A report from Seton Hall Law School Center for Policy & Research has found that in the majority-white municipality of Bloomfield, New Jersey, nearly 80 percent of traffic tickets are issued to African American and Latino drivers.
The report also found that most tickets were issued to non-resident minority drivers passing through town, suggesting a "de facto border patrol" policing policy is in effect.
The Bloomfield Police Department - which has begun collecting data on the race of drivers in traffic stops as of January 2016 - rejects the report's findings.
Jason Castle is a councilman-at-large for the Township of Teaneck, New Jersey. In 2012, Castle was detained by New Jersey state troopers near Englewood after he pulled over to change the settings on his car's GPS. His warrant stated that he had refused a breathalyzer test. Eight months later, Castle's charges were dismissed when the state failed to supply evidence of an offense or provide him with a speedy trial. VICE News sat down with Castle to hear why he believes he was mistreated and denied his rights by law enforcement.

This is already a crime; it's called *spoliation.* There are penalties and evidence is presumed to be in the accused's favor under such conditions. - I'm not a lawyer; but, the district attorney should charge him.

The evidence on the case disappeared because they found out who he was before trial date. And they were enbarrassed. The Officer should've been terminated, effective immediately!

It does not matter how many facts or how much Truth you put out to aide in establishment of Justice when you are dealing with the wicked. In the Book of Isaiah it says "Justice stands afar off and Equity cannot enter because Truth has fallen in the streets". When truth fails to bring justice about because Truth should ALWAYS lead us to a just conclusion, but if it fails because the forces of evil are so strong that Truth has fallen in the streets and is not allowed to bring about Justice, then the God of Truth and the God of Justice must physically remove from power the forces of Injustice". No. The evidence disappeared because the recording made the cop look bad. Upon review it was OBVIOUS that this was a bad case. However, it took several cops to "make the recording disappear." When people say that most cops are honest, they seldom deal with the fact that the supposedly honest cops have protected a dishonest cop several times in their career. The TRUTH? MOST cops are corrupt. They either break the law themselves or they cover up for other cops who break the law.

I agree with you. But as a Black Firefighter I have been pulled over in full uniform and the Cop asked me if I was on probation or parole and if I was in a gang. Then asked can he search my car for drugs, I said are you kidding me then he let me go once I asked for his badge number. Lol, Yes there are racist people.

Ok so for a clearyfing example I'm going to invent a new word and I'll call it for the sake of simplicity "A". Let's say you live in a city where there is crime. And let's say 80% of the crime is done by people who identify as "A". Now if you meet a person who identifies as "A". Wouldn't you be extra cautious and request measures that you wouldn't request from another person who let's say identifies as "B" who rarely do any crime?

Some of the White Guys who hated me are actually my best friends now and they apologized but there still are a few but those guys no one likes anyway, Those are the old timmers that are bitter. I remember a black friend explaining to me the circumstances of young black men and the harassment and risk they face from law-enforcement, this was 16 years ago and nothing has improved, maybe the circumstances are worse. Thank you so immensely for taking the time to share your story. This is tremendously heartbreaking, inappropriate, and total harassment. As a Caucasian man from the suburbs of Chicago I know how much privilege I am given, and I only wish I could convince others among our world, that WE ARE ALL HUMAN FIRST. We are no different from one another, 99% of our genetic code is the same. This man is a far better man than I, a Marine(I have not served), an elected official(I do not hold public office), an active contributor to commerce & community(I do not hold a position with Apple, pay as high of taxes as this man likely does, though I do own my own automobile). I have stopped on the shoulder in New Jersey, in Illinois, Alabama, Georgia, Indiana, Colorado, Idaho, Wyoming, Arizona, Florida, among dozens of other states, the only two states I have had a police officer come behind me was in California & Utah, and in both incidences after I SAID, “Officer everything is fine here, I’m just pulled over to use my phone so that I am not driving and distracted- that was the end of it.” As an American, a resident of Arizona now, a former resident of New York State of the State of Illinois, the State of Wyoming I don’t accept that this is how policing should go down. I leave you with this: I was driving on I-94 in Chicago just south of the city at 18th Street, I was headed to a girl friend’s house in Bridgeport when I saw two guys stopped on the side of the road with some engine trouble, this was the day after the shooting in Ferguson, Missouri, and tensions were heated ARE heated all around. And I saw these two guys who are Black and have tattoos on their faces and arms, really cool guys(Now great friends of mine who happen to live near Division & Kenmore) and I stopped to see if I could jump there car or just be helpful in anyway either by commission of a helpful act or simply by being present, and maybe ten minutes after arriving Chicago Police arrived and despite their car being unsafe to drive, despite the engine smoking, the police DEMANDED that they move their automobile to another location(despite not blocking the roadway), they didn’t offer to escort their vehicle through traffic which was moving at over 55mph but together we were able to get their car off the road. I don’t know what would have happened had I not stopped, but my friends tell me now that it certainly wouldn’t have gone down as smoothly and that is DISGUSTING. WE ARE ALL HUMAN BEINGS(The late great Congressman Elijah Cummings)), and none of us should be tolerant of a system that perpetrates people of color, minorities, women, and its citizens differently from person to person. This is absolutely appalling. Just because someone doesn’t promote prejudice themselves doesn’t make them any less atrocious in their committal to injustice if they too stand by silently in witness to injustice! What pisses me off is the no accountability aspect... where is this cop that unfairly harassed this guy while his was fighting the case in the courtroom? Probably harassing and/or charging someone else with an unfiar crime left and right...while a courtroom Judge wants to apologise on his behalf...theres alot of people that would take a job with benefits like that, hold cops accountable let them get fired and hire replacements til we flush out all the rotten ones.

