As the Senate confirmation hearings for Supreme Court nominee Elena Kagan get underway, the Edward M. Kennedy Institute is partnering with the PBS NewsHour to provide video highlights of the nine most recent Senate confirmation hearings.
Justice Ginsburg, only the second woman ever to serve on the high court, was confirmed by a 96-3 vote in August 1993.

She has said many times that her mother always advised her to “be a lady” really meaning to stay calm, breathe, think about the words your saying and speak slow in a clam respectful manner. That’s why she speaks the way she does. She thinks before she speaks

yes and i noticed they said at the end that they implemented a closed meeting to go over any personal allegations... did they get rid of that for Kavanaugh? because the only reason we had his public meeting about allegations was because the press found out.

Coming up in the American legal system the way she did she couldn’t afford to waste her words, every single one has thought behind it and meaning. Men still don’t let women get their thoughts out before complaining about them, imagine what it was like in the 60s and 70s in a field where women were simply not welcome. “Nevertheless she persisted.”

Defly Plaise that could be good, sounds like it’s procedure based so it’ll probably be teach you about how things go down in a lawsuit. If you want to learn about interpreting the law itself though, you need substantive courses. I took classes called civil liberties, civil rights and constitutional law in my undergrad and i learned all about the supreme court decisions. If you can find out whether any of the classes require you to “brief cases”, definitely take those!

@b7702, I often write briefs with alternative legal arguments. Sometimes you have a threshold question that, depending on the answr, takes you down different paths requiring different arguments. Sometimes, that's not the case and your'e just throwing theories around hoping one will stick. When such theories are totally incompatible, they tend to highlight weak or false assumptions in your reasoning, making them risky to make to the court. Ginsburg's arguments sound like the latter.

Seems Ginsburg a deep thinker and truly honest on every single word she made. Also she’s not afraid to speak out her opinions. Cannot see any of these from Amy C Barret’s hearings. She tried so hard to escape from questions on most issues. Very disappointed.

I read a bunch of articles about how Ginsburg didn't comment either way about stances on certain issues. I don't see that at all. I realize this isn't the entire hearing, but the fact that she spoke about abortion, women's rights shows she did have a stance and shared it. Amy Coney Barrett's testimony was about not answering as many questions as possible, when her views are obvious outside of the hearing. It made no sense and also in my opinion, looked weak.

Now, it ain't about real view points of nominee's, or qualifications, it's about the corruption brought by Republicans to "reshape" the courts with Republican judges. Barrett was their girl. Sides with corporate over worker majority. On abortion, gay marriage and healthcare, she was the one.

I love listening to all justices from Scalia, to Breyer, to Bader-Ginsburg, to Gorsuch, to Sotomayor, and now Coney-Barett. The wisdom and judicial knowledge they have is truly above partisan politics, and all humble, too! The only justice I find unfit for the role is Kavanaugh. Listening to his confirmation hearing and interviews is like listening to an arrogant college fraternity jock. Reading his decisions, especially next to other justices' writings especially the conservative ones, makes his look like a high school english essay! No wonder only Gorsuch joins him in writing his opinions. Most of the time, he joins someone else or writes opinions by himself 🤣

I miss the days when congress didn't play games with qualified appointees, she obviously was well-qualified. Chuck Grassley is still around today and did the best he could with Kavanaugh but the show around him has become a circus.

@b7702, I understand the concept of alternative arguments, but those two statements, as Ginsburg explains them here to the Senate Judiciary Committee (not in a brief) are contradictory. I actually think both arguments are plausible, but they are not congruent. Also, alternative arguments usually take alternative views of the law ("even if this legal theory doesn't work....this theory does..."). But here, she's offering alternative views of reality (who has the choice). A daring move.

It’s not a form of birth control. It’s a last resort for people who make mistakes, are assaulted, and whose birth control failed. It’s not a fun experience. Insinuating that women go and do this a few times a year rather than taking a pill or insisting male partners use a condom is ridiculous.

Did you actually watch the entirety of the hearing for ACB? Not just snippets/highlights. If so, if you came to it with an open mind, then you would understand why she did not answer many questions about active cases, did not grade precedent, did not share personal stances on issues, etc. There are ethics rules and tradition for judges to not do that. It’s been the case for every judicial nominee to not answer those, not just ACB. Her personal feelings about cases are irrelevant to her position as a judge. Judges are suppose to be impartial, have an open mind, and go through the judicial process in order to decide a case. To do otherwise would be judicial activism. Activists on the court are not good. If she did answer with her personal feelings then any litigator could use that as an argument for why she isn’t fit to hear their specific case, they could argue that previous cases were incorrectly/unfairly decided, etc.
