Learn legalese. He is travelling in a conveyance. The police have no authority when your vehicle is not deemed commercial. Driving a vehicle or a car is commercial under legalese, travelling in a conveyance is not. They are a bunch of masonic scam artists in costumes.

You are the first person I have heard say we should sue the individual and not the police, I totally agree. Suing the police is suing yourself and every other tax payer. Moreover when they act outside their code of conduct or police policy they lose their professional immunity and leave themselves open to civil proceedings, this is by far the best option for many reasons. I was pulled over at 4am one morning and was required to prove on the spot that I was the owner of the vehicle. There was no talk about going back to my home to provide the documentary evidence. That was an eye opener. Some times they do surprise you. “I don’t want to have a chat”. That was priceless😅

Years ago, long before smartphones, my uncle was pulled over and said 'no ok I can hear you just fine' when asked to wind his window down. The copper went so berserk he started screaming at him to obey and banging his fist on the window so much that his colleague, who was sitting in the police car, had to get out and drag him away! But that was Wiltshire Police for you - a force with a VERY bad reputation back in the day

The law says you must produce your documents. It does not say "you must hand them over". Tape them to the inside of your side window. They can read what is on them. You are under no obligation to speak. If it ends up in court. Just let your defence show the evidence. The price of a semi decent dash cam has gone down a lot. Deck your car out with 5 or 6 of them for under 100£. When stopped and asked "do you know why I stopped you sir?" just say no and point to the cam that records your speed, the cams on both sides, the reverse cam, the cam on your dash,, then say, a few are live streaming. Then state your right to remain silent as they read those documents you taped to your window.

As worded, the RTA 164 states that you must ‘give’ your details. This does not mean give them your documents as they will most probably use these as a bargaining chip to keep you detained longer or try and get you to exit the vehicle. You can give them the appropriate details by verbal means or by simply writing them down.

Section 163 of the road traffic act is an unnecessary intrusion into the rights of the general public. When no crime or offence has been committed by the driver of a vehicle, what purpose is served by stopping them and being rude, disrespectful, condescending and hostile, other than turning them against the police. Given the increasing number of violent crimes and unsolved burglaries ect, it should be possible for police to be put to a more productive use than harrassing innocent motorists.

If you get an incident like this, ask them for the name and address of their Chief Constable! Then as soon as you reach home, write a letter of complaint, send it recorded delivery. Just asking for the Chief Constables details may ''detune them'' some. .

The problem we have is that most police video programmes on TV show compliant drivers getting out, sitting in the back of the car etc. There is no section that states a driver MUST exit the vehicle unless being arrested, not is there a section requiring the winding down of the window or to suffer false imprisonment in the back of their car (with child locks)

A Policeman told me years ago that a Car Park was a Private road and Not a Public road so he couldn't charge me/us with anything. I was learning to ride a motorbike & learning late at night in a lit car park with no other cars around. I had all the motorbike protection on but it wasn't my bike. Police came in and just advised that learning at a proper motorbike school was the best thing and he appreciated all the protection & caution in safety that we had taken. He was really nice and said that he'd be back in an hour & suggest that we shouldn't be there on his return.

Correctkon. If you have your documents on you, you are required to *show* them. You are not required to hand them to the constable. Press your driving licence to the inside of the window so that the constable can see the information and write any necessary information down in his notepad. The same applies to to insurance and MOT although they have access to that information from the PNC from the details on your driving licence and registration number. In answer to the question "Can I ask..." I always answer "Yes" ss this is you granting permission to ask a question rather than answering an actual question. When asked actual questions, invoke your right to remain silent.

I don’t agree. The state should have the power to ensure that those using relatively heavy and fast vehicles on the public highway (i.e. motor vehicles) are those properly licensed to do so. Else, there’s dangerous chaos.

Therein lies the problem. In other words it can be for no reason whatsoever, that shouldn't be right. We can all agree they SHOULD be pulling over vehicles which are driving badly etc, but not just because they like the look of the car, or like the look of a pretty girl.

I'm just being a little picky here but this wasn't a traffic stop. Mr Bradbury was still in a car park, he hadn't made it onto the public highway. Also, Section 165 is not a requirement to give your name and address. Section 163 is the power to stop a motor vehicle (or cyclist) ONLY. Section 164 is to produce your driving license ONLY. Section 165 is to produce your other driving documents, ie, insurance, MOT and they really want to be picky, ask for your registration documents. It is an offence not to show them to an officer if you have them with you. However, you are not obligated to carry them at all times. Otherwise, a pretty informative post. The biggest surprise was that there were only 3 corrupt officers in the rouges gallery!!!!!

