I was all for Prior thinking he was doing what is right. When he started explaining himself, he made a full of himself. I almost believe him. The judge was like, not so fast Prior, not so fast, I see through you.

Far be it from me to defend Chad or John Prior. I think we all want Chad’s trial to be ‘once and done’. But I can’t help wondering about the legality of forcing Prior to stay, especially without additional pay. He has already said he can’t do it alone, and I can believe that. So, isn’t all of this stuff just preparing for an appeal after Chad’s trial? Prior already has put it on record that he can’t do a decent job. So, later, he just shrugs and says. ‘I told you so. Give my client a new trial.’ I don’t even need a crystal ball to see that coming.

@@mjdibellaI think chads wishes and the rights for him to have a trial outweigh whether Prior gets paid or not according to Judge Boyce. In the courtroom Prior admitted Chad wanted him to stay on as his lawyer and it’s also now been almost fours since the kids bodies were found

​@@debbiem7443I surmised that also. Just as Lori, going ahead with a speedy trial, had the death penalty taken off the table with the reason the dp expert did not have sufficient time to prepare to minimize the penalty.

I think that Prior planned on ditching Chad before trial from the beginning. Which is why I think that Prior has spent the last four years not preparing for Chad's trial. I think that Prior's defense is going to be something he puts together in the next 12 weeks. Prior wanted Chad's house and he wanted the media attention, but he doesn't want to actually do the work and defend Chad at trial. I think that Prior knows that Chad is going to lose at trial because you can't defend the indefensible.

It looked to me like drain him of all of his money and then drop him, which is pretty shitty. He could have bowed out before his client had no money for private counsel or had him get a public defender as soon as he could be declared indigent. He literally had to keep going until he got every last drop. I don’t feel bad for Chad, but there are kids who should have got that house and that money. They are making their way through life with no parents now.

The state summarized the dancing around by Prior and Chad very well. They are 100% correct at wondering why they are having this hearing- nothing is new in this situation from a year ago. This is flirting with unethical practice.

She's moved on and living a better life and she doesn't have to worry about her relationship with him, better things lie ahead and Chad will get what's coming to him, and he still has hell to look forward to. I would challenge anyone who thinks Chad is going to get away with this to think what comes next. Even the Big Bang Theory, the dust particles that sparked and the space they resided in had to have come from another source, they weren't just there. People who have seen things, people whom have seen their loved ones happy and smiling elsewhere, Chad will suffer in way or another and will answer for his choices and things will be made right, Tammy knew and does know that. Her poor family are the ones that need support and loving hands of friendship, this is an incredibly difficult time for them, Chad has even gotten to them and betrayed love can be incredibly hard to accept, but Chad is only half of their life, Tammy is the other and good half. She loves and wants the best for her children, and I'm 100% sure she would wish for nothing more than to make sure they're taken care of through this difficult time

My gut instinct has always made me dislike Mr. Prior. Since he knew all these facts in advance, I think he's just an opportunist. He has had plenty of time to get ready for trial, and now he's pulling this crap 3 months before trial? Scandalous!

There is just something about Prior’s voice that sets my nerves on edge. So glad that Judge Boyce refused to allow this ridiculous motion. Hopefully, it won’t be an issue when Chad eventually appeals his inevitable conviction.

They need to either admit that he can’t do it properly or he needs to just suck it up. Lawyers can do pro bono if they want…and he volunteered for that…they can’t complain because he is pro bono.

Prior is a snake. Bleed Tammy’s estate dry instead of negotiating a plea for Chad. He watched Lori’s trial, he knows there is no way for Chad to get away with this.

Dr. John Matthias goes into how pea brained Chad thinks, he said three years ago it's not in him to even plead guilty it's a matter of pride his ego won't ever let Chad plead guilty , and that was three years ago and Chad's still refusing to take a plea , I think Prior underestimated Chad holding out for a trial even with mountains of evidence against him.

I'm interested in the value of Daybell's property. The reason being is who would possibly want to purchase a property which was a site for the torture, murder, burning, dismemberment and burial of two precious children and inside the home, the murder of a lovely woman?

