This is a Very Common Scheme by these Deadbeats. When they owe ALOT of money they offer a Blank Check they know will bounce or the old here is my debit card and pin. Knowing the debit card won't work either

I have no idea. My rent is automatically deducted from my checking account each month. Many apartment owners encourage it. (mine even gives me a $50 monthly incentive for doing it) But my landlord doesn't have my debit card & PIN. I can think of no logical or rational reason to give a landlord your debit card & PIN. 🤔

In certain cases, landlords will need to access your bank info if tenant is unreliable or had history of non-payment, otherwise landlords will not rent to tenant as the risk is simply too high. I think this tenant had bad credit and had history of non-payment that's why this landlord requires access to her bank before agreeing to rent to her.

@@terriesmith2616 Well... Sort of. Sure, you can technically sign something from the landlord where you give them the pin information/card and the right to pull the money. But that would be very odd and honestly may not hold up in court since it violates the financial agreements with most banks/credit unions. More likely for that situation, part of the lease would be auto drafting from a bank account where they have proven to consistently hold a balance of the rent for a specific period of time with further proof that the household income is three times the rent of the apartment. I have never seen them take a tenant's ATM card and physically go to a machine.

@@JustOneSpoon True. I agree with you that's it's very rare for landlords to do that, most landlords won't even bother to rent to tenants if that was required as it's too much trouble to begin with. In this case, Judge Judy ruled in the landlord's favor as the tenant couldn't prove it was the landlord who withdraw the money. If the landlord lord did withdraw the money using a pin numbers in an ATM, it would be an easy case to have the bank produce a video of the landlord doing so. The tenant didn't even have proof of that, so it could be the tenant herself taking the money out while blaming the landlord. Who would know when there's no proof? Just go get the copy of the bank's video. Simple. But tenant didn't do that.

Yes many places say their require your banking info for direct debit only. That transaction is recorded by the bank and you would have proof of who took it. I don't6 know anyone who would give up their pin to a person they do business with. The bank doesn't even request your pin!

I have a one bedroom for 600 and I’m moving to a 2 bedroom with a dining room and bonus room for 900 with water included and a pool. Both include the washer and dryer(I think our area doesn’t have a laundry mat because every place includes one). Rent can be cheap you have to be willing to live in the middle of nowhere lol.

I have an assumption that her landlord didn’t want to look suspicious and got the 713$ instead of 750$. I believe that she did take the money from her. That’s why she didn’t ask for rent that month. Or follow up on the eviction

That's why assumptions are dismissed in court. There's no proof the landlord withdraw the money that's why JJ dismissed the plaintiff's claim.

What doesn’t make sense… what ATM allows odd increments like that? Most are in counts of $20, some in $5's, but $713? Never heard of it

If her money was taken out of an ATM, the bank would have records of which ATM and at what time. They would also have camera footage of it. Seems pretty open and shut as far as finding out who took it...

Yeah - they *_don’t have camera footage!!!!!!!!_* They lie and make you think they do. I go to a huge bank! When I called police, I was gobsmacked to learn the bloody cameras were, and still are *_never_* running! So don’t assume!

Who said anything about it being taken out of an atm? Technology has upgraded. You can do these transactions online with just a little bit of information from the cardholder. And if it were done that way, there would be no way to tell if it was done by the renter or the landlord if the landlord had all of her information already on file.

Disagree w JJ on this one. You don't have a right to charge my card without my authorization. It's theft. But it's true she can't prove it was her but if she admits she took the money without asking it's wrong. Also, it's very uncommon to serve someone with and eviction notice 3 days after the rent was late

Not true. It depends on where you live. This happened to me once where I had my rent auto-withdrawn and something went sideways on the bank side. I didn't know until there was an eviction notice on my door on the 4th day. Naturally freaked out, called the apartment office and then my bank. They said it was mandatory to post that eviction notice. Thankfully I had everything sorted within 1 hour so I never got any negative marks as a renter. This was a cheaper place so maybe they have a lot of those issues in places like that so they are quicker on the draw with eviction notices.

landlords can transfer from their phone app if it's set up that way. But landlords ALWAYS have to get permission first before just accessing your account.

I don't think the plaintiff is fully able-bodied--in some shots you can see she's seated on a stool (which is very unusual on JJ--she's a stickler for courtroom protocol).

I have been in this situation myself. My landlord tried to evict me for being only two weeks late paying my rent. The judge dismissed the case for the simple fact that my landlord accepted my rent payment. I counter sued for harassment and was won my claim. Don't let these people bully you. Remember, you are paying your hard earned money to live there.

@@mini6595 There are renters laws in the state where I live. According to the judge that was over my case, you must be a least three months behind on rent to justify an eviction. If it's less than three months the landlord can only charge you a late fee. I have lived in my apartment complex for twelve years. It's not like I'm late every month but things happen. True that a contract must be honored but an individuals legal rights must be taken into account as well.

