed as such because it happens ALL THE TIME to kids in the toddler stage. But since the parents didn’t know what happened and their excuse as to how it probably could have was something that absolutely WOULDN’T cause that kind of fracture, Dad was forced to report it - much to his ire and frustration. He didn’t want to, he knew it was nothing, but his job was quite literally on the line if he didn’t and it pissed him off. Dad actually testified on the parents’ behalf in court, got the whole thing thrown out. Waste of everyone’s time he said, and I agree

No, the hospital staff did the right thing -- it's not their job to investigate possible child abuse, but to record health records and report possible abuse to the relevant authorities to be investigated. Obviously someone dropped the ball in this case, but just because the government investigators put their foot in it doesn't mean that the private hospital should take the fall for them.

The younger u are when u have separation from parents (abandonment, rejection is easily perceived by fetus in utero & pre-verbal children bc their entire life depends on mom) the harder it is as u get older. Rejection can become a constant theme. I FIRMLY believe the overreach of child 'protection' services & the devastation caused by family court system is an intentional manipulation designed to cause trauma. A traumatized society is much easier to control. Traumatized ppl want to be rescued, want to feel secure. They want MORE laws & they'll even give up the right to their own bodies, look what happened in 2020.

you'd want a suspicion of child abuse to be looked into - ignoring it could cause a different sadness. but if they had had enough "proof" they'd be able to get a warrant and do it the right way. they bypassed a judge/warrant because they knew the case was weak. bypassing legal steps is what caused this, they should lose their qualified immunity

Every night we tuck him in, and ask him “who is protecting you?” And he goes down his long list of everyone who loves him (even if they don’t live with us). So when children go to the hospital these days, parents need to have the financial reserves to go IMMEDIATELY from the hospital into hiding in an abandoned town in Iowa or some woods in WV or North Carolina or something? Burner phones and nice, untraceable cash? When Big Brother has unlimited time, lawyers and money, it sure seems that way. This is NOT the first time people have moved. Here in Louisville KY a few years ago, a (probably innocent) family was REPEATEDLY investigated until they left the jurisdiction -- the local TV station did a phone interview from their new "undisclosed location". It would not surprise me at all if the family left LITERALLY in the middle of the night.

They took my granddaughter from school without telling her why. Put her in foster care without the family knowing anything. Haven't seen her in a year. Now ready to terminate her Moms custody. They now said she is a he. Many other lies. I believe they are going to traffic her and no one is helping. I'm going insane from all the court hearings. “Children’s services” is by far one of the most evil on the planet. May every one of those workers and lawmakers be seriously disciplined by G-d. You know. The One who said children are a gift from G-d and are to be raised accordingly. I have a little cousin in CPS custody after they were the ones who put her in harms way in the first place….. with her drug addicted rapist dad who ended up molesting her and killing some guy. We tried absolutely everything to get her and keep her safe but her twenty something case worker who has never had kids or raised them came and took her and put her in another horrible environment. They are evil.

Qualified immunity does not cover if you forgot to get a warrant. Qualified immunity only works if you get a warrant, and you were wrong about everything in that warrant. And even then that’s very dubious.

they need to consult with specialists, a fracture that goes un noticed is indicative of an underlying condition such as osteogenesis imperfecta or some condition that causes weakened bones. could also be sensory processing where the child is under reactive to pain so the parents didn't know he was hurt. i know someone that happened to, 2 year old broke his arm and didn't even react.

VERY good point. The medical professionals didn't check the kid for any underlying causes that may make his bones more fragile, or pain responses did they? The medical staff IMMEDIATELY assumed it was the parents without doing their job of looking for health complications of the child. 😢 Sad. Kid could be living with a debilitating illness and not know it yet. 😢 Super sad. Lady takes her kid to the hospital to understand his health better, instead hospital staff did not do that job, but instead start the process to separate your family due to misinformation based on assumptions, and a lack of information. I'm not sure what's more sad, that this happened to this family, 😢 or that the hospital staff stopped doing their job of helping individuals with their health to separate families like this. 😢😢😢

That’s what I was thinking. This child needs a good diagnostician to figure out his medical problem sooner rather than later. But after this experience, the parents will be reluctant to trust doctors. I don’t blame them for considering abuse as a possibility with an unexplained fracture, but it’s certainly not the only possibility, and it sounds like they considered no options except for abuse.

Doctors need to be trained on what a shit show calling CPS can become for the parents. Think twice and think thrice before doing it.

If it was an "emergency" why did they wait till the middle of the night??? Not to mention after already questioning them at the hospital then releasing them... If it was an emergency, they never should have left the hospital; it obviously was not an emergency though, as the child was not deemed in immediate threat, so by all means open an investigation and follow up to make sure there are no new injuries, but to show up in the middle of the night for an "emergency" protection was completely wrong and I hope the they all loose their jobs and the city and the workers pay dearly. Also, the managers of these people need to be investigated and probably fired.

If only it was so simple. They don't need a warrant to take your kids, and your refusal to consent to a search gives them probable cause to do the search anyway. It's absolutely messed up.
