Today we are joined by @BareBritainAudits as we take a look at Exallot Ltd, Patent Dr, Wednesbury WS10 7XD.
We are shocked at the large goods being stored on the public footpath so we start filming. We take a look into the yard to work out what they do and then speak to staff about the issues found.
Obstruction of the Highway and using a Works Truck on the Public Highway without a Number Plate.

Quote taken from a fork lift supplier: If your forklift is travelling less than 1000 yards in one go, it still needs to be registered and licensed. It will fall under the category of ‘work trucks’ if it is using public roads for passing between premises/sites in distances under 1000 yards, delivering goods between private premises in distances under 1000 yards, or if it’s working on roadworks. Any distance below 1000 yards, and you may be excused from the Road Vehicles (Construction and Use) Regulations, meaning that fewer modifications might be needed - but the vehicle must still must be insured and registered. There are other suppliers stating the same.

@@georgesemple8136 The vehicle is not legal if it is not displaying a license plate, also the driver MUST hold a driving license in order to drive on the road. Without either of these the driver is driving illegally. What i am more concerned about is the driver himself who is currently on license from prison and could be recalled for breaking the law.

if they kept the yard a bit tidier they wouldnt need to use outside!! If you google map the postcode it shows them using the paths on both sides of the road to store/unload goods using the unregistered forklift on the road

Forklift definitely breaking the law with no DVLA registration, the driver is the culpable person. Looks like a couple of bits of box section being used as fork extensions, also totally illegal, they need a test certificate. Notice also that there are no safety pins to lock them onto the actual tines of the machine. The operator of the forks should be wearing the safety restraint (seatbelt) All that stuff on the pavement is a big no no. Imagine if a gust of wind picked one of those items up and it ended up colliding with a pedestrian or a vehicle ??? Looks like a tinpot operation going on here that needs a visit from the HSE pronto. Goodness knows what things are like inside the building with fibreglass being used. i shudder to think. I bet that the HSE would shut this business down with immediate effect.

A safety restraint is not needed on a forklift although if it is fitted must be used. So technically if there is no seat belt on the forklift he is fine to operate it without wearing one it’s only if one is fitted he must wear it. And if your operating under a 1000 yards on the road you do not need to have it license or registered with the DVLA with the size of fork lift he was using. The only thing he did wrong was store something on a public footpath.

DJ I love this style of auditing by giving them 30 days to put right any wrong doings. If after 30 days the goods are still being stored/advertised on the public highway can you report it as fly tipping on the app you showed us at the end of a previous video or would it come under a different category?

If I find that stuff on the roadside. Not only is it not covered by the business' insurance. It is also safe to assume it has been abandoned and so taking it is not theft.

A lot of them fake chimneys etc are used on the sites I plaster. Lot of them are brick slips stuck on. Same with lintels over windows.

@@andrewthorne9034 yer they are moulded mostly in fibreglass and the brick slips are fixed on them and pointed up like normal brickwork. They have metal fixings for the crane to lift onto the roof and fixings to fix them to the roof.

Some items were jutting out into the road presenting hazards for cyclists especially, also they were not fully monitoring their stock and increasing the likelihood of theft? They did not seem to care about the likelihood of dog poo etc on the products they produce, not worrying about the workmen either who have to handle and install the product. They did not seem to have any pride and respect for what they manufacture or process at all. Also pretty odd that this was not officially complained about before and the Police had not ever driven past whilst the truck was using the road. I did notice the truck driver did block the lane by leaving his truck to straighten a dormer, strange that the hazard warning lights went off too when he left it parked that way. Not even a warning for the public for a trip hazard. It is probably the case that it is cheaper and less stressful to be told of these issues, than to face the implications of fines and officialdom raining down on them?

The boss handled that perfectly, and only asked for written confirmation of the alleged offence so he could understand and properly address the accusation. DJ misrepresented himself in an attempt to give the impression that he was in a position to enforce his accusations, and DJ knows this, which is why he didn't hang around, hence only a 10 minute video. Disappointingly, this time its DJ - 0, Boss - 1 from me. Just to be clear, I'm not arguing that the company were right to store goods on public land, but the interaction from the company after DJ made his point (from an imaginary position of authority) was perfectly reasonable. I'm disappointed that as the number of subscribers has grown, the integrity which brought me here in the first place, has dwindled...hey ho. Plenty more channels on the tube, eh...

My only issue is that DJ tried to give the impression that he WAS someone with the power to bring consequences to bear if his recommendations were not followed in a timely manner. The boss quite reasonably wanted more details of the alleged offence, as would anyone, so they can check to see if there really is an offence, or whether it's just some Karen with an ego, who can obviously be ignored.

Have get in touch with me dj..I know a garage the uses the public highway as an extension to their car park..leaves sale cars outside on the road..the people who live on the road are sick to death of it..we had an agreement that all were moved at night so residents could park, but that was soon forgotten. They don’t seem to really care..an audit would be really good lol..get in touch and I’ll tell you where and which big name garage it is. 👍🏻😁

What a shoddy operation! I use to be a manger of an operational work unit within local government and most of my time was spent at a keyboard of a computer or on the phone. I did however, wear a high visibility vest because as soon as I stepped outside I was in an area where it was required (just like this pkace).

It would be better to keep them inside or covered.

They are a nice bunch, very respectful and only wanted to know more. I am wondering if they managed to get a large contract and are desperately trying to fulfil it. Excellent and good for them if that is the case. True they shouldn't really be having products on the pavements but I think they will move them. I am not one for too much red tape so a little forklift on the road for less than a minute I would waver. Could also be that the items are due to be picked up or moved across the road. Could be worse and because they were decent, let them off ! 🤭🤗

I presumed the stock was being out on the footpath for loading into a truck. I worked for a business day here we did this, BUT we put out safety cones and had a lad stand and watch. The managers defensiveness was unnecessary. I’m not based in the UK. Different countries, different laws.

Hi DJ,, hope your canny,,I'm fine thanks,,done some research on the building,, apparently Des O'Connor worked here as a boy ,, what a workie ticket he was,, according to my sister's uncle,,Des as he said,,was a right pest ,,always smiling,,always telling jokes,,always making people feel good,he was forever happy ,doing a great job also,,the problem is when he started singing in the toilets,,at the top of voice,,any way ,,this went on for 2 year's,, anyway the boss you were talking to at the gates,and his mates grabbed ahold of Des and took him down to the river,,and threw him in at the deep end,,Des went to the bottom but managed to swim back to the surface,,Des popped his head into the fresh air,,, And shouted at the top of his voice,,,, SOME DAY IM GOING TO MAKE A RECORD! all the lads laughed and left,DES all alone and feeling blue,,if only they knew! True story.

Is the footpath/pavement part of the highway? I don't think so but what do I know.

In the UK, it definitely is. It includes the entire width up to the boundary of adjacent private properties and includes any grass verges too. A Highway is an area of land which the public at large have the absolute right to use to 'Pass and Repass without let or. hindrance'. That is a much broader definition than road. Many people think the two are synonymous which is not the case.

At 0:51 that pile of whatever it is (with free access to the public) doesn't look secure. In fact, looks very dangerous. Can you imagine a child trying to clamber up the front and pulls the top one down resulting in serious injury or death? Needs a call to the local authority or The Health & Safety Executive pronto.