Evictions can only be enforced if certain conditions are met, and two weeks is nowhere near the threshold of being served with an eviction. With your logic, everyone that’s ever been affected by the COVID crisis and couldn’t make payments on time should be out on the streets as well. Things happen dude, and these laws exist so people can have an opportunity to get everything in order and not immediately lose their homes.

I absolutely believe that landlord took her money. The fact that JJ doesn't understand landlords and their mentality goes to show her place of privilege. The landlord is a crook. I can tell that by just looking at her.

So if she withdrew it from an ATM, there are photos and video taken from anyone using the ATM. She doesn’t have a police report or subpoena to prove the landlord did it. She’s out here giving her PIN number to about everybody, but she can’t prove where the money went? My point is, there’s cameras everywhere and she doesn’t actually have credible evidence to prove who took it from the account?

You can't fumble over words with Judge Judy. The only people she is patient with in the courtroom are children.

Bad call JJ! 💯 percent guaranteed the defendant stole this poor woman’s money just to get her out! It makes absolute sense to withdraw an off number _round about_ $700. Otherwise it would have connected the dots more easily. JJ made a huge mistake on this case. But God was watching and what goes around, eventually comes around! She’ll get hers one day!

I don't think she did. The plaintiff said she gave an ATM card. Not a debit card. That means the defendant would've had to go in person to an ATM or bank since ATM cards do not process payments online. If she went to the teller she would have had to shown ID. If she went to the ATM she would not have been able to pull $713 (even extended bill ATMs only give as small as 5 dollar bills.) On top of that, even if she did pull the money out; releasing your pin gives authorization for someone to access that account and she admitted that she freely gave the pin and not that it was stolen. (It's also a breech of contract with your bank to release that pin.) I don't think the defendant did... but even if she took the money, she can't be held accountable legally based on what the plaintiff gave.

@@JustOneSpoon If you go to an ATM that is not within network you can definitely be charged a fee of $3 and get bills a low as 10. Which means $713 could have been withdrawn off her account

@@Kiarra1983 That's true. I did also mishear her and she did in fact say debit card. But if it was online does she not have the statement saying who took it or who it was sent to? It would say paypal or a company name or SOMETING. If it was done at an ATM your bank can find out what ATM and like 99% have cameras nowadays and if it is pulling out a 10 dollar bill it's definitely one at a bank. - Also it looks like Chase ATMS can dispense even down to change... but they would also have a camera.

And supposedly plaintiff gave her her ATM card in September to withdrawal the rent. Her money was missing in November. What did plaintiff do let landlord keep her ATM card till November?

Only thing I can think of is if work or transportation didn’t allow for her to do that in time that the landlord needed it. As weird as it sounds, if I were to trust anyone to have access to that it would be my landlords. My entire safety, security, belongings, home, etc is in their hands as is, and you would never expect them to rob you considering they depend on your payments as income. I’m sure this lady just assumed that if anything were to happen it would be easy to prove. Poor girl :/

Do people think letting property is a hobby or something? It’s a legitimate business with relatively small margins if you don’t own a lot of other properties. This lady owns a 6 unit building and almost certainly relies on the rent to cover her mortgage payments on the it - if the tenants don’t pay, you don’t pay. What is hard to understand about that?

No one letting property is a hobby. It is called a rental and is a business. What happened is the tenets sign a document letting the landlord access to her bank account to be able to get rent. The plaintiff did not understand that happens all the time, not theft.

@@trekgirl65 I haven’t watched the second part but I’m happy to keep with your thinking on the fact the tenants behaviour might not be deemed “theft” but only at a level of meaning… Thus far we have breach of contract on the defendants part…. Had the landlord taken a business mentality to her rentals then her choice to move toward eviction is wholly appropriate and coming to court to regain the short fall is entirely appropriate given that paradigm

“She always calls when I’m late”. Why did she think that was important to note? Your landlord shouldn’t have to be a collection agency and harass you for money. You’re an adult! You shouldn’t be entitled to a reminder to pay your rent. Pay your dang bills on time!

The landlords in my area are generous this one gives 5 days and usually more of the 5 falls on a weekend and the new one I’m moving to gives to the 9th(though I think that’s him being lazy, I guess he figures most will get it together by the 9th).

Not much informationto go on there. Could be a monthly checkup from a considerate landlord to see if everything is OK. Could be a rude landlord invading your privacy.

@@tomround8271 ok well she lives above me I pay $2500 a month for a basement… she has a 2 year old baby’s that screams at mostly 6am she comes down once a month just too look the basement. quiet time starts at 8am ends at 8pm for her baby…she vacuums at 7am. We have told her there is a pipe that creates a lot of condensation in the bathroom so it smells of wet towels in there 🤢. There’s ur info lol

Like I've said that most government agencies are dealing with outdated computers and old systems. Doing an overhaul is not only costly but can cause interruptions of services. And to add to that workers r experiencing case over loads. God bless them for the work they do.🤯😇

The system where you give your account details and they can make withdrawals is bizarre. Here in Australia to make that happen it requires a contract and is reserved for particular registered businesses.