the cop was in court every time, getting paid time and a half.......cops today make in excess of $100,00.00 per year, but there's a catch, they have to write tickets and make arrests to get to that pay, if all they did was cruse and keep order, they would leave 40,000.00 on the table, so yeah, if they just did their jobs they would get between 65 and 75 grand a year (basic patrolman). so think about that whenever you get stopped or see someone getting stopped, they have an incentive to ruin your day.

I was all alone this was in 1979' I had been living in the area for . Maybe two months. And wonted to see all those great monuments . After a couple of hours I sat too rest on a granet wall . Along Indipendance Avenue' was'int there two minutes before ! A policeman came along and said you can't sit there you got! Too move along, I thought that was kind of odd. But I thought, I'm new here so I moved on; and took in some more sites. While passing the very same spot an hour later. There was a young white couple sitting there ! And the Cop' and I met at the same location, I looked at them. And I looked at him ! And he looked away, And as if this wasn't troubling enough ! The cop and I were bought "Black Men" about the same age. I'm from the south, and that never happened to me there ! I thought too myself what a great "Police Dog!!!

I realize this video is 2 years old now. But do those of you that are black realize what you have done when a white man tried to open dialogue with you? You refused it. You begin calling him names and disrespecting him. How can you have a dialogue if you're not willing to listen to a white man that agrees with your plight? If you expect to win the war against racism don't you think you're going to need White's on your side? Use the Civil War as an example. Blacks helped fight for their own freedom. I constantly think of how to fix the cop problem and I thought prosecuting them for everything false arrest should be kidnapping and accessive for should be aggervated assault but they will never pass laws to punish them and if the are all required to wear body cams it still wouldn't help because they can cut em off and on but u make a good case we need a organization put in place to police the police

It just makes us *think* we are safer. And the kicker is , usually the reason it doesnt make us safer is we where not in any danger to begin with. Always invoke your 5th Amendment right to remain silent, no matter what your color. Talk to them when you sue them in court, but never when you're being investigated.

I don't think it matters whether you disclose that you have been drinking because they will ask you to do the sobriety test no matter what you say and if they find out you had been drinking and you lied about it, then you know it's going to get worse for the driver, particularly if he's Black!

Thank you for your service. I have been in a similar situation except I’m white. I got pulled over by a Georgia State patrol officer around 11pm on I-20. I do not drink but I was accused of being impaired. Field sobriety tests are not admissible in court and I am not legally obligated to take any field sobriety tests. But I knew I wasn’t impaired in any way. I blew 0.00 on the handheld device. I was arrested for DWI because he said I was under the influence of marijuana. I don’t smoke marijuana or anything else. They gave me a breathalyzer at the jail, again blew 0.00 of course. They drew my blood for testing and I spent the night in jail. I had to be @ work by 7am that morning but I didn’t get out until 10am. Blood test results came back a week or so later and I was of course clean. The officer swore up and down in court that I was dwi. 4 different court dates and they finally dropped all charges 6 months later. I had my bank pouch in my truck as I am self employed. I had just over $7,500 in cash that they took from me under civil forfeiture. Even after all charges were dropped it took me 6 more months, a year in all, to get my money. I support law enforcement when they do their job correctly. Unfortunately, that seems to be decreasing over time.

