इस हफ्ते सुप्रीम कोर्ट के एक महत्वपूर्ण फैसले में सीआरपीसी की धारा 125 के तहत मुस्लिम महिला को अपने पति से गुज़ारे भत्ते के लिए मिले कानूनी अधिकार पर विस्तार से चर्चा हुई. इसके अलावा मुंबई के हिट एंड रन केस और दिल्ली यूनिवर्सिटी में मनुस्मृति लागू करने के प्रस्ताव पर भी बात हुई.
इस हफ्ते चर्चा में वरिष्ठ पत्रकार स्मृति शर्मा, सुप्रीम कोर्ट की अधिवक्ता नबीला जमील और वरिष्ठ पत्रकार सुधीर सूर्यवंशी शामिल हुए. न्यूज़लॉन्ड्री टीम से विकास जांगड़ा ने चर्चा में हिस्सा लिया. वहीं, चर्चा का संचालन अतुल चौरसिया ने किया.

Nabila did not present the concept of “Meher” properly. Mostly Meher is fixed at the time of Nikah by both the Parties that has to be paid by Husband if he divorce his wife. And it cannot be claimed if the Wife demands Qula- Seperation.

To be frank, Indian law will remain a mess until a separation of church and state happens. Bottom line is that there shouldn’t be a space for religion in laws - personal as well as criminal. Both Hindus and Muslims can peacefully coexist in western countries where there are single laws and no religious interpretations. But in India both religions keep asking for exceptions in laws for their own things. PS: Its the same case for other religions.

The envy! Education system is getting tainted day by day with certain group of people's radical ideologies and beliefs. Manusmriti had clearly emphasized everything on brahmins and Kshatriyas glory and supermacy ,while metioning other two just briefly and with discrimination. Clearly,showcasing conservative racism and selectiveness. And it's also known that all these theories and restrictions are written by humans from their point of view back in that time period. Yet, people just glorify all such according to their T&C and benefits. Knowing history for knowledge is good, but for blind faith and supermacy is dangerous. What's with all this superiority complex,when we all are humans , birth and death is the truth.

Who decides the amount of the Mahr? Deciding the amount of the Mahr is to be left to the woman and her guardian. If the woman disagrees with her guardian about the amount of the Mahr, then what appears to be the case from the words of the scholars is that they should take as a reference the Mahr of a woman of similar standing. If she agrees to the Mahr of a woman of similar standing, but he (the guardian) wants more than that, then no attention should be paid to his wishes. If he is the one who wants a Mahr like that of a woman of similar standing, but she wants less than that, then what matters is his view.