What I don't understand is I want off the case, then I want to stay on the case in the same breath. Which is it? He can't pay me. I don't care if he can't pay me. He isn't death penalty qualified. We've known this how long? We need a score card to keep up with Prior's antics.

He was angling for something but didn't want to have to ask- I reckon for the court to start paying him. I worry that this will be used as a reason to appeal if Chad is convicted- plus it gives his ego the protection that 'i said I couldn't do it on my own ' if there's a guilty verdict 🙄

If there is a plea deal that means Chad is in prison until his death, that sounds reasonable to me. The thought of a whole trial again with all the awful details of their victims deaths doesn’t bring them back and traumatises the victims loved ones again. Judge Boyce made the right decision. John Pryor is sketchy at the best. Just lock Chad up forever…no parole ever. Lock him up and throw away the key. RIP Tylee, JJ, Tammy and not forgetting Charles Vallow. 😢

He doesn't want to say he can't adequately represent Chad- yet he says even after all this time, he's NOT ready! Hmm. I've always found Mr. Prior a rather large windbag- lots of filling the air with talk talk talk, but not really making sense.

That really is..... Ugh Tammy is likely" in the beyond" and shaking her head sadly about all this aftermath. Probably hardly any of which we only are aware of the effects on her kids and grandkids. House should have been sold first thing, profit divided equally between her kids. What CHUD can afford is a public defender and that should have been his representation.

If anyone wants to hear an attorney speak double-speak, John Prior just did it here. Judge Boyce saw right through his ruse. This was a 'Hail Mary' on Prior's and Chad Daybell's part. Chad blew it out of the water when he told the judge he wanted to keep Prior as his representation.

All Chad had to do is request new counsel. Under his constitutional rights, Chad would have to be appointed 2 Death Penalty qualified attorneys, and that would have set the trial back years. It was he right, yet he chose to stay with Prior. Hopefully the antics are done and let's get this over with.

Nate, I am very interested in Chad's trial because of the bodies buried in his yard and his wife's death being a homicide. Now that Lori has been judged guilty in Utah, Chad is the more interesting one. Thank you so much Nate for all of your hard work.

Oh, her case was in Idaho. And she has a trial upcoming in Arizona, but already she is serving a 5x life sentence in Idaho so its not a very useful trial. 🤷🏻‍♀ Charles' family deserves to see justice for that death specifically also though.

Chad knows Prior isn't DP certified yet still wants him as his attorney. That fact should negate him being able to use that as grounds for appeal. We can hope anyway.

I don’t think if he get 5 great lawyers, like a dream team, he won’t be send it to dead row. Lori escaped the dead penalty for a good reason, her lawyer strategy, imho. So, there will be no way that Chad isn’t going to get fried, he will. If not for his wife, but the two children.

John Prior has seemed a bit like a whiny-child who wants his way and thinks anyone who disagrees with him is just inferior to his knowledge. I don’t think he has spent hours looking for a co-attorney nor hours and hours preparing. He’s had the exact same time as prosecutors have has plus he didn’t have to try another part of this case at the same time. I definitely think it was another ploy to get more time.

I agree with you that he wants more time because he's spent the last four years filing motions to delay the trial instead of actually preparing his defense. I wonder if Prior is going to pretend to have a medical emergency the day before the trial starts so that he can delay it again.

Judge Boyce was very patient, I was asking to myself, what one is it Prior? Do you wanted to get paid or not? Does only matter or not? He was a fool to bring this matter to the judge like a little child. I thought he was smarter than that, I guess I was wrong. Judge Boyce was great.

If there's a plea deal Chad will have to offer up the details of what actually happened in these deaths. The denial the Daybell children are still in won't survive that. I feel for them but they need to have their eyes opened. Then Chad can disappear into the bowels of the prison system for the rest of his life.

Yes, thoughts are that JP was trying to work a plea deal as soon as he went to the Prosecution table after the hearing.

Why did John Prior petition the court to let him leave because of non-payment if that isn’t the issue??? Even now, this attorney less than transparent in his motivation. I suspect that Prior is aware that he is not up to the task.

