Former Delhi High Court judge Justice Mukta Gupta, while talking to India Today, said the new criminal laws have given umpteen powers to the police. Now a Senior Advocate of the Supreme Court, Mukta Gupta also said that certain changes need to be done in the BNS.

To give more power to police was necessary. Because in most of cases, the hard work to arrest criminals by police gets failed. Because criminals goes to courts and judges release them within some days. This is injustice or not??

thanks . explained in lucid way. all audio/ video recordings as evidence must within an hour of recording should be upoaded to a central registering authority so that there is no chance of wrongdoing with the evidence collected

I am happy there were reforms. I am worried if corruption is not tackled. There will be advantages for more corruption or abuses. Check and balance must be enforced.

In a Scroll.in article, social activist and author Harsh Mander said that “under this doctrine, no weapon or strategy of offence is out of bounds - bullets, pellet guns, human shields - even if these outrage international and national legal and moral codes. Victory can only be assured by military might. The only objective is to win by any means. Even if blood flows, if children are felled or blinded, if mothers weep, if liberals are outraged, if people do not vote - it does not matter. The State has to prevail by more and more military force, even over its own people.”The statements of Doval mean he has a different understanding of the Constitution, democracy and civil society. He seems to think that India is still a colonial monarchy, where people are subjects, and not a democracy wherein, they are citizens. Our Constitution opens with the words “We the People” and democracy is defined as a society in which the citizens are sovereign and command the State. There is an ocean of difference between ‘subject’ and ‘citizen.’ ‘Subject’ is one who is placed under the authority or control of a monarch or government, whereas ‘citizen’ is one entitled to the rights and privileges of a freeman. While it is the duty of a ‘subject’ to obey the government, it is the right of a ‘citizen’ to command the State because it is them who form that government by exercising the electoral franchise. In short, democracy in essence is ‘people’s power’ and not ‘State power.’

Time line is possible if u see the judges take time to deliver the order deliberately delay a person who is losing want adjournment by bribing judges.

ironic the same court releases Kancha iliahs book on hindus saying its freedom of speech but bans Hum do hamare baarah calling it offensive. when documents are clear who the owner is who the tenant is and tenant refuses to vacate then why the court needs 20 years. are the judges having such low IQ?

LAWS passed without discussing in parliament. Police State ind. Corruption will be freely used. Judiciary is short staffed. Not feasible at the moment.

Enough and more time was given in the parliament to discuss the laws.But as is their won't the opposition deliberately raised ruckus in the house and prevented the discussion and there after came out of the house and lamented that the laws were passed without discussion.Every time they employ the same tactics.

When these laws were 'passed', more than 100 Oppositions MPs had conveniently been 'suspended' on the most frivolous of 'charges'! This was no doubt done deliberately a few days previously in order for the Modi/Shah duo to pass these pernicious laws! Oh, BTW, you don't have to believe me/take my word for it! Just see the Sansad proceedings from that time! Perhaps look at facts rather than act as BJP's propaganda-spreading troll!!

Earlier in elopement cases, if abduction fir was filed, the consent statement s. 164 crpc could be recorded any where but now we see no such thing, thus the risk of life as wrll as tutoring, coercion to change statement.

Can you compare the new powers given to police to the powers police has in other democratic countries like US? Then we will have a better idea. Because if they don’t have powers then we the people itself call out the lack of law enforcement.

The now Supreme Court lawyer has extraordinary understanding of criminal law very very uncomman at these times and reflects she has been groomed by lawyers best in the profession apart from her own efforts obviously. The lady taking the interview is requested to give primacy to the person being interviewed and I am certain she lacks the understanding to follow the replies.

These new laws will lead to a) filing of more frivolous cases; b) delaying/delayed filing of cases by the police; c) delaying in examining evidence (as the proper resources for forensics is pretty much lacking); d) increased pendency of cases due to increased case load in courts -- so, you make up your mind whether this will lead to 'speedy justice' or not... And, oh, also, this will increase police bribery & arbitrariness...so, hurray for that too!!

It should be at least 100 years with full confiscation of property removal to citizenship along with jail for all family members of criminal.

Law is an ever-evolving field, and most issues go into the future as well... So??? "At present the punishment of spurious drugs food items , question paper leak is very less 1-3 years. It should be at least 100 years with full confiscation of property removal to citizenship along with jail for all family members of criminal." -- I agree that the punishment for some of the crimes is obsolete (esp. the fines/monetary punishment) and for many the sentencing minimums need to be changed -- for some they need to be cut down, and for others they need to be more stringent... However, those are not the issues at hand/we're discussing right now...! The issues are: 1) there is/was no need to change the laws en masse, in toto - selective modifications would have been better (faster, causing less chaos & confusion); 2) the egregious manner in which this was actually done; 3) the fact that the 'new' laws are pretty much not new, and are ~80% copy-paste, thus negating/obviating the very rationale of 'changing' them!; 4) the fact that some of the new laws have been made much more arbitrary & stringent -- leading to potentially more arbitrariness & corruption in the policing & legal systems, not to mention the total disregard of human/individual rights & freedoms (incl. & esp. the freedom of speech/expression!). In short, most/much of the new laws are unwanted, unnecessary modifications (but not enough!) which were passed by highly dubious methods, and they are pernicious to the extent of being anti-democratic...!

People are resistant to change, but criminals evolve. The issues are: 1) there is/was no need to change the laws en masse, in toto - selective modifications would have been better (faster, causing less chaos & confusion); Ans: You told earlier Law is ever evolving. We are still going with British era laws. This is sufficient to change it. I know people are resistant to change. 2) the egregious manner in which this was actually done; Ans: Its not. It’s passed by parliament. Decision of speaker is final. Opposition has not raised no confidence in speaker prior to start of session. It’s of least concern. I am not political animal. 3) the fact that the 'new' laws are pretty much not new, and are ~80% copy-paste, thus negating/obviating the very rationale of 'changing' them!; Ans: I did not read the old law. New law I have read. Its easy to understand. Serial numbers are given. Its good. It does not have sub clause. It Could have been better drafted. Murder by Bullet, Knife, Sword, By cutting in pieces, burning, etc should have different sentences. Depending on nature of cruelty ranging from 10,20,30,40 etc. But most crimes are clubbed together. 4) the fact that some of the new laws have been made much more arbitrary & stringent -- leading to potentially more arbitrariness & corruption in the policing & legal systems, not to mention the total disregard of human/individual rights & freedoms (incl. & esp. the freedom of speech/expression!). In short, most/much of the new laws are unwanted, unnecessary modifications (but not enough!) which were passed by highly dubious methods, and they are pernicious to the extent of being anti-democratic...! Ans: You need to read and point out. Like I am doing Number 63 rape. Punishment of 10 years. How do you record a consensual sex? Gov should provide a draft of consensual sex. Is that draft not violation of privacy. Who would like to keep record of all sexual activities? Over glorification of rape. Corruption is hidden and is underestimated 173 - One year punishment is too less. 174 Election fraud one year jail, 178 Counterfeit note 10 year its too less. It can be argued. On what is good or bad. But I as a citizen is concerned about by safety my right to self defence , corruption free society .I am not concerned how the law is passed

In most of cases, police arrests criminals. Than criminals go to court and get released or get bail by judges. Police was weak in it. Now they have got power. But they should not misuse such powers. They should use these powers against criminals and for safe guarding citizens.
