According to the Landlord and Tenant Board, there are only 2 legitimate reasons for the Landlord to terminate the lease with the Tenant.
Reason #1
You or your immediate family needs to take the unit back for self-use.
And in this case, you must pay one month’s rent to the tenant for compensation.
Reason #2
You sold the unit to someone else and the new buyer needs the unit for self-use.

I had the exact same thing happen to me, except the judge ruled in favour of the seller - odd that we have two similar circumstances with two different rulings - the judge ruled that the buyer was at fault and seller did everything he could to act in good faith. The only difference is the tenant only named the seller in the hearing to the landlord tenant board. The buyer was a numbered company from Vancouver and no effort was taken to locate them by the tenant.

The bigger problems is landlords and rental companies raising rents by 20-30% on good long term tenants is inhuman. Yes, you’re allowed to do this by law but that doesn’t make it right. I would rather have a tenant who treats my property like it’s their own home and lives there for an extended period of instead of constantly raising rents and having to cycle through multiple groups of people.

Another approach would be to hire someone to represent you at the Landlord and Tenant Board who was familiar with the issue and could point out the various decisions of Apellate Courts (including two that are mentioned in the Board's own Interpretaion Guidelines) that say that the purchaser is the one liable to pay under these circumstances.😁

If you have a long time good tenant, don't push him out. With sky high rent, you can get into very strange situations like subletting etc.

I’m renting out my unit for 20% below market price under rent control. Nothing I can do.

@@akk4768 Guess what? Tenants aren't just an investment opportunity. They are actual human beings. If you don't like the regulations protecting tenants from greedy landlords, then don't invest in rental properties. Pretty simple isn't it?

@@akk4768 I have a feeling you have no idea how the law works regarding the residential tenancy act here in Ontario. You can’t just simply “break the contract”, forcibly remove the tenant and then just pay a fine. Doesn’t work that way. If you didn’t know what you were getting into when you purchased a rental property as an investment, then that’s on you. Should have done your research first.

Landlord's should have a reputation to live up to like a restaurant. There should be a website like Yelp where names of landlord's can be looked up based on their history and reviews. No paying tenant should be asked to leave their home unless the landlord is selling. At least 3 months' notice should be given to tenants when they are planning on listing. A mutual agreement should be met when a landlord is asking the tenant to leave before the contract is fulfilled.
