A father and son were allegedly shot dead by their downstairs neighbor in Brooklyn Sunday night. The search is still on for the shooter. CBS New York's Christina Fan reports.

I had a similar dispute over noise with a neighbor downstairs not too long ago. The leasing office was no help. I called the police once when the verbal assault almost became physical. I got even worse quickly, I moved before the lease ended. You can't take stuff like this for granted. Mental illness is widespread.

About 3 or 4 years ago, a couple moved upstairs with a toddler. The kid would run from 8 pm- 3 am, I worked at 4 am. I notified the office to avoid confrontation, they got a simple noise warning. After that they started stomping their heels for HOURS on end and had the kid run more on purpose. After about a week of avoiding it I knocked on their door and addressed their intentional stomping. The mother said "We don't like people bad mouthing us. She's a kid. If you don't like it, put ear plugs in." I notified the office and we had a meeting. They started arguing with management and ended up evicted. There's a lot of parents that let their kids run amok and unchecked and use "they're kids" as justification for shitty/lazy parenting, and if you address it they become defensive and nasty. Obviously killing is not the way to go, but I feel bad for people that have to move or endure inconsiderate neighbors. It's unfortunate, but I can't say I'm surprised by this case

This is SAD, but stealing a person's peace is a dangerous business. I lived next door to neighbors who blasted music. I didn't dislike them, I used it for fuel to buy my first home. I didn't want to be comfortable in that duplex. But I KNEW that once the new people moved it he wouldn't last. He was kicked out less than 6 months after I bought my house. You can't steal people's peace like it's not a crime.

I have a noisy neighbor who gets everything paid by the government. One night i begged her nicely to be quite so i could rest from a hard day of work. She made it even louder when i called 911, after the police left who asked her nicely to have some respect. She deliberately bang stuff on the floor for the whole night! Be respectful and considerate to people who live below you. The floors are nade with wood so the thud is deafening. Sometimes i literally feel like i am going crazy. And not everyone can just buy a house or move. There need to be criminal charges of terrorism against people who deliberately make deafening noise to offend their neighbors.

This incident brought tears to my eyes. 30 yrs ago I was this guy 6'5 built like a brick. I was very intimidating,and I used my size to get up in peoples faces to watch them back down. My wife sometimes tried to stop me but I ignored her as usual,and pushed her away. My life almost ended 30 yrs ago when I was approached by 3 men armed with firearms while I was leaving a supermarket with my 5 yr old son. I tried to pretend that I didn't know who this guy was,but he knew who I was. I remembered doing the exact same thing that Mr. Mathurin did. He stated to me that my son saved my life that day. Please Men,don't try to intimidate with size,and anger.listen to your wife,and walk away.

I COMPLETLY UNDERSTAND wanting the noise to STOP. I finally moved to get away from my downstairs neighbor...dog barking at all hours, kid screaming at all hours, loud music, the parents yelling at each other, turning the parking lot into an auto repair. The new place is WORSE.

Had a neighbor with one child living upstairs from me and that one kid made noise and carried on like there were 8 kids up there. This was a two family house. The owner of the house suggested we switch. I was okay with that but my boyfriend at the time leaned towards moving so we moved. Its not your house, its not your property. You live among others in a community, be considerate and respectful of others. Not condoning the violence cause that was just wrong. Hopefully landlords will take note.

When I had noisy neighbors, i cannot say how many times I almost lost my mind with loud kids running back and forth/drug addicts stomping around 2:00 am/a fat guy above me who would stomp around in the middle of the night, even after being asked not to. My current apartment is relatively quiet in comparison, but we have very heavy metal doors that the savages here like to slam as hard as they can, and each time I jump out of my skin. Noise pollution can absolutely make someone snap.

