Canadian Pacific 9768, HLCX 7193 northbound at mile 74 of the Mactier subdivision in Craighurst pulling a short train of mixed freight (140 axles) (16MAR2011).
This is the second time that this so far unnamed conductor has reported a "trespasser" for fouling the mainline. As you can see by the video, the gate drops between the camera and the train, which is ABSOLUTE PROOF that the camera and operator were outside the gate and not foul of the mainline. The conductor's real issue has nothing to do with fouling. He should realize that I was on PUBLIC property and it is 100% legal to video tape or photograph ANYTHING. Call the CP Police if you must, tell them your LIES and they will tell you the same thing. Unlike you, the CP Police that I have talked to seemed to have NO issues with railfans.
You say I am short, yet you describe me as 5' 10"? I am taller than that. And you say I am there every day? Check my videos; I am not. You say I am trespassing, yet you say I am on the road. Like to stretch the truth much?
I will be sure to be well within my legal rights when they decide to swoop down on me. I wasn't looking for any of this drama. If you had a concern or didn't want your face on video, you could have just messaged me. Thanks a fuck load.

Not a violation, lights may be dimmed through crossings as long as the train doesnt exceed 20 MPH.

Probably not. Lots of guys turn them on just before the crossing, and off immediately afterward.

What a cry baby but this is what our world has come to. Seems to me one would appreciate those who appreciate what they do. I was a lineman and often had people taking pictures and video of me doing my job. I was flattered that someone gave a damn. Most don't, it made me feel good that I was being watched and appreciated for the job I did. Guess I am cut from a different cloth than these cry babies today. Thanks, Jay appreciate the video because I have always liked trains and enjoy watching all these video's. As for the crybaby get over yourself and be thankful someone appreciates you and your job.

WOW...a tad Uptight. This guy had EVERY RIGHT to be where he was. That Conductor should be Arrested for False Report of an Incident. He's on Public Land. CSX Crews actually offer us water when it's hot and we are Rail Fanning.

"False Report"? No, this conductor shouldn't just be arrested, he should also be FIRED for lying!! JayJr2007 was WELL within his rights to film whatever he wants from public property so long as it doesn't pose a security threat and as this video clearly showed, it wasn't.

A million years ago at YSU I took an Astronomy class. There was a group of 5 men and women who also took the course. They huddled together in the hallway before the class before the prof came and unlocked the door. The one guy would always give people the evil eye as they walked by. Always with the look. One day I was driving home and there 'evil eye' was in uniform driving a cop car. Okay I says to myself that explains it, he's a cop. Well no. A while later the Youngstown Vindicator ran a front page story how a theft ring was broken and arrests had been made. The arrested pictures were there too. Guess who the ring leader was. Ol' Evil Eye himself. Seems they'd break into stereo shops and fill up their trunks of their squad cars.

Rick Saffery I wouldn't go that far. Railroads today leave ZERO room for drug and alcohol use while on the job. Surprise, suspicionless drug/alcohol testing is the norm. And the job pays pretty well. Some guys do fall off the wagon, but most won't risk a 100k/yr job just to take a illicit sip or toke. But certainly the guy needs to accept being filmed in todays tech heavy, social media age. It's now the norm.

I know a lot of train crews are happy to see railfans still these days. It's a different time now I guess though... even a few decades ago there was a more friendly relationship between crews and railfans especially looking at old videos of hundreds to thousands of people meeting certain special trains just to get a look at it. In the 1960s I believe there was a triple header steam excursion train that did a trip from Toronto to Orangeville and there were thousands of people that greeted the train when it arrived in Orangeville and they completely flooded the rail yard. You would never see anything like that now.

Hi. I´m just wondering, that is it illegal to film trains in Canada? I would understand, if one was filming right next to the tracks, because it is dangerous, but clearly you´re like 3-4 meters away from the tracks. I´m planning to come to Canada this coming summer to film some trains. But anyway, i would like to say that i love your films. You´re doing a great job! Greetings from Helsinki, Finland :)

Ya know what is really actually sad is that we are now given rules such as this to deter this activity...it's part of the ethics and heightened security threats. The conductor in fact did his job sadly enough and he'll get an atta-boy or so be it... But yea, what a desperately sad state of affairs this world....pretty soon the birds will be posting here about being harassed and having their nests bombed out. I'm done. Oh and by the way...I work at a NON-UNION railway...in Canada... Watching trains has now been officially tagged as low as pedophilia...

