Apparently, she was not fearful enough to avoid seeking a loan from, according to her, a man she said is verbally and physically abusive when inebriated. It had been several years since they were in what she described was a volatile and violent relationship after their first year together. In fact, according to the defendant it’s possible that the plaintiff might have allegedly been involved in the fire that ended the life of one of her children. And yet this is the person that she chose to reach out to for financial help? That sounds crazy. Why risk the potential harm to yourself to borrow money just to get your car fixed? Why not ask someone else who isn’t an alleged “threat” to you? Thank goodness the plaintiff had the presence of mind to get a signed document stating that the defendant would pay him back the money that she borrowed. Good job on the decision Judge Mathis!
