Markus Rochin thats where you’re wrong legal tender is acceptable payment to settlement debts such as fines etc. The only time someone can refuse a certain denomination of currency for payment is when it’s a voluntary exchange such as gifts, in exchange for products and services etc.

The people receiving the quarters were obviously extremely, as the children like to say, butt hurt. So when they called the police they said some very nasty alarming things and the police were ready to face a violent suspect. @@duewhat9815 Being that it's legal tender, if whatever building they were in has a rule that you're not supposed to pay with coins, then it's a rule... not a law. They could've simply refused to apply the payment towards his fine, and since he chose to walk away, they could've kept his quarters and he still would've owed the fine. I'm just saying that there was no reason for the police to be involved. It's obvious that the person who called went overboard on purpose and they also said something in the 911 call that had the police on high alert. It's doubtful that they would've showed up with that many police over quarters.

jamstrat you are making the statue say what it is never meant to say. In Nemser v NYC Transit Authority, the State Court judge sided with the city for denying Nemser in paying with FIVE pennies. The Judge explained that the law only defined what ARE legal tender but made no claim in forbading REASONABLE limitation in usage. Now, unless you have more legal training and authority than a residing judge, I'd have to say you have zero clue about this particular statue.

1. Quarters are US legal tender. The clerk does not have the right to refuse legal tender because she’s lazy and doesn’t want to count it. Dumb? Yes. Illegal? No. 2. The police are clearly provocative from the beginning, especially the officer saying “why is mommy here.” Additionally, they had absolutely no right to stop him, question him, or even ask for his ID. Request a FOIA on the call to police and hear exactly what the caller told the dispatcher. I’m sure it wasn’t just “someone just paid their fine in quarters, please send us the police”.

The clerk called 911 because she claimed the kid "pushed" her, legally speaking that's assault and an arrestable offense. They tried to detain (NOT ARREST) the subject of a alleged crime while they did an INVESTIGATION. They probably would have got his ID and detained him, got a statement from all parties involved (Him, his mom, the alleged victims, and any witnesses) They would have reviewed security cameras and used all the statements from all parties and witnesses and any other evidence for or against the boy and determined if he committed the alleged crime. If they had reasonable suspicion that he had, he would have been arrested and the court would have settled it. I'm not saying he did assault any of the clerks because I wasn't there, the cops weren't there, and you weren't there, but that's why they wanted to detain him and get his information, to determine if he had committed a crime he was accused of. He wasn't illegally arrested. At first he was just being detained so he didn't run off while they were conducting their investigation. After he resisted it became a LEGAL arrest, kicked the police just added to the officers case against the teen. In short, legal arrest, officers didn't break any procedure, protocol, or law. The teen committed several crimes on camera and an addition alleged crime off camera (Which I wouldn't doubt he assaulted the clerks after seeing how he reacted to the police)

You can resist UNLAWFUL ORDERS. just because someone calls the cops if the person has done nothing wrong they don't have to give ID or do anything the cops say, you can't even be detained unless they suspect you've commited a crime. The clerks can't refuse legal tender they're a government agency not a private business, if they refuse your money after you make a sincere effort to pay your ticket or fine is supposed to be voided at that time. Its not hard people. You can and should pay bs fines in change. Their policy does not trump the law.

This type of shit happened to me. There were hoodlums at my house one night doing shady stuff so i called the cops and told them to come. I informed them that I had been arguing with the hoodlums. First thing that happens when the police get here, the officer slams me against my houses walls and practically strips me naked looking for "weapons" which the man never fucking found. After he violated my privacy, they asked me what happened and then drove off. Humiliating me to my neighborhood in the middle of the night, and they never tried to find those hoodlums. I am the person who called the cops, I am the one that needs help, and your going to come to my house and harass me? Every single one of my 3 or 4 experiences with cops has been like this. They always abuse their power and you can never do anything about it. This is why I will never, ever trust police. I do not care what you say, I make my decisions based on my life experiences. And if all 3 or 4 times I needed help, police came and didnt do shit but harass you, I say fuck the police. I have no criminal record, not even a misdemeanor, I am chinese and not african american. And the cops still treat me like shit, I cant imagine how minorities who actually get bullied by police feel.

