DENVER - A Denver bakery owner said she is facing a complaint of religious discrimination because she refused to write an anti-gay message on a cake.
"This is mainly a happy job. Happy birthday, Happy Anniversary, Merry Christmas," said Marjorie Silva as she iced a cake in her award-winning Peruvian Bakery. "It's filled with dulce de leche and love."
But last March, a man came in to Azucar, 1186 S. Broadway, asking for a Bible cake with a message he had written down on paper.
"I was shocked; I was like, 'Oh my God. What am I supposed to do?'" said Silva. "It was words like 'detestable', 'sinners.' He wanted me to draw two guys holding hands with an X on top, so it was a very hateful message against the gay community. "
Last year, the Colorado Civil Rights Commission ruled that another bakery, Masterpiece Cake Shop in Lakewood could not refuse to make a wedding cake for a gay couple, calling it discriminatory.
Now, some anti-gay activists claiming to be exposing hypocrisy are ordering "Gay Marriage Is Wrong" cakes from gay-friendly bakeries.
"I was sick and tired of Christian businesses being attacked by homosexual groups," said Theodore Shoebat, a self-described 'militant Christian' who called 13 businesses ordering cakes last year.
He doesn't know who made the request at Azucar, but said he is encouraging others to do the same.
"But I wouldn't write an anti-Christian message, either," said Silva.
Silva said she eventually agreed to make the Bible cake, but not to write the anti-gay message.

So, is a cake shop owner allowed to refuse to sell a cake based on what it supports or not? Forget about which side of the argument you happen to agree with, it's hypocritical to discriminate. As a Christian myself, my view is that if a cake shop owner wishes to refuse to make a cake based on what it supports, then they have the right to do so. No-one should be forced to sell something that is not for sale. That applies to everyone equally, no discrimination. If a cake shop wishes not to sell a cake with an ANTI gay message, they should be free to do so, and if a cake shop wishes not to sell a cake with a PRO gay message (like a wedding cake with two dudes on top) then they should also be free to do so. You should not be able to use the "justice" system to force anyone to sell that which is not for sale, or to bring upon said person any financial, social or any other repercussion for refusing to sale that which is not for sale. It's that simple. There is no such thing as positive discrimination, only discrimination, there is not such thing as tolerance that goes only one way, only intolerance.

No-one has refused to sell a cake based on who the customer loves. Just like in this video, the cake was not refused based on who the customer disapproves of. Refusal of sale has been based on the cake itself and the message upon the cake, not the customer of the cake. In the case of this video, the cake shop owner refused to make a product to the customers specification as it went against her beliefs, and in this case everyone agrees she has the right to do so. But the fact is, if she has the right to do so then so does everyone else weather you happen to agree with it or not or if you think it's judgemental is irrelevant. You can defend against people like me all you like, big up yourself brah! But when you realise that I have not been judgemental or mean spirited in any way then you might realise that you have wasted your time fighting a cause that never existed. All I am asking for here is that the law be applied to everyone equally. Either you have the freedom to refuse a sale based on the fact that the item in question is an item you do not wish to manufacture or you do not. Personally, I would rather people have that right to refuse the sale of an item they don't want to make and I am glad to see the woman in this video exercise that right. I just think the law should apply to everyone equally, not just to those that you or I happen to agree with. I honestly do not see how that is mean spirited or judgemental. It's equality, and true equality is not the kind that happens only when it suites you, or gays, or straights, or men, women, black, whites or whoever. Between you, me and the cake shop owners the only one that has been overly judgemental and mean spirited here is you.

radbot1 - In the case of the gay couple who were the victims of discrimination, they didn't ask for something that wasn't for sale. They asked for a wedding cake from bakers who bake wedding cakes. Your opinion if just that - your opinion. If you're a business owner in a state that has laws that protect certain classes of people from discrimination you're expected to abide by those laws. You don't get to pick and choose which laws you'll obey and which you'll ignore based on your personal beliefs, no matter how "deeply held" you believe them to be. In the case at hand, the baker didn't discriminate against the Christian man. She agreed to make his cakes, but declined to write his requested message on the cakes. If she were a Christian baker opposed to writing "God Doesn't Exist" on a cake, she'd have the right to refuse that as well. Refusing to write hateful comments on a cake is not discrimination. Do you understand the difference? If not please let me know. I'm here to help.

