Hi Ksenya! Thank you so much for this video! I almost send our case to NVC even though my daughter’s income requirements were’t met. It’s so frustrating to wait for so many years, but I agree it’s worth to be more prepared. We’ve paid all fees and I was concerned they would expire, so glad to know that we’ll have another year or so to file our case more properly! God bless you😊

She is in the States and I am in Canada - we're not seeing anything about income requirements in the initial I-130 application, when does that come into play? Is that after the Petition for an Alien Relative gets approved?

That's why I'm not rushing to mail all the applications too quickly even though I already have my marriage certificate. I thought I had to submit documents before my wife's J1 visa expires but I learned that I can still submit everything if she overstays her visa. So now I'm building a strong portfolio of bona fide marriage evidence to support my petition and feel that will take a few months having to show both of our matching names and address on license/passports, converting banks to joint accounts, and our domestic traveling with family/friends to have as more solid proof.

Hi! Thank you so much for all this information!! You are wonderful! Two years ago I watched your videos and it help me so much with my husband’s and my process in becoming permanent residents. We been legal residents for a year now. We have a son that is attending college here in the US for the past year, and we would like to know how could we help him to become a resident himself? He is 23 years old and unmarried. What are the forms that we need to fill out? We are both retired and our only income comes from our home country. In that case do we need to fill our taxes for his process? What about if our income isn’t enough to sponsor him? Could we have a co-sponsor? Again, thank you so much for all the helpful advices. The Evidence of Financial Report requirements differ from INSIDE the US (Adjustment of Status) vs NVC to foreign Consulate. Yes, if Inside US they only care about last couple yrs tax returns (and will usually avg them.) If a Native country consulate however, the tend to care more about current Income (but you still need to provide tax returns. TIP: BE SURE to check the CURRENT YEAR 125% Poverty Level and BE SURE to be a min of 135%. If too close to 125%, they will assume you manipulated the numbers.

If you don't file taxes you need to get a sponsor somebody that makes money that is willing to say that if your mother ever ask for financial aid from the government they will be the ones providing it for her not the government.

Hi Kseniya, I'm really stressed now! My wife and I just responded to an RFE regarding i864. I never submitted my W2s to support my 2022 return, so we figured the rfe was for this. I've submitted 6 months worth of paystubs making my current pay rate which is well above requirements but all my returns for 3 years was part time work during college... will this be rejected?

You need a co-sponsor for that, which means another US citizen or PR. You will then file the "Affidavit of Support" form.

I got married a month ago with a USA citizen, we have been together for 5years, I have J1 student visa and we just send online the I130. however, we are getting all the documents to support form I485, but its going to take a couple of months, so can I stop going to the school and overstay whiteout affecting my case in a bad way??

Visa overstay is forgiven for immediate relatives of US citizens. But each case is different. For example, consider the 90-day rule.

When filing your i-485 form you also file your affidavit of support and other required forms. Then you mail everything together to USCIS.

No. They can’t be your joint sponsors or household members because they cannot consent to it. Also SSI doesn’t count as income

Your case will be closed if you don’t log in to the portal and are inactive for a year.

I did all my application with my maiden name, I am about to go to my biometrics today. Does anybody know if I can go in there and give my new name (my husbands) of did I have to do that since the beginning. I havent been able to change it yet because I don't have a valid ID. I want to know if it's possible to change it today in my biometrics so I can get my EAD and green card with my new name? because I know they will send a new SSN. which I already have one with my maiden name but it doesnt have authorization to work.

Hi Ksenya, My situation is this, I am a US citizen, my girlfriend is from Thailand and our daughter born earlier this year is also a US citizen via the Born abroad petition. Is it possible to use the Petition I-130 for Parent? The goal is for Mom and my daughter to travel freely on occation for visits with me. Denied on the tourist Visa because we have a child, they wouldnt even hear it. Thanks

@@okita273 it appears to be fine. I resubmitted before I get the rejection notice, so I did not have the green sheet by that time. It might have helped that I resubmitted within 1 day of my initial application!

One question: if sponsor made $10k AGI in 2019, $30k AGI 2020 and $$40k AGI in 2021, is it enough to fulfill requirements? (Even though 2019 AIG wasn't above poverty line)?

You only NEED to upload the MOST RECENT 1 year tax information. If you make enough last year, then you're fine.