That's scary cause i just yesterday banged on my upstairs neighbors door explaining to them to stop stomping banging noise on my ceiling, they woke me up out of my sleep. It's very painful and disturbing noises. Your body jumps and vibrates everytime you hear sudden heavy 🪨 bangs above your head. It's mentally draining. And it really nobody's fault but the building. The construction and insulation in the walls are too thin too old. I wish neighbors can mediate together and convince the landlord to reconstruct the insulation in walls to tune out sound better. But its usually the neighbors that make the noises not caring too much about the complaint, they just think somebody's bother them. And the landlord not caring to get involved. So you don't know, that man was dealing with that cheap apartment noises for so long, he came to his limit. And when that father banged noise back, that's when that man snapped. And im pretty sure with this expensive housing market, he couldn't afford to move elsewhere. Bad situation. And it's usually apartments that originally had carpet floors, but they changed it to hard wood floors which make noise impact sounds louder. Carpets and rugs help absorb sound impacts. And im not a violent person, i don't like fighting or arguing, but those bangs from upstairs neighbors be making you wanna run upstairs and slap somebody upside their heads but he really shot them. That's a unfortunate sad situation. Neighbors need learn to live together separately. You don't have to like each other, but you signed yourself into a building, you live with others period. Just be considered of others around you. Don't act like you living in the building by yourself, making all that noise, go move in a house, but you can't to move elsewhere either, so be modest of other neighbors around you. One thing helps, communication.

Going to a noisy neighbor's door is never a good idea; you never know what they have ready for you behind their door. That is how people get shot. I would suggest you stop doing that. You can't control how someone will react to you banging On their door.

The video can out. The husband came out menacing with a scissors. The other man looked was ready for a confrontation . The next day he died by cop suicide . Sad you can’t live in peace where you pay rent in NYC

If you watch video when they was interviewing the wife after it happened she lied and said her husband didn't have a weapon this was going on for years with this family making noise and not having consideration for their Neighbors and the people who lived under them this man was talking to the wife calmly and wasn't being aggressive at all when the husband came out and threatened him with the scissors that's when the man pulled his gun and killed him not saying what he did was right in any way but everyone has a breaking point and this man was feed up with him and his family being disrespect by these people who obviously didn't have any respect or consideration for the people they were living above and the neighbors they were living around. You reap what you sow & every action is gonna cause a reaction.

I experienced this living in a private house. Omg its absolutely annoying loud noise and you call 311 the cops come but they turn the music off and back on. They dont even give fines anymore. I had to write the man a letter in Spanish to tell him my walls are vibrating two houses down from him. I was petrified to confront him. Sad situation

Yup. That's why I tell people to NEVER live in an adjoining structure, apartment/condo/townhouse, if they can help it. Those inconsiderate mfers are something else. I just love the way how the family is talking and acting like angels - I don't believe them. The man reached his breaking point - he couldn't take it anymore.

I had that issue with my upstairs neighbors. I worked from home, and beginning around 9am, the children would run up and down the apartment, you can hear them jumping from furniture onto the floor, it was insane. I wrote 2 nice notes introducing myself, just explaining that I work from home, and it's hard to focus with the running back and forth all day. It continued until i finally knocked on the door and was ready to explode. All of a sudden, they became the victims. We never actually got into anything heated, but it could easily happen. Glad to say that they moved, and I purchased a home. I couldn't deal with that happening again.

The problem that I have is with the kids getting on the couch and jumping onto the floor. The running is understandable because they are kids, but I would think that the parent would be upset with that horseplay alone. Maybe he or she was immune to it, but people do need to keep in mind the renter below.

The Parents of Small Children Never “Hear” the Noise Because they have learned to Tune-It-Out. Unfortunately, the Neighbors especially the ones below have to endure the Constant Noise. This is a Tragedy but if the Father did threaten the Shooter with Scissors than Self-Defense could be argued. Moreover, the Loss of Peace due to the Constant Noise could be a Temporary Insanity defense.

I saw the full clip via twitter and I must say it was absolutely horrifying to see how it all went down...the husband did come out and seemed to have threatened the man with scissors as to have him back off but the moment the wife pulled the husband to de-escalate the situation the man shot him with his back turned and the young son while he was trying to run away (sadly towards the shooter)....the most appalling part of all this is that he didnt just stop at the shooting HE WITH FULL INTENTION executed both son and father giving them no chance at survival....

These buildings are basically the projects and I’m not surprised if there wasn’t proper soundproofing set up when it was built. If people want to live in a quiet area then move to a single house in the countryside. It’s ridiculous to expect it to be quiet in a multi story building with at least 100 people living in it and being in the city. People shouldn’t have to change how they are in their own home just to make their neighbor comfortable. If they can’t afford being in a quiet neighborhood then deal with it. Having 4 children is a valid excuse and you’re lack of understanding is really just sad.