Who cares if it's a hateful message if bakery's are forced to make pro gay cakes then bakery's should be forced to make anti gay cakes, it's all or nothing with equality no picking and choosing. I personally believe that it is not a right to be served by any business and so all businesses should be allowed to discriminate based on whatever they want. She shouldn't be forced to make a cake and neither should anyone else

marksmith46 when you buy something it belongs to you but just because you are willing to buy something doesn't mean the owner has to sell it to you. Where did I say closed mindedness and intolerance were noble? I personally don't think people should refuse to do cakes for gay weddings but they shouldn't be forced to. Once the cake is sold to you it's yours to do with it as you wish, write messages, use it for a gay wedding whatever, but until then it belongs to the bakery

marksmith46 where did I say gay cakes were anti traditional marriage? I'm pretty certain any cake with writing on it can convey an opinion, and sometimes that opinion can be polarizing. In such cases when the baker takes offence to or opposes the view being endorsed by the cake they have the right not to put their icing on that cake to create that message. This goes both ways, with both anti gay marriage cakes or pro gay marriage cakes, if you don't want to write on the cake you shouldn't have to. note I am not opposed to gay marriage and think those that refuse to write pro gay marriage sentiments on cakes they offer are stupid. However I can't stand the hypocrisy of the fact that refusing to serve someone on grounds that they request you to write something you find abhorrent, is only punished when the ones being refused are gay. Freedom to refuse such a service to someone goes both ways, if you don't want to be forced to write "god hates fags" on your cake then someone else shouldn't have to write "support gay marriage" on theirs

Nope. You're not alone. She didn't break the law either. She won the case -- she was able to prove that the basis for the refusal to do the job wasn't the customer's status as a Christian (which would be illegal), but because she had a policy of not writing derogatory messages on any cake for any customer (i.e., "derogatory" cakes just weren't on her menu).

It’s the same as a Christian cakeowner refusing to make and sell a gay wedding cake. It is fine and not discrimination of gay ppl. They own the shop and can sell what they want. Is it discrimination towards Indians to have an italian restaurant only serve Italian food and not sell any Indian food?

This is a very friendly nice bakery! I am ordering my batmitzvah cake from this bakery and as of today it's been ordered I can't wait!!! Also gay marriage is not bad!!! Being gay/lesbian is OK!!!

So it's ok for a pro gay business to refuse service when their beliefs are violated but it's not ok when a christian business refuses service when their beliefs are violated. Pro Gay Businesses can run their businesses according to their beliefs and values and do business with whoever they want to or not but Christian businesses can't run their business according to their beliefs and values and they must do business with everyone there's no one they can't do business with.

Law19157 - Gay newlyweds don't ask for cakes that say "straight marriage is wrong" or "Christians are wrong." A Christian ordering a cake that says homosexuals are bad is the same as a gay person asking for a cake that says Christians are bad. If one is OK, both are OK. If one is wrong, both are wrong. I would make it for them if they came into my store--which their own prejudice would stop them from doing. Making them a cake, for pay, wouldn't make me sympathetic to their cause, any more than baking an undecorated cake for gay people makes Christians sympathetic to gay marriage. It's an exchange of a product for money, with no strings attached.

As aphauled as this baker was, so was the Christian couple who lost a law suit because they did not want to bake a cake for a gay wedding. They should both have the right to refuse service to anyone if it does not line up with their moral convictions.