Roger Diotte Can't count the number of defective crossings I have reported. And given rides to conductors to the back of their train and back up to the head end. It never hurts to help a guy out. Some have flat out refused the ride & would rather walk than have anything to do with me. lol

That's actually false. Under the Act, it is completely, 100% legal to operate a scanner and to re-broadcast any received audio as long as it isn't relaying private information (which this is clearly not doing). You're also allowed, by law, to broadcast radio streams (like many sites for trains & airplanes, police etc.) as long as they aren't encrypted. And no, this hasn't changed in the last year since your comment was made. Stand up for your rights! Record it, broadcast it, whatever you want!

Dude needs to get over it. He might think his conductor job is just any other type of job and heck he probably hates his job being a conductor. That A**hole should understand there are people that would love to work for the railroad and do his type of job. It's not easy getting into the railroad business sometimes whether it's personal reasons or other reasons. So people just railfan which is harmless if done the right way. That conductor obviously has nothing else better to do either than clog up the radio over BS. The guy is out in the public were cars are passing him and seeing him. He is obviously not trying to be secretive and up to no good...

My feeling is that you are NOT trespassing at all, and the only reason someone might get upset about being photographed is if they aren't very good at their job, or are afraid of being caught on tape doing something wrong. Confident train employees shouldn't have a problem with a railfan. Also, its offensive that this guy things you have nothing better to do. If you are an older guy then you might be retired, how dare he judge you and suggest you have nothing better to do!

Sheesh, harsh... Im always here on the BNSF subs and tracks listening to the scanners and all I have ever heard was hey, honk at em! or if they see the scanner, even a hi! But never about trespassing... Although, I sort of notice his on alot of videos with CP in em. Guess its not a railfan friendly company... some are friendly, others not so much...

Some have made excellent comments below. I am saddened to hear that this particular Canadian railway employee was put out by someone taking an interest in what he did for a living. I hope that guy is in a tiny minority of CP employees. Sad really.

Here is a "classic" case of job boredom. The conductor is so bored with his job that he has to take it out on the guy recording the train. Conductor needs to find another line of work or perhaps do something else. How do we know he is bored or unhappy with his job? Good question. Notice when he gets out of the cab and walks to the lock box, walking like a man unhappy with the work or bored. This does not make for same railroading. So for something to do, he calls the dispatcher. Probably to make conversation. Maybe he and the engineer don't get along and he needs to talk to someone. Anyway, the guy is a jerk.

This train crew is absolutely on the wrong legal track! In addition, a true railfan is a huge benefit to the railways as he can provide train inspection of the cars and loads going by and call RTC with his cell-phone if an anomaly is detected. This can be critical since we no longer run trains with cabooses. 2018/01/13.

Well. if the conductor can't stand being filmed...best not go into law enforcement, or any other public service field. I guess this is in Canada...in the United States, anyone may observer/film passing trains as long as they are not blocking the signals, standing in the road, or trespassing on private land (that is Posted!).

He reports to RTC, they typically contact teh CP police when required. Thankfully, nothing ever came of it. Regards, J

I can understand he doesn't want to be videotaped, but he can't report you for trespassing. I'm pretty sure he's abusing his job as a conductor (reporting you to RTC), for his own personal reason. And I like how he sticks his head out the window at 3:44 to try and catch your plate number!

That's the "back track" or maintenance siding where they put equipment so it does not interfere with train meets.

In my opinion there are two kinds of rail fans. The first kind are the ones who don't trespass, won't foul the mainline ect. The second kind are these so called "foamers" I don't really know a lot about foamers but I've heard nothing but bad things about them. Also the rail fans who do actual illegal shit on railway property give the rest of us a bad reputation. It sucks but what can you do.

Oh man, that conductor's attitude ruined the video LOL. Talk about being grumpy, wow. I have chatted with several CP rail employees and they've all been nice in answering questions regarding rail work etc... I've even seen CP Police watch me and my dog walk on the rail side road and they left us alone...If a train comes we move well out of the way. Thanks, hope you don't have to put up with that jerk too often.

I wouldn't have videotaped him walking along the track. Let him do his job. Other then that, and that's more of an ethical suggestion on my part, I don't see anything wrong. The employee needs to get a grip on things. By the way what happened? There was a claim that they would do spot checks at that location.