I think that Prior planned on backing out right before trial since he agreed to be Chad's defense attorney in exchange for his house. I think that the only work Prior did for Chad the past four years was filing motions to delay the trial. I think that he is going to start preparing his defense tomorrow. Chad is an absolute idiot and he's so stupid he didn't see that he hired a thief for a lawyer. Prior would have gotten away with stealing Chad's house if Judge Boyce hadn't nipped it in the bud.

I had the feeling Pryor was just delaying and delaying, hoping that eventually they would take the death penalty off the table. I hadn't thought of the possibility of a plea agreement. That seems like a very real possibility. It would be better for the victims' families.

I think it would be great if Chad showed some honesty and pled guilty! No big trial, saves everyone time and money and heartbreak. He knows honesty is the correct way to go, but he probably will not do that.

I don't think the prosecutors in this case would even consider a plea deal. Especially this far into the process. I hope I'm not wrong.

I think they might: plead guilty or no contest in exchange for life w/o parole. Then this whole mess can be over. Except for the infinite grief of the family members, that is. 🥺

Thank you again Nate for putting this together. To answer your question ... am equally as interested in following you on Chad's trial as I was with Lori's. ALTHOUGH this is the first motion that really got my attention. Seems like Prior wanting to withdraw was simply a strategic move on his part to try and get the DP off the table. After listening to the judge it seems like Boyce was preparing a really fine summary for an appellate review so they won't decide to overturn. Just my opinion.😊

He owns the defendants house which is worth hundreds of thousands of dollars. So he blew through all that money? He is talking out of both sides of his mouth.

The house hasn’t been sold. Also, I’m sure he’s had to pay a mortgage. No way with Chad’s financial history was that house paid off. Chads kids live in it and pay Prior rent. The house and land might be hard to sell because of what happened there (Tammy) and the kids being fond there. I don’t feel bad for Prior, but that house and land isn’t all that.

I think the whole "I want to withdraw" thing was just a maneuver to get Boyce to remove the death penalty again since he's denied all the motions. Pryor was trying to create a situation where 'death penalty out' would have been a possible remedy.

That is very possible, but I also think maybe Chad is willing to take a plea deal to get DP off the table. He has to be convinced he will lose a jury trial. Not sure Prior has been convincing Chad of that, but he needs to in order to facilitate a plea deal.

Yes please do a deep dive into how lawyers get DP qualified. I thought I heard the mike pick up a few words from Prior to the pros at the end. I thought I heard him say something like "We have to figure out" then I lost it. Give it a listen again. Thx Nate and crew!

Personally when I saw the motion filing I thought that Prior was being sneaky and trying to get the death penalty off the table. He has argued this qualification due to Lori not having it before. After hearing his statements in court today I can say I still think the same. Also… why would you want to work for free for a murderer? I understand wanting to for someone who is actually innocent.

I love that the judge also mentioned how long Chad has been in custody! That’s also a significant factor, lots of people are overlooking.

@@angelaangela6875 I had it done to me at one time, some nut case suing me, so I ran to a lawyer and told him the story, he said he needed a retainer, took my money, and said, take a deep breath, don't worry anymore, I will take care of it.. End of story; he did nothing but filed a answer to the court took 5 minutes, next, 3 years later I received a Judgement. He did NOTHING, and there are stories like this every single day. NEVER TRUST A LAWYER PERIOD. I have had all bad results.

Thank you for clarifying the DP qualified situation. I did not know that if you are facing the DP and you have a private lawyer they don’t need to be DP qualified. Only if the attorney is state appointed. That makes a big difference to Priors argument. Interesting.

I don’t see how Prior, being an attorney not wanting to work for free, would think in any stretch of the imagination that he would find a DP qualified attorney who would want to work for free. There’s no way he couldn’t have know he wouldn’t obtain co-counsel once Chad was found indigent.

The majority of death penalty qualified attorneys work for “free” as far as the client not paying. They are public defenders. You just need to be indigent and have a judge appoint them for you. That’s what Prior wanted. He gets all the money and then has the state pay for the actual work to be done once there was no more money.

Thank you Nate! As always you are on top of this case! I listened to the whole hearing. Very happy that Judge Boice ruled as he did. I agree that this was another delay tactic by Mr. Prior. They have known all along that this was a DP case but Chad and Mr. Prior wanted to proceed anyway. Well, they've made their bed