Bath Crest I could agree with that if they questioned every damn customer about their feelings on abortion, divorce, swearing, masturbating, and lusting after thy neighbor's wife, but no, it's just gay issues, which leads me to believe they're just using the Bible as a useful tool for justifying pre-existing shitty opinions. It looks to me like people get really vocal about a sin they'll never be guilty of - gay love - but everything else gets a wink and a nod and a gentle turning away. (Seriously though, I would never agree to that, because I'm not a judgmental fuck and believe in minding my own business and everyone's right to be happy).

I should have the right as a US citizen to choose who I do or do not do business with. It does not matter if you agree with me and visa versa. It does not matter what the reason is. My neighbor won't speak to me because I support Republican policies. I think she is rediculous, but guess what, it is her right a free US citizen to associate with whom ever she wants. It is part of our Constitution. It's called freedom of assembly. Any other argument is just politics and political correctness.

See? This is exactly the same as jack phillips refusing to make a gay wedding cake. He is the owner of his shop and has the right to choose what types of cakes are sold. It’s not gay discrimination. And the owner of this shop refused to make and sell a cake that was saying homosexuality is wrong. That is not discrimination of Christians. It’s their shop and they can sell what they want.

People throw around the word hate so loosely. Calling "Gay marriage is wrong" hateful is seriously going overboard. All that is, is an opinion. Now if it were to say "I hate gay marriage", then yes I can see how it could be considered hateful when the word hate is actually used. Though not to play the devils advocate, but if the anti-gay activists wanted to send a stronger messages, they should've simply asked for a simple traditional marriage wedding cake. If any gay bakeries turned THAT down, then those activists would have much sturdier ground on which to cry hypocrisy against the gays. Make no mistake, I'm anti-gay as well. It's my right to not have to accept anything I don't agree with. I don't hate gays, but I don't accept homosexuality. Deal with it.

Fire Power No. The "cake" means the whole thing as ordered. It's like saying if she refuses to put any icing or toppings on it and just gives them the baked loaf she made them the cake. She would have baked it but not "finished it." All bakeries advertise the "cake" as finished product as ordered and specified.

StopFear Nope...That's what we call a load of bullshit. Everyone should have the right to the same, exact product that is presented to all. If one would like alterations to said product, it is up to the one providing the product if that will be provided. In this case it was a cake. The people ordering the cake just wanted one that was provided to everyone. No alterations. No changes. If they HAD ordered something the bakery doesn't provide on a normal basis to all, the bakery would have had a leg to stand on. For instance....Let's say they customer ordered a cake out of the case but asked the icing that is only offered by the baker in chocolate or vanilla be flavored in a berry that can only be obtained in the Antarctica once a year and the baker would have to fetch said berry. Well, in this case the baker, as it wasn't something they normally provide, could just flat out say no, but offer them chocolate or vanilla (offered to all). The baker could also accept the request. It is their choice when it comes to SPECIAL REQUEST. The event the cake will be served at is not a special request and in all actuality, none of the bakers fucking business. Now in the case of writing on a cake, the courts have ruled that ANY writing is a first amendment right. Even writing on cakes. In other words, no one can be forced to write ANYTHING they don't want to. Even bakers. So if the gay couples had requested the bakers to write on their cake, "We love gay marriage", the baker could refuse to write said message. However, they would still be required to sell the gay couple the cake in the case offered to all. That is what happened in the case of the Christian "gotcha" guy trying to entrap the gay baker. He tried to get the baker to decorate a SPECIAL ORDER cake (bible picture not offered in the case) with writing that the bakery does not offer. Double whammy....They are out the door. Come on, dude...this isn't rocket science. Get your thinking cap on.

If I ran a bakery and a customer orders a cake with an anti gay message, I would refuse to bake their cake. Then send him a message stating “The cake you requested is very hateful and strongly goes against my personal beliefs, we will refund your deposit and not bake you the custom cake that you have requested because cakes are art and we reserve the right to refuse service to anyone. You need to learn how to be respectful of others regardless of their sexual orientation even if you do not agree with it.”

