Want to make a last will and testament quickly?
Well, most people who want and need to put their estate legal affairs in order need to see an estate planning attorney. Estate planning is complicated and most people have at least one unique circumstance that requires assistance from an estate planning attorney.
But it's possible, if you live in or in another state that permits olographic wills, to make a will in just a few short minutes.
Now I hope that people with unique family circumstances, or people with significant assets at stake, all realize they must see an estate planning attorney to put their own estate legal program in order.
But there is a group of folks out there who, either because they are cheap, broke, a do-it-yourselfer, or for some other reason, refuse to go to an attorney to get their legal affairs in order.
Virtually all lawyers say that you should never sign any estate planning document without going through a law firm. I think one of the reasons lawyers say that is because it is self-serving. Now, I do acknowledge that some of the "create your own will" websites and software out there is 100% junk, and you shouldn't touch it with a ten foot pole, much less your ink pen.
But for a simple scenario, where you can get excellent written and video instruction, there may be a circumstance out there where someone who refuses to see a lawyer to get legal affairs in order, can be instructed to put a simple, effective, estate legal plan in place. What are your thoughts?

Paul, just saw your video. As a retired CPA with a long background in estate/tax planning, I find your common sense approach to estate planning both highly informative and refreshing. If you have done so already, I strongly encourage you to develop a portfolio of forms and instructions that the average person could read, evaluate, and adapt to their own situation. Your explanations and everyday language is the best I’ve heard for a normally intimidating subject. Good job...

What if you have property in a foreign country, is the will valid in the foreign country or do you need another will valid in the foreign country?

@@heidiceleridad7346 I have written my own will a number of times. When circumstances changed and I always got it notarized just in case. I also had a witness present at the time I had it done. I also included that this will dated ??? renders all previous wills null and void.

each state is different. make sure this will will be valid in your state. this doesn't quite work in Illinois.

Fact is, you weren’t required to chime in and assume that about someone who obviously by their own admission is facing some struggles. What good came of this? Your own superiority ego boost? We will definitely being agreeing to disagree especially on belief in The One True God of All. Including you and I. Jesus is The Way, The Truth and The Life and one day very soon every knee will bow and every tongue confess that He is God. There is much evidence of Him. Take a breath. Evidence. Sun shining on your face? Evidence. So many historical facts and prophetic happening written thousands of years ago coming to fruition right before your every eyes and yet, you are hardening your heart to the one who created and loves you the most! Thank you so much. This is the family I have, 2 kids. I will copy your will Verbatim. My husband just passed away without a will. I thought when he was ill, he didn't need one because our bank accounts are joint, our house is under both our names. We didn't think about his vehicle which is under his name only. We were busy with his treatment and one of his wishes is not to sell the vehicle. When he passed away, I thought changing ownership during registration won't be a problem since I only needed to show the death certificate, that was what I thought. One of the registries (I am in Canada) denied my request and said I needed a will. That was when the problem started to really stress me out. Now I am going to make my own Will so that my children won't have the same problem when it's time for me to go. Thank you so much! I really appreciate your help and your unselfishness. Written will is accepted here in Alberta.

On several occasions, we've held free public seminars to give overviews to those who need a will, but would never seek one because of the cost. Getting an attorney is dependent on the level of assets and the complications of your Career and life. The vast majority who live paycheck to pay check don't need an attorney and this attorney is serving a great example of what an attorney should be! Congrats !!!!

My father is 92 yrs. old and he said he never made out a will so the other day we sat down and wrote out a will pretty close to what you just did. He can't hardly write anymore so he told me what to put down. It is just me and him and he said he wanted me to have everything. The house his old car and what little he has in his bank account. We did go to the bank and signed papers so I could have access to his checking and savings account so I could write checks to pay his bills because he could not do that anymore. I have been his caregiver for the last 6 years. Here in Texas we don't know if it's legal to do so but we did it anyway just in case and we both signed it. I as a witness. I also sent the original will to myself via Certified Mail. I also sent a copy to my kids via Certified Mail with my address, I wrote on the back of each envelope To be opened by the court if need be then taped over it. I also have another copy so they can read it as well. I was more extensive in my will including not only my personal property but all of my copyrights and licensing agreements, etc. In Cali we have the same thing, a written will is admissible. I actually like this because it is my very own handwriting which can be compared to my writing in my journals. I do enjoy your video and saved it because there was helpful information I can use in the future if need be, saved it. Blessings to you. Amen.

Paul, I am sooo grateful to hear your explanation of simple written wills. I am in the process of writing a 'self proving' will and get it notarized with 2 witnesses. I am one of the ones who Absolutely Refuses to pay a lawyer thousands for Simple issues. Done that...but No More. My children have passed away, and one was special needs. I rent an apt. now and only have listed beneficiaries for monetary issues (ie, IRA, mutual funds etc.). I even went for 'free consultations from lawyers....sure IF you go with Them, Only is it free. Can't thank you enough for confirming my belief in 'doing it yourself'. You're really a confidence booster!