@@JayJr2007 I also wonder if he knew that you had a scanner with you. He 'claimed' he was going to talk to you then decided not to. As you had a camera rolling, knew that his conversation with you would be taped. The way he handled it, he figured he could make claims about you more easier (i.e. that you were trespassing when you clearly weren't.) You would not have known about the conversation without the scanner.

What is that guy thinking you have to be on the other side down a bit to be trespassing. My father use to work for a train yard and I know you have to be 200 yard before you are on rail yard. I almost got a fine for being walking down the track. I got stop just before I just enter the yard. Told the guy I was meeting up with my father. This guy is on a power trip.

This Conductor is afraid of his own shadow. He is afraid the Railfans will videotape him doing something wrong. What was the last comment? Citing the train's slight delay because trespassing??????

Don't know how they can complain if you are filming from a public street. Of course if you are on RR property that might be a different matter. Railfanners SUPPORT RR workers. No reason for the RR workers to be upset with filming. Just my opinion.

Wow jay. You weren't a very popular guy back then. A real rabble rousing scallywag. I was 10 years a switchman from 93 to 04. There were folks filming even back then. They were just using video cameras instead of cell phones. I never really had an issue because I already knew folks have been filming trains long before I was there. My only worry today is that now millions of folks can see these vids now. Including the bosses of the workers in the vids. I always suggest that rail workers be on their best "follow the rules" behavior. Never know who's watching. Also, I worried back then that some guy filming was actually a railroad company official. Still not much I can do about except be on my "best" behavior during filming. But I did have conversations with a few guys. Really nice people. But as long as you are not on railroad property, not much they can do.

I had inadvertently made some enemies when I reported some autoracks that almost rolled over (kzfaq.info/get/bejne/kKd5bLSWmt-ugoU.htmlm23s ) & later found out that it was the engineer's fault for staying in the speed range of harmonic roll. Needless to say, there was a few of them that were very unhappy with me after that. Ooops. lol . The vast majority of crews are friendly & have given rides to several conductors so they didn't have to walk the train. Thanks for watching! Jason

Yeah your "harmonic roll" vid was wild. Now can they be mad at you??? Sure. But that crew is LUCKY those cars didn't rock right off the rail. They would have been disciplined for sure. You alerting them of their condition may have irritated some. But they certainly needed the irritation to remind them of the speed restriction in that siding. That's not something you can just wily nily forget about. Roll a few loaded racks of the rail and that siding will be unceremoniously named after you. I guarantee it. (btw, not sure if you know or not but anytime a part of the railroad is named after you, that means you really eff'd something up bigtime)

Yeah for most RR employees, they could care less unless you are doing something dangerous. However, I will say that it does make train crews nervous as people do end themselves by train regularly. When I realized that, I started giving them more space.

Riiight. My favorite spot in Chattanooga is technically trespassing, but I used to park up there and watch trains roll by and they’d wave and do a horn salute. No problem with me. But recently the city installed a large power pole at the bottom of the hill and cleared out some trees, now you can see who’s parked up there from the road. Last time I was in Chattanooga I parked up there and not ten minutes later did a cop pull up and say he spotted me and asked me to leave. So next time i go I’ll have to hide from the cops but not the crews. Funny how that works sometimes.

He said he was gonna talk to the guy himself, but of course he didn't. Like most people who call in false complaints they don't have the courage to do anything themselves. They call it in to dispatch and have the police called to do the dirty work this conductor should have done himself.

Actually, he can film or take pictures of whatever he wants. It sounds more like CPR is harassing him, which also has it's legal and criminal implications. This video and the radio recording could completely implicate the railway crew in that they are simply out to get this guy. Being cited and proving it in court are two very different things. If CPR isn't careful, it could find itself in a nice hefty lawsuit of harassment of the public.

Lol he's upset at a train enthusiast filming him. Here in the Philadelphia area they throw rocks at trains as they pass through industrial areas. He'd really have his period over that. Must have been a hall monitor in school lol !!

I'm surprised at this. Looks like you were filming from way back of the barrier line and not next to the tracks. Not friendly of this guy at all including his ignorant comments. Unfortunate. If you were a terrorist scoping out a "plan of action" I wonder if they would do anything at all.

Wow, seems the train crews on the CP Mactier Sub just don't like railfans. We are railfans, not trespassers!!! You were a good distance from the tracks, so you were definitely not trespassing. I cant believe this conductor keeps reporting railfans as a suspicious person or a trespasser, because we are not trespassing. My cousin is a CSX engineer, and he has no issue with railfans.