Here's my stance on it. I think the "pastor" was looking for a lawsuit. Classic setup if I ever saw one. However, I would have given him the cake as he asked, verbatim... I get the whole "well it's about principles and for making a stand" argument.. Blah blah. It would not affect nor sway my feelings on the matter. People are stupid to cut themselves off from a profit. Sugar and flour is edible and will soon be eliminated in a toilet... That's the worth of the message anyway.

If she wins her case then t the baker in Colorado should have won his initially. She refused service to the Christian man because it goes against her belief/moral ethics. She was asked to bake and design that cake. She refused. Thus she is discriminating based against his religious belief.

I know the person who requested that cake. He did not ask for two gay men with an X but simply gay marriage is wrong. He wanted to test and see if they would discriminate against that just as much as the people who refused to make the gay wedding cake. It is the same thing

So a christian bakery should be forced to make a cake that supports a gay wedding but a gay bakery should not be forced to make a cake that does not support a gay wedding? Alright, let me explain something to the fundamentalist, Christian homophobes posting their comments here. You can't go to your local newspaper and demand they accept your money to run an advertisement that espouses hatred towards a group of people. They won't run it and they won't face any legal repercussions. This is entirely different from a gay couple wanting their marriage notice in the paper the same as a straight couple. If the bakery refuses to put hateful messages on a cake for ANY customer, gay, straight, black or white, they are not practicing discrimination. This is not hard.

Gabe King Let me explain something further to you. I went to that bakery today. I live in Denver and I went out of my way to buy some empanadas from this bakery just because of people like you. I went there with my wife and two young daughters because I want to support them and I want to educate my daughters not to be hate-filled people like you. The people who own this bakery are very lovely people from Peru. They are just trying to make it in this county. We had a great time, eating pastries, drinking coffee, and just being normal, good natured people. Maybe someday, you might not be so hate-filled. I don't know what's wrong with you. Your religion has made you less of a person.

Equal protection under the law. If a Christian is forced to make a cake with a message he morally disagrees with, but another baker is allowed to deny a customer for the same reason, it shows that the court is one-sided against not just Christian's, but any religion, since most major world religions condemn homosexuality as unnatural.

Show us an example of gay people asking for a cake with an anti-straight or anti-Christian message. You can't, because it hasn't happened. If you want a cake for a celebration of traditional marriage, have it say "Hooray for traditional marriage." You don't celebrate something by putting something else down. That's completely illogical.

This may or may not hold up in court. If the guy asked to have something put on there on what he was for (traditional marriage, one man/one woman marriage) it would hold up better in court if the person refused because it's for sure speech based on a personal belief about something already established as legal. Even posting a bible verse could hold up in court because it's directly taken from a religious text accepted by our society. Being a little more subtle and tactful will go a long way instead of being careless about one's agenda.

One cake is for a union between two people deeply and love and devoted to each other. The happiest moments of their lives. It is suppose to be a happy event, because believe it or not some gay couples are religious too and can go to Christian bakery's. Even if not, of all the bekerys out there they chose that one to make something so crucial to their wedding. The OTHER cake is a petty attempt to be hateful and smu about it and just to prove some stupid point that they are a jerk and can't stand love outside their narrow standards. There is no celebration or love there. Only pettiness. This Baker did the right thing. If everything wanted a anti gay cake there are plenty of anti gay bakery's out there. And let us not forget that a "poor discriminated Christian bakery" Malicously posted the HOME Address of the couple they refused to serve. Making them receive death threats and harassment! That guy was going on to start controversy and make a statement. The couple just wanted a regular plain old wedding cake. Besides, why would you wanna even eat a cake like that?? Yumm, detestable sinner flavor! Blech. One cake stands for love. The other stands for hate. She did the right thing she even offered to still make the cake and let him rewrite the hate speech on himself. Shenly refused to with a cruel message. The message on the cake belongs to the customers who are paying for it. It does not belong to the baker or the bakery, they are only providing a paid service. Therefore if they choose to run a bakery, they are not allowed to discriminate. Religious views have nothing to do with running a business. If my religion says not to wash or clean my store or be hygienic, my bakery would be shut down by health authorities. I have to obey the law, this includes anti discrimination law. I do not have a "right" to run a bakery, it is a privilege that requires a license.

