You're absolutely right about the Phoenix, folk. Aaron, like Bendis before him, has had no regard for continuity with his Avengers run. I get that retains come part and parcel with doing big stories, his haven't felt earned however.

my theory is that whoever this avenger prime is, it is either someone who has taken that name/mantel or a case where a scenario unfolded that required it to be formed like it did last time but in a more permanent capacity

I just realized, if this Dark Phoenix is the mother of this Thor and we are dealing with Time travel, What if this Berserker Thor is from a timeline where the Phoenix and Odin did have a kid and stay together? I think that would explain it since the branch universe theory is based in decisions made and a million years ago is a long time enough for another universe in the Multiverse to be as old as 616.