He was the subject of an investigation. The clerk from inside called 911 and claimed he had pushed them. That's assault. The responding officers saw the subject and attempted to detain him while they got statements from everyone involved, witness, and reviewed the camera footage to determine if he was actually guilty of assault. I'm not sure if he actually is guilty of assault but I do know he is guilty of resisting an officer trying to detain him to conduct an investigation. While actively resisting and border line fighting the police, he then crosses the line into fighting with them with that kicked he delivered to the officer’s stomach. Get rid of the victim mentality as a minority! Find something more create/legit to complain about. All the officers weren't even white. They did nothing unlawful and broke no procedures!

It’s all about how it’s given to them. You can take it. But counting is another thing. I have seen people throw change at gas station attendants and say put it on number, and then expect to have it counted. Holding up the line making them count is likely a crime not often associated or charged often. Blocking the flow of traffic is a good way to get another fine.

Even if the money was in tolls the clerks would have had to unroll them and count each coin to ensure the rolls were filled accurately and correctly. I won't agree with y'all political ideas or views because I'm still learning but I can agree on as a criminal justice student that the officers were in no right to arrest or even touch him. It was a bs and shady move. Now with the video the kid should have never kicked the officer it just backfires completely. But I will say this about officer safety, I'm sick of it too. It's that you have to be in the officer shoes and always assume that something really when it could be a toy to a replica to a minor problem. Because they don't know until the last second and it's too late. We can't solve with bullets. Hopefully today technology will keep increasing to help us find out more of the truth. Like how we find DNA, serial codes, cameras. And I ask you to think about police look into the police side if you can you don't have to but you'll start to understand the training and office safety reasons behind it.

j ho Yes the clerk has everything to do with the fine. He processes it and takes cash payment. He is therefore complicit with the court, who would otherwise have to sit down a bailliff or even a judge to collect the payments and mark them off as paid. Also he receives a certain amount of money on a regular basis and at least once a month from the court from funds he has helped collect, which reinforces the fact he is an accomplice (as opposed to someone coerced to provide this service). Making this person miserable is therefore an adequate response. It impedes the court,'s ability to process payments and it also burdens the clerk. If enough people do this, then the clerk might stop working for the court altogether and seek income elsewhere, leaving the court to process payments again either by bailiffs or even by judges until they can find another person willing to count large numbers of coins on a day to day basis. They might have to offer a substantial larger share of the take to such a person which also causes the court damage.

The boy went to jail because some lazy cunt didn't want to do a little extra work. I could see if it was all pennies but hope hard is it to make stacks of four? I hope they were sued and fired.

Anyone else hear the officer specifically tell him to "remove his hands from his pockets"? How were they supposed to know he didn't have a gun in there or something else that could hurt the officers? He refused to take his hands from his pockets. He could have had a gun in there.

Thunderkrux not our fault you can't read. I know the law is a little more tricky to read, but when something doesn't exist, it is kind of easy to read. Hint: there is no law against the clerk rejecting the form of payment. The law is on her side.

Actually it isn't. There is no law stipulating what form of currency a payment of fine has to be in. In the absence of any such law, the Coinage Act is the standing federal law on the matter. As long as the payment is complete and done with legal tender, the law says she *HAS* to accept it. The clerk was abusing her authority to try to make an inconvenience go away. The kid had every right to expect to be able to pay his fine in quarters. Getting them put into rolls would be courteous, as would simply cashing them at the bank, but as a matter of sheer bullheaded technicality, he wasn't obliged to be courteous, he was just obliged to pay the fine. Sure, he probably did it in quarters as a bit of a punk move. Sure it was rude and inconvenient, but no law forces someone paying a fine to be polite and convenient. Just that the amount is fully paid. In the absence of any claim by the clerk that it wasn't the correct NUMBER of quarters, I presume innocence -- that the value of the quarters was appropriate to the value of the fine and the clerk and the PD are ENTIRELY out of line.

Not one of the officers had the basic common sense to realize that they shouldn't have been called, because someone was angered by the method of payment? He could pay with pennies if he wants to!! The officers should have went right to the window and told the employee that they're wasting police resources. And do the officers know anything about descalating a situation? You should have told the guy to go have a nice day and and then explain to the employee behind the glass what police officers are 'supposed' to be used for.

Any and all fines can be paid in legal tender. There was no crime committed and the officers assaulted that kid. They should be fired and the kid needs to sue..