Gay marriage equality is like a party previously exclusive, that is now inviting everyone to attend. If you don't like that others have been invited, then that's your problem. You are not consulted about the guest list. Nobody will miss you if you stay home in protest. That must remind you of those school dances open only to "the right kind of people". Business's should maybe list their services; such as doesn't make wedding cakes, doesn't make wedding cakes if the wedding cakes will have absolutely anything to do with a person who is gay, doesn't do cakes with religious messages, doesn't do cakes with vulgar, intolerant, bigoted, ignorant messages (that are apparently religious). Not every bakery makes cakes and not every bakery makes wedding cakes, just as not everyone is a baker or runs a bakery and knowing what type of cakes a bakery makes will let the public know which business's they are inclined to support or boycott. I think in most places in the "Western World" the anti vulgar bigoted intolerance bakery will find more success than the anti provide cakes that have absolutely anything to do with any person who happens to be gay.

If we were living in the desert and didn't have regular access to clean water etc...we might need to use some of the old practices or we might have different ones than we have now. This was the ceremonial custom of the Jews and some other cultures. Women also took ritual bath's at the end of the cycle and we know, in our modern day, that this promoted sexual activity during the time the woman is most ready to conceive. This would have been helpful to populate the earth...as God commanded. But those laws don't apply today. They also lived in tents and might have had to kill enemies or criminals since they didn't have prisons or hospitals to put them in. Fortunately, the seed of the Messiah was protected and He has come and Jesus fulfilled God's laws. So, we are now under the law of grace...if we want to be. We only need to receive Jesus as savior and follow Him. :D

Do you think I'm under an illusion that everyone is a Christian? Even though some are not, this doesn't change facts, in God's word, that we are living in a period of grace. Just because you don't believe something doesn't make it untrue. I speak from what I know and I promise you that when it comes to the bible I know more than most...but this is not salvation. Salvation comes from Jesus and His love for you. He loves you enough to die for you. He rose again to show He's God and this is fact...no matter if we believe it or not. On the day of judgement...everyone will believe the word of God...some to eternal enjoyment and some to eternal punishment. Jesus came so no one would have to suffer eternal punishment. Sadly, many have and will reject the gift of God...salvation through faith in Jesus. He's the lover of our soul. Ephesians 2:8-9 & John 3:16-19. Read the bible...it's great for the soul. :D

This is what happens when your force social change before society is ready. The gay marriage issue should have been given to the people to decide, since it's a social issue and the people are the society. If the society is ready then the vote will pass. Ireland is the only nation in the world who did it the right way. Forcing something upon people will always result in aggressive backlash and retract any advancement the cause might have made.

Its so funny how one likes to call certain Biblical scriptures in the Bible, hate speech....Unless quoting scripture in the Bible is against the law it is not a hate speech but freedom of speech combined with religious freedoms to preach the Gospel scriptures.

*@Kit Kat* I'm bisexual and could care less if people think it's wrong. Religion is stupid but people have a *right* to run their businesses in accordance to their religious beliefs. If they don't like me doing hanky-panky with other men then I'll just go somewhere else and shrug it off. Maybe I just have a thick skin.

CommissarKozlov Trust me, when people call me gay I don't take it as an insult, it's actually more of a complement. I just think that free speech is abused to justify spreading hate. I have no intention of lashing out on anyone because they disagree with me but I do think that it's a dumb waste of time trying to justify hate.