That’s the difference between the culture today, where respect for others comes in, I had 4 children in an apartment, I had quiet activities, and kept the t.v. or radio at respectable levels. I lived in NYC and know of neighbors who wouldn’t accept being told to lower the noise level. There isn’t any respect for others in society today. We live in a selfish, disregard for others…. The holidays are coming up. So they'll buy their children bikes and skates to ride around in the apartment, because they don't take them outside, because its too dangerous. So they create a hostile environment with their neighbors, causing danger inside. There need to be some rules regulated and courses giving on how to respect thy neighbors. Im living in a nightmare now of a neighbor above me with 3 kids. She called cops on me because I addressed the noise several times. The hate I have in my spirit for this woman I pray about daily because I do want to harm her. I work very hard and pay rent too and also have 2 children i tell to mind their feet constantly because we're above someone. People think because they moved to a higher floor to disregard the families below them. Im sorry this happened but as a mom you should have been controlling your kids' energy and giving them different outlets to release it. Rip to them, but i do understand the neighbor snapping. Enough is enough, buy a house if you want to make noise all day and night. That simple.

Years ago my cousin used to live on the 1st floor of an old building. The neighbors on the ground floor used to complain all the time, she only had one son that started walking. We will be walking, they will hit the ceiling with something to tell us it was too much noise. Sometimes it’s also the buildings, so the only best option is to move !

My family used to live in one of the most downtrodden, noisy parts of BK and BX, East New York and the South Bronx. When they got sick of it, they didn't kill anyone they simply moved to a suburb in Florida. The gunman could've done the same.

If there's a noise complaint, that's what the police is for. The woman said the guy had a grudge against them so anything they did, including sneeze too hard would of ticked him off

Its obvious the father was a bully. The wife was pulling him away from the neighbors but the husband was in raged to attack with the scissors. He escalated the situation. If the father behaved in such manner over a noise complained I can imagined what the downstairs neighbors went threw with them.

This situation is really scary. My Wife always tells about a neighbour who always comes knocking and complaining that she should reduce the music coming from our apartment. We have no sound system. No television, just a family of 3 with a 3 months baby who rarely cries. This Man looks mentally unstable. He has even convinced her to come hear the noise coming from our flat from his room and she went with him. This left me furious. In as much as people can be noisy, no one should be getting shot

Hearing noise constantly over you is annoying, 311 nor the landlord result a solution to help the tenant. People going through life situations, or have to go to work early and consistent noise and pleading for peace from your neighbors can be the result of unnecessary tragic moments

Nah.. transfers take along time.. no one really moves out. This is a tricky one.. alot of people living in apartment and not respectful to other surrounding. Fortunately murder doesn't happen all the time.. prayers to both families.

This whole situation could've been avoided if neighbors were more respectful to each other. Having children does not give you a (FREE PASS) on making a bunch of noise and blasting music all day. People want to come home to some peace and quiet.

I have been in a situation where it was simply how the building was made. The neighbors would hit the ceiling even if someone was just walking. You people are lunatics and need to get some money and buy acres instead of demanding peace on a broke budget in crowded NYC where people live on top of each other. I was in the situation of having to hear noise and never complained because I understood my tax bracket. But this is America, where the entitlement is strong !

You’re not telling the whole truth, because the husband went into the house and came back out with a pair of scissors, which can clearly be seen on the cameras located on the ceiling opposite of their apartments and over the stairs. You can clearly see them arguing you clearly see the man go back into his home to put on his shirt, but when he came back out, he clearly had a pair of scissors in his hand. Which still is no reason to bring a large gun to someone’s door unless you intend to use it. The graphic video was on IG

I know what a noisy neighbor can do to ur health after working and be so tired,he just couldn't take it no more,he call the cops nothing was done,and the victim instead of saying he's sorry he chose to be a bully with his scissor ,the condo association should be able to evict people who won't comply with rules and things like this won't happen so sad

@@tevin2740 Pulling the gun out got him to back off. He probably started shooting because the guy probably said something he didn’t like as he was walking away. Now he is on the run because he knows he is going to prison.

​@@tevin2740 any sliver of a "potential" self defense scenario(not that there really was one in this case) left the door once he executed the father while down on the floor, face down by walking over and shooting him in the back of the head. The killer commited suicide by cop just a bit ago anyway. Charged at the cops with a knife. All of it just dumb and senseless. 🤦🏾‍♂️