1) If you read the law the vehicle has to be in motion not on or running to be subject for dui. Anyone can be stone faced drunk behind the wheel in a car but if it isnt moving there's no violation. 2) You are allowed to stop on the side of a highway. Thats what shoulders are for. There are spots where there is no exposed shoulder pavement and of course you cant stop there. He could've gotten into an accident adjusting GPS. 3) A lack of education about the law BY OFFICERS is the problem. They are supposed to Know the law, uphold and enforce the law...and also follow the law. 4)This is racism because this doesn't happen to white people.

+Montgomery Bojangles Unfortunately, they ALREADY know what they can and can't do. They just don't care and do whatever they FEEL like doing, because they know they're shielded from accountability. We need an army of highly trained, heavily armed and well funded anonymous soldiers to go around executing corrupt and brutal cops. Once the bad ones start dropping like flies, all that will remain are the good ones and ones that have been chastened. Cops SHOULD think twice during interactions with citizens. They should hesitate to use excessive force, never violate citizens rights, show courtesy, professionalism and respect as their motto goes in NYC and show deference to people and treat them as citizens whom they are there to protect. An arrest should only be made if there is an obvious gross violation. A cop shouldn't even have the right to pull you over unless there is a clear violation that has been caught on video tape. And even then, they shouldn't be allowed to question you about anything other than the specific issue of the violation. None of this fishing expedition nonsense which is then used as a backdoor to try and find something - anything they can twist into a justification for arresting you and making their quota. In a just world, the cop would be disemboweled and his body mounted on a pike in front of the precinct as a warning to other crooked pigs, Khaleesi style.

What the biggest problem with this is is it perpetuates racism the s*** happens to white people as well as black people as well as Hispanic people and they say it's disproportionate but it's not disproportionate it's happening to all our citizenry and while it's happening it's just bad policing our justice system needs to be completely eradicated and rebuilt is systematically corrupt biased and Criminal. The justice system operating under the color of the law not under legal Authority. has successfully criminalized not just our back black population but our entire population. And again we as a people allow this. Instead of making it a black issue it should be a American issue. I think the reason why it's a black issue and not an American issue is because the powers-that-be want to divide us into black and white right and left gay and straight instead of facing the real issues of why the system only works for the few the wealthy. the American system becomes more and more corrupt.

Honestly police have no right to ask anyone where they are coming from or where they are going. They do it to establish dominance. To make you aware that you have to answer anything or do whatever they ask. Whenever a cop asks you where you're coming from ask them what does that matter. If asked where you're going to ask them is there some road I'm not allowed to drive on? What does it matter where I'm going to? In this instance he's parked on the side of the road i't's a state road and the state says if the keys are in the ignition you are in the act of driving. then he answered he'd been drinking. Wrong answer.

This story is a perfect example of why I never leave home without clipping my discrete bodycam on the front straps of my backpack whether, in a car, public transportation or walking on the streets as anything can happen in a NYC moment or in this case a NJ moment.

@rats arsed That's not true, I was on the shoulder of Route 80 with a flat tire, the same highway this guy is talking about, and I had my car off and keys out of the ignition waiting for a tow truck and about 10 minutes after stopping a cop pulled up behind me. I was coming home from work and I was a bit tired but I was sober and the cop just randomly asked if I wanted to do a field sobriety test and I asked if it was mandatory and the cop said no so I said if it's not mandatory then no thank you I don't want to do one then he immediately pulled me out of the car and arrested me for dui without any warnings or without telling me I'd be arrested if I didn't take one smh and when I got to the station I did a breathalyzer and blew a 0.0 but the charge still stuck and I'm still going through court for it. NJ cops are the worst and are so incompetent

So the police officer gets charged with false arrest, false imprisonment, destruction of evidence, false storage of vehicle (gets towed after DUIs), waste of tax payer money, etc? Of course not! And thats why the best defense is to not talk to the police, even if you mean well or think they mean well, because all it takes is one of the many "bad apples" to cause all this.

i was a Police Officer for twenty years in Australia. Although I was a Detective for most of my Service and ended my career as a high ranking officer I continued to work at street level, supervising officers under my command. My Police Force is regarded Internationally as highly professional and well trained. I cannot comprehend the disgusting, vile racism I see almost dailly in the United States. I cannot understand how nobel African Americans are in the face of blatant racial bias. You are better than the shit who police you. You must continue to pursue these matters, see that these officers, not only losse his job, but hopefully their home and anything else of value. I promise you, not all countries have these same issues. I wish I could help. You are a far better human being than me.

