Where shall criminal actions be instituted ?
(a) For offenses where a preliminary investigation is required pursuant to section 1 of Rule 112, by filing the complaint with the proper officer for the purpose of conducting the requisite preliminary investigation.
(b) For all other offenses, by filing the complaint or information directly with the Municipal Trial Courts and Municipal Circuit Trial Courts, or the complaint with the office of the prosecutor.
In Manila and other chartered cities, the complaint shall be filed with the office of the prosecutor unless otherwise provided in their charters

Ang natutunan ko dito ay mahalaga ang court pillar sa CJS. Ang court pillar ay nangangaulugang referee at ito ay nangangasiwa sa pagtiyak na ang mga pinaghihinalaang kriminal ay tatanggap ng mga paglilitis at para sa pagtiyak na guilty o inusente sa akusado. Ang natutunan ko po sa court pillar ay napaka halaga nya dahil sakanya ng gagaling ang huling disisyon at nag bibigay ng hatol sa dalawang panig pinakikinggan nya muna ang lahat ng importanting impormasyan bago sya mag bigay ng hatol kong sya ba ay guilty or not gulty at dito binibigyan sila ng tamang parusa sa mga nagawa nila. Ang judge nmn ang ginagawa nya ay siya yong nagiging referee wla syang kinakampihan sa dawalang panig at pinakikinga nya lahat ng impormasyan at bumabase sya sa batas bago mag salita at hindi sya nag didisinyon ng sarili nya kondi batas din ang kanyang sinusunod. The court pillar is critical in CJS because it renders the final/decisive judgment. The court is the proper venue for making fair and just decisions. Another thing is that the court protects the rights of the accused. As they say, the accused is innocent until proven guilty, so we make certain that their rights are also protected. Our court, through our judge, ensures that no one violates the accused's rights.

We're now on the third pillar of Criminal Justice System and it is the Court Pillar . Court Pillar is serve as the center of CJS. What I've learned in this new lesson is the function of the Court pillar wherein one of its function is to administer justice every time there's a criminal case. Court is the one who'll decide or give a final judgement to the offender. In addition to that, I also learned that the Judge is the one who serve as referee for both parties and his most crucial role is to determine the guilt or innocence of the acused, based on the laws and not on his own discretion.

In this video lesson, I've learned that the court is a government body and not a private sector and it's job is to administer justice. In these days, the court gives the final decision on what will happen to the accused unlike before that there are no court and people are just doing "ordeal" to know if is the man is guilty or not. In addition, I've learned that in the court we consider the Judge as the "referee" because he/she make sure that attorneys (prosecutors or defense) play by rules of the games, so to speak and he/she determines the guilt or innocence of the accused.

In this new Lesson, I learned a lot especially the definition of COURT PILLAR and it's roles in CJS . The COURT is the third pillar of the CJS. In CJS we have a separate initial judicial branch that is necessary to assure or in assuring that the constitution and statutory rights of the people are practiced. This pillar is important in the administration of CJS because it is the final arbiter. In the COURT comes the decision on all disputes and issues of cases involving violation of criminal law and other laws that are heard in the Court. In this subject matter, talks about the third pillar of our Philippine criminal justice system which is our court pillar that is the government body to administrates our justice system .In our court trial, judge will determine the guilt or innocence of accused that is committed to know the both statements or evidence and do his/her duty that based on our law and do the rights of accused. The judge must be responsible for paying attention the person who’ve been arrested/accused. In the Philippines, we have 4 categories of court which are the regular courts, the special courts, the collegiate courts, and last is the lower courts.Those court functions through the lowest to the highest court that have a classification which court you may in based on the cases.

Ang pinaka mataas na court ay ang supreme court meron tong isang chief justice at 14 na associate justice. Lastly, I learned that there are different courts in the Philippines and all of them have their own function but only the same goal which is to ensure that the defendant truly committed the crime and to provide justice fairly.