Thank you so much, Paul. I have been very sick for about the past 8 months and today I am going into hospital for surgery and I don't want to sound 'crazy' but all I can say is that I just do not have a good feeling about this. When you are so sick and weak, you just don't have the energy to move. So last night while tossing & turning, I started to panic and quickly looked up holograph wills. If things go well today you can bet that I'll be seeing a professional because I also need POAs. As I am doing this on an emergency basis, it does give me peace of mind knowing that everyone is taken care of. Thanks again, Paul

Paul, I think a PDF form to follow is a great idea! I am single on a small pension here in California. I have two properties along with some tools and equipment that I would like to leave to my neighbors. I pretty much live paycheck-to-paycheck, so there isn’t anything complicated financially. It seems to me that my estate is pretty much straight forward, and I can’t see why I need to spend over $1000 just to get my property transferred over upon my death.

Look into TOD (Transfer On Death) or Lady Bird Deed it remains your property until death, then TOD or Lady Bird Deed becomes valid. No need for probate court. Needs to be witnessed by 2 people not related to you. Then notarized and filed at county clerks. Type or hand write listing the tools and contents of house and outbuildings as he described in this video. Have 2 people unrelated witness with signature and date it. Then ALL has to be notorized at county clerks offices. And filed.

Start a trust, put your assets in it including real estate, bank acc, personal property ect. Start a whole life insurance policy put it in the trust. Borrow from the policy get more real estate sell it pay back the policy, do that over and over create passive income add it all to the trust and control who the trust goes to when you pass and how it’s distributed and when. If you do it right you can create generational wealth and avoid probate after death and taxes during the process.

My husband and I went to and attorney in the Fall of 2019, she charged us $200.00 for an office visit. Collected information, stated she would get back with us, the Pandemic happened, and we never heard back from her. Everything was so complicated when she explained everything. Thank you for making this video. Some of my friends have been meaning to make a will but haven't gotten around to it. They have desires that would not be met intestate. So learning how to make a will in handwriting is so helpful. Being from California, it's another state that allows handwritten Wills. California offers an online will, however it requires Witnesses which can't be brought together during our current situation.

A Farmer in Saskatchewan was trapped under his tractor. He wrote his will on the mudguard before he passed. It held up as a holographic will.

I'm in California and a single friend of mine had only a home And personal possessions....I told her to write a will on paper. She said she wanted her niece to have it all. Never wrote it down. Passed away and niece got nothing....friends cousin whom she didn't like got it all. County officer said if she had written something it would have helped 😁

A friend died suddenly in January, in Texas, with no will. She had a farm and animals to deal with. Her husband had died in November. She had a son and daughter who had predeceased her, but did have a grand-daughter. A nephew and his wife took over handling things, as they were the only ones close by and had helped her over the last few years. My friend had not spoken to her son in 18 years, and yet, he will get half the estate. He flew in from Washington state for the funeral and then left. The nephew and his wife get nothing. Took 2 months, but finally got her named as administrator of the estate, so animals could be dispersed. But meantime, they had to be fed and cared for.

In the novel "Uncle Tom's Cabin" Tom's owner at the moment is afraid that if he writes a will, he will immediately die. That used to be a rare, but real, superstition. His sister had been visiting and had been very concerned for one little slave girl named "Topsy". She insisted her brother write out that "Topsy" would belong to the sister when bro died. When the brother died, everything else (and all slaves) were just sold to just anyone to pay off brother's debts. The "Topsy" character in the novel is the source of the phrase "I just growed" for a child utterly uncared for. It's often applied to situations that just happen without planning, everything topsy turvy.

Do your will now if you haven’t already. Pull it out and re-read it every time someone is born, dies, marries, or divorces (you may want to make a change). In California, a holographic will doesn’t even need to be witnessed, just clear and in the testator’s (dead guy) handwriting, signed and dated.

What would be great is a checklist that one could check off to figure out if a simple will is enough, or an estate will type would be a better choice. Also information on contesting wills, I heard you have to mention immediate family in your wills so they cant contest a will. Just a thought but the check list would be a great idea for young families just starting out and deciding on a will for the first time.

Thank you Paul for your educational videos and real-life examples which makes it easier to understand the complex concept of creating a trust. I absolutely appreciate and support your suggestion to provide forms and drafts to your viewers so they can at least consider drafting their own will if their situation is simple enough to use your material. I believe one of the main reasons for a lot of people do not to have a will or trust is the cost of an attorney and also not understanding the complex legal language spoken by many attorneys which is time-consuming and expensive. Definitely interested in a form will with video instructions. As a single 58 year old mom with 2 adult kids, I just have a home and a car that I don’t want the state taking possession of. Covid 19 has put writing a will and/or trust on my mind and I’d really like to get it done soon at a reasonable price. A few years ago an attorney quoted me $3300 and he would not budge on the price. This video is very easy to follow. A website is a great idea! Adding to what you just demonstrated with a number of common variations (but not too involved) would be useful. Also, a list of states that allow holographic wills. Links on unfamiliar & legal terms for definitions would also be helpful, like a popup when clicking on the word or a glossary page.

Illinois is holographic will state. Just get 2 witnesses to sign it, and have the executor take the will to probate court to register it.

I spent a life time being called " Poncho , Chico etc.name which are actually pretty names, but used in the wrong contexts can be offensive ,and nobody said anything in my/ our defense. I had many of fights with Anglos because of it , but once an anglo finally meets there match they now what to create law against it. I just want to say one thing " Welcome to my world!!"! Ese!