I don't know what the original function of law enforcement were in Australia. But here in the US, the original police force were slave catchers. Even would take many freed Blacks who migrated north as a result of being LEGALLY no longer slaves, kidnap them, and transport them BACK to the South to be slaves once again. The way I see it is this, how can we expect good from something that was literally created to force the will of those with privilege, wealth, and statutory authority over the segment of that society with no power at all. It honestly hasn't changed that much, and one could argue that it actually got worse. There are still Klansman in the force all around the country, per FBI statistics and information warning that law enforcement has been infiltrated by racists.. Juxtapose that with a social and economic system that is fundamentally designed to keep wealth firmly in the hands of the dominant race so that the status quo almost never changes. It's no wonder that the situation that exists today is not much different than when it was first implemented hundreds of years ago.

James Frith Thank you for your service mate, what the African American community needs is to Petition the Federal Courts for an order to hold a public and NATIONAL referendum so people can vote to change the laws that protect police officers from personal lawsuits. I was s State Trooper in the 80s in New England US, most of The Troopers were former Marines , highly trained and very respectful of the public in general, I never saw this blatant racist bullshit these cops are pulling in these videos, I condemn it, them, and the whole uneducated culture that spawns it.... totally unprofessional.... know your rights and record everything! Especially with ICE being out of control now, and this new breed of cops who instantly reach for their weapons.... sad.

The first mistake was stopping on the interstate for something that wasn't an emergency. That's a law by the way. "I wasn't driving." Yes, you were. You just pulled over on the interstate. He probably stopped because he wanted to help if you needed something. You told him you were drinking. You just incriminated yourself. He wanted to issue a sobriety test, he has every right to for the safety of all drivers. None of your rights were violated.

The numbers speak for themselves. Take the 112th US Congress for example. It comprised only 44 black house members vs 361 white members and ZERO black senators compared to 96 white senators (thisnation.com/congress-facts.html). Barack Obama was the first black president after the 43 white presidents before him who governed for a total of 240 years. In 2015, out of all the CEOs for the top 500 American companies, only 5 CEOs, or 1% of all CEOs, were black (money.cnn.com/2015/01/29/news/economy/mcdonalds-ceo-diversity/). You mentioned that Asians earn more than whites, but this is a red herring argument and does not change the fact that black men earn 75 cents on the dollar vs white men, and black women earn a paltry 64 cents (www.infoplease.com/ipa/A0882775.html). At the expense of making sweeping generalizations, I will say that Asian culture places a high value on self-discipline, family honor and hard work. These rigid values produce generations of high-achieving Asian-American citizens who outcompete all other races of people at all levels of education and, ultimately, in the workplace. It is not clear what you are trying to argue by pointing out the relative incarceration rates of Asians vs whites in the USA. In an effort to make a more insightful argument, I'll point out that in the year 2010 blacks constituted 40% of the total US prison population. Indeed, whites made up almost the exact same percentage of the prison population, but the pertinent statistic is that in the same year black people only accounted for 13% of the total American population, meanwhile 64% of the American people were white. Put in more meaningful terms, African-Americans are incarcerated at nearly six times the rate of white people (www.prisonpolicy.org/reports/rates.html). It goes without saying that the USA was built upon the institutionalized enslavement of Africans by white Anglo-Saxons, or in other words, WHITE SUPREMACY, which began more than a century before the Declaration of Independence was ratified in 1776. This amounts to roughly 245 years of institutionalized slavery which has left a lasting legacy in this country in the form of systematic marginalization, oppression and even disenfranchisement of not just black people, but hispanics and other minorities as well. I will close by pointing out that oftentimes deniers of white supremacy like to point out that there are plenty of poor white people in this country who struggle in much the same way as black people or any other minority race; and, therefore, white supremacy is a myth and mere fabrication of the liberal left. Take a moment to appreciate that in 2014 only 10% of the US white households fell below the poverty line, while nearly three times as many black households (26%) fit in the same category (kff.org/other/state-indicator/poverty-rate-by-raceethnicity/). Poverty is a systemic problem that plagues people of all races in this country, and it is perpetuated by politics that are intertwined with the neoliberal capitalistic interests of corporations that are dominated by white American men.
