If the new criminal laws come into force on the 1st of July we'll have "a legal and judicial mess, life and liberty could be in danger": former Additional Solicitor General, Indira Jaising, to Karan Thapar for The Wire.

One of India’s most highly regarded senior advocates and a former Additional Solicitor General has said that if the three new criminal laws come into force on the 1st of July, which is what the government intends, we will have “a legal and judicial mess” adding specifically that “life and liberty could be in danger”. This is why Indira Jaising has loudly and publicly appealed to the Law Minister as well as to all the leading Opposition politicians in the country to hold the three criminal laws in abeyance until they are further discussed and looked at closely once again.
I do not want to give away the critical details Ms. Jaising has discussed because I think you should hear them for yourself. However, let me tell you she makes three general points followed by three specific points about new offences under the new criminal laws. The three general points are that you could have two different justice systems running concurrently and in parallel, you could have endless disputes over which procedural law applies (old or new) and the pendency of cases could increase by 30% or even 40%.
The offences she discusses are Section 152 of the Bharatiya Nyaya Sanhita, which she says is even more draconian than Section 124A of the IPC which defines sedition, second, the fact that many UAPA offences are repeated as offences under the new criminal law and, therefore, the “process” will be additionally “punishing” and, third, that the Bharatiya Nagarik Suraksha Sanhita mandates a preliminary inquiry in every cognizable offence which is punishable for three years or more but less than seven and, therefore, FIRs won’t be automatically lodged.
Ms. Jaising says there will be multiple petitions challenging the new criminal laws in the Supreme Court as well as the major High Courts in the country.
For all the above reasons she believes that if the laws come into force (on the 1st) before these issues are resolved and the challenges heard and adjudicated we will have a legal and judicial mess placing life and liberty at risk.

Vagueness and uncertainty is more with legal fraternity and not politician. What can be better example than SC changing its own decisions on 377 and so on in 50 years. So all the persons convicted earlier were convicted wrongly. Certainty is the word missing from our judicial system and vagueness is the norm. Interim bail to Kejriwal during elections another example of vagueness and extraordinary exemption

I fail to understand, why our prominent SC lawyers like Kapil Sibbal, who otherwise undertakes discussions on many critical national issues although had talkshow on the issue but in a very casual way, without raising any red flag against the implementation of these new laws especially on long term impact of this law on citizens.

Lack of deliberation can hamper the rights of the accused. Taking into consideration that half of the members were suspended when the bills were being deliberated. Also lack of understanding of the laws to the Judges as well as the lawyers without adequate infrastructure of training is another loophole. I am surprised that govt. has taken zero efforts to setup training sessions for lawyers especially for the ones who are private independent lawyers.

The Supreme Court of India must intervene and should postpone the implementation of new Criminal Laws till the necessary infrastructure of forensic laboratories , training of police and lawyers and judges in the new criminal justice procedure and evidence production , formation of new courts for trial under new laws is completed

Quite understandable that it is very difficult for the vassal droppings and the remnants of the 20th century suzerain to come to terms with the independent, new age outlook of the present generation to get rid of the vassal state left-overs. In these vassals' view only Hindu practices alone need reformation. Their lexicon has it that: To oppose a bollywood scene showing a Hindu woman stripping with a Hindu symbol is '"Reprisals of freedom expression and artist' freedom". As opposed to this: if a school lays down rules against purdahs, the very same people would say 'it is denial of freedom to practice one's practices!!!' In sum, their self-defeating, polarising stands on two issues of the very same nature has driven them suffering with bipolar disorder.

Laws should be simple and can be understood by the public. Principle of laws require that it makes everyone in the country equal in the eyes of the laws . Judges and lawyers are the beneficiary of bad laws and they protect criminals for pecuniary gains. This business of lawyers and judges should stop and people judge themselves by using the laws and it's principles enshrined in the constitution of India. Regards

Is there any Refresher Course for Advocates and Judicial Officers And Magistrates/Judges to get amply conversant with the New Set of Laws? There's serious apprehensions that the New Laws will create a host of disturbing issues in the long run. Last, how will Police Authorities deal with the sudden implementation? They too need to be tutored about how to make use of it! The General Public needs enhanced legal awareness and alertness too.

I prefer describing the BNS as rather the 'Anyay Sanhita' which is precisely aimed at justifying every injustice perpetrated by the govt that was prevented by the old criminal laws. I've got no doubts whatsoever, about the govt planning to bring about a dark era of oppression through these laws.

Ms. Jaisingh is oblivious to Section 531 of BNSS 2023, the successor to The Code of Criminal Procedure, 1973...the said Section provides for the repeal and savings and it's sub -section 2 which begins with a non obstante clause and clearly mandates that

Presumption is everybody is a criminal before proven guilty and only people in power and their chamchas are innocent. This is dangerous. This shows what flavors the ruling party desires. Need to see what opposition speaks on it or it may contribute to the new normal.

Karan, Please pick up topics that are of much larger impact to masses like: 1. Possibility to have all lower and district courts turning into e-courts. Litigant and judge from different part of country so to have minimal influence either way. All hearings online and timely judgement. Once the courts start functioning in a truthful way, the flimsy cases will be withdrawn automatically. Mind you most cases are just to intimidate. 2. Abuse of women laws in the country. Do you see possibility to have some changes to 125 and 498a in favor of men given the widespread abuse of this act? 3. Corruption at local level especially at municipality level and govt dept that deal with land issues. Take the example of HUDA / HSVP in Gurgaon. Possibly the most corrupt. How do we connect judiciary to complaints that we have against our local administration? The opposition will find most fodder here. Though Modi govt may not be corrupt at the top, there is ample corruption at the bottom of the pyramid. 4 Things like the months of vacation that our judiciary enjoys. This is a mockery of modern judiciary system and goes in the face of the lowest common denominator who slogs 12 hours a day 365 days a year to put 2 square meals on his plate. I KNOW SEVERAL PEOPLE OF 3 RD & 4 TH GENERATION THAT ARE STILL HAVING TO DO / FACE LITIGATION WHICH IS STILL NOT FINALLY DECIDED EITHER WAY IN THE LOWEST COURT & HENCE STILL CONTINUING IN THE LOWEST LOWEST COURT .