The ATM machine cannot tell the difference who is withdrawing. All you need is the card and the PIN.

@@wintercomesearly I was referring to direct withdrawals from the account using the bank account details. We don’t need to protect our account details so much because it’s not possible to withdraw money that easily.

There are scammers who steal credit card information. Happened to a family member. Apparently the scammers had done some rigging with the atm, so it read card info and registered pin used.

I’m thinking was it an electronic debit?….Not an actual ATM withdrawal.. I definitely feel like the landlord lady stole that money… that stupid little smirk on her face said it all…The plaintiff didn’t know how to articulate her case and The minute judge Judy heard her fumbling over her words it was over for her… Periodttt!

@@mexyo539 she never asked about proof. Lol. She just said never happened. All I’m saying is go to a court where they aren’t going to make an opinion because they are on tv and it sells. Plus a lawyer can defend you when a judge gets out of line. I’ve had a family member force a court to change judges because they spoke like Judy does, thus the argument was perceived bias, thus not a fair trial.

Doesn't most ATM's have security cameras on them? Why doesn't the plantiff report the defendant to the police if she suspects that it's the defendant? It can easily be checked out if the money were taken out of an ATM machine.

could've filed a claim with the bank, and the bank would've immediately put the $713 back in the account as a temporary credit while they investigated. then she should've paid the rent, called the police, and sued.

Not saying she stole it, but Judy should see why it would be obvious she wouldn't just take the full 750 if she had been the thief: it would've overtly implicated her. There's a person who's getting 750 rent, who also happens to be the only (known) person who had access to the account and information, and then 750 goes missing from the account? Gee, I wonder who could be a suspect? Also, how were the fraud people unable to trace who took the money/where it went? It couldn't be from an ATM since you can't take an odd figure like 713 out of one. Even if it somehow was, almost all ATMs have some sort of surveillance.

Dixie - I agree. I’ve been an investigative researcher and writer for 38 years and can usually smell the truth. It makes absolute sense to withdraw about that amount, except make it an off odd number. So I personally believe the plaintiff wouldn’t have gone through all this to just make shit up. I believe this despicable landlord stole it. Also I was robbed at a major bank and to my shock found out that the ABM camera wasn’t functional or recording, and it _still_ hasn’t been over 6 years later.

explain how one can withdraw $713 from the ATM? which ATM gives out lower than 5's? it would have to be $720 or perhaps $715 (unlikely) for this to be believeable. Furtheremore, if there is an unauthorized wihdrawal, smart people alert the bank and they investigate WHO was at the ATM. Banks have cameras. She came with no evidence of an investigation.

@@CarolineWolterHall BUT where can you withdraw $713? even if there is not a working camera, if one reports that there has been an unauthorized withdrawal, most banks investigate. She didn't come with any evidence of an investigation which is very curious.

@@thesb2836 There are too many answers for that. Maybe the amount was $710, which is possible. She couldn’t prove it, because the defendant had her card. Maybe she transferred it. Maybe she went directly in to the teller.

She said she made racist comments she didn't straight up say she's racist. Clearly if she's making racist comments she would be racist and I'd hate to break it to everybody who's arguing about it but you can be racist and not realize it. You can be racist and have racist ideas or say racist things and still rent to someone of color. The fact that everyone's jumping on that one comment she made at the end of the video is weird to me there's no reason not to believe that there's a chance that woman was racist towards her. Maybe she wasn't but there's no reason to totally discount the fact that she may have said something like that. It sounds like she knew that the plaintiff was in trouble when she rented her the place. She was living in a car with her child. If she really wanted to be of help maybe she wouldnt jump them the minute the rent was late to evict them. Maybe she would have offered alternatives. It's just weird to take someone in off the street living in a car and I expect that everything's going to be hunky-dory right away and say you're helping them.

This is a huge problem, When you’re renting an apartment..it’s business because money transactions and documents are signed between parties. We all have uncertainties yes, but when you’re late regardless to how it’s being “funded” , it affects your credit once you’re ready to purchase your own home. Uh, why would this “tenant” give her “landlord” her personal debit card and pin for her to withdraw from an ATM, where the heck was she during this withdrawal. I would have done my homework prior to coming to court to prove her thievery..photo/surveillance cameras of the location the transaction took place..Judy, she’s tough..if you don’t walk in with “clean hands” and documentation/proof, it’s just a mere allegation to her.

I know this is a short clip, but so many things don’t add up. 1. Why did she STILL have the ATM card? Forget why you gave it to her in the 1st place 2. You can’t take $*13 out of an ATM, it’s increments of $20, some CU’s $5. 3. Why bring your kid? Just something I never understand… unless they are a legit be necessary witness, put them in the audience if they want to see the show.

The landlord would not be able to take money from the account unless they had the debit card with them and physically went to an atmosphere to pull money, in which case there are security cameras for. So this is an obvious lie.
