The Scenario
You want to do your own #expungement and save some money? You're not sure what to do, where to start and how to fill out the paperwork and get your court conviction dates stay tuned. I'm going to walk you through this tutorial.
The Forms
If you're doing your own expungement in #California, you'll need to start out with the CR 180 and CR 181 We'll go to www.courts.ca.gov. Look at the categories. We will select criminal forms. After you download those forms, we'll open it up and start filling it out.
If it’s a #DUI then the vehicle Code Section is 23152a/b
If it's a DUI it's 23152 A and B vehicle code. This video assumes that you were on DUI probation for three years. You completed probation with no violations. So if that's the case and you don't have to worry about other things.
Print out 3 Copies.
You leave to the court to fill out. Once you print this out, you print three copies of each. You make three sets, then you'll take to court. You have to serve the da and filed the paperwork with the courts, depending on your courthouse.
Court procedures
Some courthouses will require you to serve the DA's office. Other courthouses will just take it from you and then serve the DA's office. Or it's also differ on whether or not they require you to show up, or the judges do this in chambers. Then have you show up if it's denied other judges just straight out, deny it without giving you any kind of notice. Also other judges who will bring you in and have you explain your circumstances to justify the 1203.4 dismissal.
Make sure you Completed Everything!
In addition, when you do this, you need to check whether or not you've completed probation all the way. And most importantly, whether or not you've finished off all your commitments, I've seen people do this without completing the Caltrans or their classes. They didn't complete the MADD commitments. They come in, they have a warrant for them when they come in thinking that they're good with the expungements, but all of a sudden they find out they have a probation violation. So it's important that you make sure you're off probation.
If Orange County the you Can use Occourts.org to look up your case Number.
If you're in orange County and you don't have your case number, you can use the case index search at OCcourts.org to look up the case number. However, if you have your case number and for one reason or another, you don't have your date you can use occourts.org to look it up. You can do a case, access search, check out the video on that. From there, you'll be able to get your conviction date and any kind of scheduled hearings that you have in the future.
Double Warning Make sure you completed everything
The one thing I have to warn you though, as if you have not paid off all your fines, or you have some outstanding hours of community service or Caltrans, chances are your expungement will be denied and you may have a warrant out for your arrest as well. The other thing you have to be aware of is any kind of probation violations. That's going to throw a wrench into your expungement as well. If you do have any of those situations then you should consult a professional, because the last thing you want to do is walk in there only to find out that you have a warrant for your arrest.
Once you fill it out, you have to pay $150 falling fee on top of that. You will have to fall it one at the DA's office and one with the court.
