I have seen many episodes of Crime Tak, but I was really shocked after viewing this. I was compelled to view the episode a second time to really comprehend what had happened. It looks like it is a big SIN to be poor in India. Looks like the media in Nasik also failed to highlight the blatant miscarriage of justice in 2003. When the incident happened, Sh Sushilkumar Shinde was the CM of Maharashtra. Before he entered politics he was employed with the police. Is it possible that some disgruntled person has tried to embarrass the CM by framing 6 innocent members having the same surname ?? Shams Sir should try to interview Sh Shinde. Maybe he will be able to throw some light on the incident.

Mr Soubhik Chatterjee, Very observant of you..I too listen to Sir Shams version but my mind is what is the ultimate results..that shows I am not listing properly..I am from Mumbai so Hindi or Urdu language is familiar to me as I get to hear each & every day...what a blunder was the decision of the high Court...When Sir Shams spoke about the witness recognizing the criminal's & the Police official let them go Scot free..I am certain money must have changed hands & they arrested this Tribal people knowing as Mr Shams said no one would have supported them..their voice Silent just because of their background..but the Judge who took looked at the appeal & asked for the papers my hats off to him..wish we had more of these types of Judges in our Courts of Law.

Very sad those who are down cast they are deprived of everything they have lost their life for so much years

What a sad case, people who are lower castes in India and Pakistan never get any justice, I live in the west if that happens here they would have got millions of pounds!!!! When you have no one on your side you have god on your side and god is the almighty judge.

This case was conducted by me in Sessions Court Nashik. The police while recording the statement of the injured lady then admitted in the Civil Hospital Nashik, had shown an album of criminals to her and asked whether any or some of the persons seen in the album had entered her hut in that fateful night . The lady identified the for persons from the said album, but however, they were not put on trial. The prosecution tried to suppress this fact but during the cross examination of the lady I brought this fact on record. The accused were also charged for gang rape. It was alleged that they gangraped the young married woman and killed her and they also gangraped the eyewitness. The police had also obtained the DNA report but being not useful against the accused, declined to rely on the same. The two eyewitnesses were cross examined at length and more than 22 improvements were brought on record. There were other witnesses also including medical officers, magistrate who conducted TI parade etc. The accused didn't carry any radio or transistor but it was there in the hut itself and the accused grabbed 3000 rupees from deceased husband of the eyewitness. The case was tried and decided by the Sessions Court Nashik ( Smt. Tambi ) and not by Sessions Court Pune ( The reporting is not correct on some material points ) .All the accused were convicted for murder and gangrape-mainly- and sentenced to suffer death penalty. In appeal before the High Court Mumbai ,the accused were represented by me and Adv Ashok Mundargi. The appeal was heard before the bench of J.Marlapalle and J. Mohite. The appeal was partly allowed and the death sentence of three accused was commuted to life imprisonment. For full judgement see - Ankush Marutu Shinde V. State of Maharashtra 2019 Cr.L.J. March issue.

Law is ok but in India the police , lawyers and judges are at fault due to their negligence, irresponsibility , and no one can question them - thankfully in last the jugde at supreme court did his job well and gone through the case with honesty and delivered the justice for those innocent who have lost 13 years of life behind bars and lovedones and didn't get any compensation yet .
