An off-duty police officer pulled his gun on a man buying candy at a convenience store in Southern California. The officer apparently thought a crime was happening, but he was wrong. The man and his family don't want the mistake to be swept under the rug. CBS Los Angeles' Jeff Nguyen reports from Buena Park, California.

I had a SWAT team pointing M16's at me on my own front lawn because while they were raiding my neighbor they decided that I looked suspicious sitting there on my front lawn and they proceeded to illegally raid my house arrest my friend's Aunt who is staying with us because she didn't want to cooperate all of us are 100% Whiteskin color really has nothing to do with it at the end of the day pigs just want to shoot someone

wrong. someone who jumps to conclusions, should not be a cop. he pulled a gun over suspected candy thief, there's nothing wrong with it. i agree wtih the victim, cop's arrogance was the problem. they way he treated him like he was trash, that was the problem. cop should have started by asking "did he pay for it", not pull a gun on him and tell him to put back what he paid for.

@@SethiozProject "he pulled a gun over suspected candy thief" He could have just said, "Look, I'm an off-duty police officer. Put that candy back before I arrest you." Instead he pulled a gun. He should not be a cop. Of course he disqualifies himself by jumping to conclusions. But this was not him stopping a violent crime in progress. No gun was needed. The threat alone would have caused a shop-lifter to comply. He didn't ask the cashier first because cops don't care what a witness has to say, they care about establishing dominance through fear. Once his gun was out, he felt like he was "in control" of the situation. He wasn't even in control of himself.

Exactly . You traumatized this man unnecessarily then its supposed to be OK by a " my apologies " . This happens all the time this just happened to be on video so hopefully this officer will be at least reprimanded .As a young man I was sitting in a car outside the liquor store just shooting the breeze with 3 of my friends when 2 officers walked up , gun drawn pointing at us in the vehicle .After studying us for a minute they reholstered their weapons and walked off , no apology , no explanation , nothing . We couldn't do a damn thing just makes you feel powerless and violated . Do I need to say we were four twenty - something year old black men ?

@@kzziggy not quite sure what to make of your reply . The police have a code of conduct that they need to follow as well as the citizens need to obey the laws . Its supposed to be " serve and protect " not bully and intimidate . If the police see you do something wrong you will probably face punitive action , arrest , ticket , etc . If you see them do something wrong , and especially if you can't verify it with video evidence , they will probably get away scott-free . Also ,what threat did the Hispanic man pose that the cop had to immediately draw his weapon , please tell me how you justify this ?

Mentos are 50 cent candy? Not in California. This man was gracious not to request termination. Officers are taught you do not pull your weapon unless its life or death on duty. Off duty its even lower profile. Over candy never. Even if it was Ferrere Roche (sp?Lol.). I am pro good policing. This fellow was way out of line. He could have asked the proprietor if the gentleman paid for the candy and avoided the drama and embarassment to himself and department. I would file a civil suit at minimum. Buena Park PD can decide about termination. He is a liability. Poor discretion. Theft of Mentos is not life or death.

You must have voted for Biden with that nasty comment. I think the officers actions were deplorable to say the least. I said he should be fired on the spot. I didn’t imply or say that there should be no consequences for his wrong actions did I??? At bare minimum he should be fired not reassigned duty or other BS and yes he should face criminal charges for pulling a gun out in a public area without all the facts and where it wasn’t warranted. The first thing he should have done is anounced himself as a police officer. Then he should have asked the store owner if the guy had paid for the candy. After that he should have made his decision on what to do next. He was ready to shoot first and ask questions later. He handled that situation completely backwards.

Crap officer wasn't even looking to make an arrest for shoplifting (was letting him leave before he confirmed the guy paid for it) - he just wanted to stroke his gun and go on a power trip, not the mentality to be entrusted as an officer.

It’s disturbing how quick he was to pull a gun over a pack of mentos. If that was me, not only would I have pushed for the cop’s credentials to be stripped, but I’d also have called the police right after he pulled a gun on me to file a criminal report, then a civil suit after that. Even if this gentleman was actually stealing candy, pulling your gun out for something this simple is insane as there was no threats whatsoever so ever and on top of that over a dollar candy? The cop could’ve easily handled the situation a lot better by showing a badge.

It's amazing how low the bar is for police officers. If you engaged in anywhere near this level of misconduct in a different industry, Not only would you be immediately fired and blackballed from that industry, but you would also be facing criminal prosecution. The Cheif should’ve been referencing pending criminal charges as well. There was 0 justification for him drawing his firearm, and that was assault with a deadly weapon, and your average citizen would’ve been locked up. As a cop, that was excessive force. Anyone that would pull a gun on someone because they saw them put a pack of candy in their pocket has no business owning a gun. Even more important, such an individual has no business carrying a badge

That cop is a damn menace to everyone he crosses paths with and should absolutely not have a badge. That customer is WAY too kind. Training will never fix that kind of a power trip.

Exactly - he has been trained when to pull his firearm, in a classroom role play he would say that is not the time to draw his weapon, he didn't even intend to arrest for shoplifting - cop just wanted to publicly stroke his gun on a power trip.

​@@theflyingegg3557 Most wouldn't describe a _person_ as an _incident._ If the majority of law enforcement would uphold the blue shield, showing favoritism to another officer or his family/friends based on their connection to the police department, or lie on a report to cover up the inappropriate behavior of themselves or another officer, then most officers are corrupt, not "isolated incidents."

He's a good dude, not wanting the officer to lose his job, but as a former police officer and current 911 dispatcher, that officer doesn't deserve to wear a badge. I don't know the outcome of this story, but he absolutely needed to lose his job.

if he pulled his badge instead there would be no danger. He was more at risk of getting a taste of his own medicine by pulling the gun. The shopper didnt know he was a cop and may well have pulled his own gun and shot him. Quite frankly he would have deserved it.

He did apologize. I’ve seen cops refuse to apologize even when they did something wrong. I wonder if he’ll jump to conclusions next time. Good thing the guy in the video didn’t argue with the cop, he just complied and the misunderstanding was resolved without anyone getting hurt. The officer should be embarrassed and put on probation at least. One thing that baffles me is why the cashier just sits there and doesn’t say anything until he’s directly asked. I almost feel like that contributed to the cop thinking he stole it.