Really enjoying your analysis, one minor point though. This PC repeatedly says you have to give your name under 163, you do not. You could simply say I'm not required to give you my name, or no I'm not until they state the correct legislation. If they don't say a legislation you could ask them and if they don't know you could decline until they give you the correct legislation.

The thing with law is that a newer law will always take the place of an older law. If a new law came out tomorrow making it a legal obligation to give the police your name upon request if you were part of a rally then that would supercede any law which came before it that stated otherwise. A good current example would be s.50 of the Police Reform Act (2002).

under the road traffic act, you must PRODUCE your details (ie. license). You don't have to state your name, only produce your license (which can be done with a producer) which he asked for. He would also have to state his DOB which the constable had not asked for at 6 mins into video. So the driver did not have to state his name. He already offered the officer a Producer.

When interacting with police they are in a position of strength. Strength by way of present numbers and backup numbers. They have body armour, batons, pepper spray and tasers. And they can call up firearms and dogs. They are trained to use restraint, sometimes fatally. Additionally, they have egos. In short, tgese guys are dangerous. Your advice to say as little as possible is very wise - even the insanely dangerous and brave SAS know when captured to become "the grey man". If they realise the need to survive then we need to learn from them.

A lot of the police are on a power trip, and are seriously unhinged. With the array of weaponry they have at their disposal, they have the ability to cause excessive harm to anyone, depending on how they are feeling on that day. Their actions must be proportional too. I recall many instances of serious aggression for just being a human being, between 2020 and 2023. Thankfully they weren't able to catch a hold of me. A masked up, goon dressed in black, tried it on with me, but was unsuccessful, in 2021. It had great potential of going bad. Thanks for the reply. Respect 👍

Whilst I fully agree with the advice you give in this video I would like to make one point having seen the original material. This gentleman was stopped before he had driven out of a Car Park. The is case law found in Griffin v Squires 1958 that a Car Park is not a road which is further reinforcing by the wording of subsequent legislation. As Sections 163, 164 & 165 all have the qualification of ‘a person driving a motor vehicle on a road’ it could be said this was an unlawful stop and also an unlawful demand for details under threat of violence. However, if it was me I still would have complied with 163, 164 & 165 and then added this to any civil claim and/ or complaint.

Several years ago I was on my motorcycle. I was pulled over and the copper wanted to check out who i was. No reason why i was stopped. I was not speeding. He checked my bike over found nothing wrong. He even said he would FIND something wrong. He had all my details. I was detained for over 45 minutes before handing back my license. Insurance and Mot certificate. Didn't even apologise for inconvenience. I had to return home because i could not keep my appointment for a job interview.

6:00 no, 163 power to stop ( divert traffic from crashes or control traffic when lights are out etc etc ) 164 & 165 can ONLY be used if suspected of an offence…..AFTER the use of 163. How auditors and commentators still get this wrong is crazy.

@SensibleCentrist can you please explain how you have formed this theory? Looking at the Road Traffic Act on legislation.gov.uk, I cannot see anything within 164 or 165 that states they can ONLY be used if suspected of an offence.

Legislation is NOT law unless you consent, and it’s not a Vehicle he’s in it’s his CONVEYANCE HIS PROPERTY. VEHICLES AND CARS ARE COMMERCIAL USE ONLY and then the Road traffic ACT NOT LAW applies.

I believe that the police have to still detail their suspicion or knowledge of traffic infringement in order to detain or demand identification. It cannot be simply demanded without cause. Happy to be corrected

You need to bear in mind that police can stop you anytime for any reason, or no reason at all, when you are driving a motor vehicle. You are required by law to provide your details when asked. The police may also carry out basic checks on your vehicle and may also breathalyse you if they have the slightest suspicion. Its best not to aggravate them and just get it over and done with. That being said, that police officer could have kept his cool and could have done a better job.

If they don't find anything wrong with your vehicle and you refuse to get out of the car, Can they say we suspect you have been drinking and you are required to provide a breath sample, Can you still stay in the car?

@@HarryGrrowler yes. You do not have to leave your vehicle if there is nothing wrong. You can be breathalysed in your seat through the open window. They have to have real suspicion, or a serious safety concern, to remove you. That being said, it's very easy for them to bullsh*t you and get you out unless you really know what you are doing.

You don’t have to give your date of birth, so many police officers ask for that and it’s not a legal requirement. Name and Address only!
