Musk is smart. Notice the timing. Twitter quarterly reports come out on Thursday. Twitter stock was hovering around 33 a share before musk bought into it for 9.2 raising the share price. He offer would make the share holders money. Twitter isn't doing well in terms of their earnings, and all indicators show another earnings failure on Thursday. So by not taking Musk's offer ahead of a dismal quarterly report the board already knows, means they would have had to contend to massive lawsuits for Twitter causing a massive drop in their stock by not taking the offer, Musk selling his shares bringing the price down even more and then failing on earnings. Twitter would have been a 19 dollar stock, or lower by Friday of this week. To which Musk would still come in and buy up the company on a massive discount. Twitter had no options other than to take the offer. Had Musk not bought it, the Thursday earnings would have pushed the stock to the mid 20's, and without a doubt the CEO would have been fired. He alone has brought the stock from mid 50s to low 30's.
