Florida v. Jimeno | 500 U.S. 248 (1991)
The Fourth Amendment prohibits unreasonable searches and seizures. In Florida versus Jimeno, the Supreme Court considered the boundaries of a reasonable search.
Dade County police officer Frank Trujillo happened to overhear Enio Jimeno talking on a public telephone about what sounded like a drug transaction. When Jimeno and his wife drove off, Trujillo followed their car. Jimeno made a right turn at a red light without stopping, and Trujillo pulled him over to issue a traffic citation. Trujillo then told Jimeno that he had reason to believe that Jimeno had narcotics in his car. Trujillo asked Jimeno’s permission to search the vehicle, pointing out that Jimeno didn’t have to say yes. Jimeno said he had nothing to hide and consented to the search. Trujillo saw a brown paper bag on the floorboards on the passenger side. He opened the bag and discovered a kilo of cocaine.
The Jimenos were charged with possession with intent to distribute cocaine. At trial, they asked the court to suppress the cocaine that Trujillo found in the bag on the floorboards because Jimeno hadn’t consented to Trujillo’s searching of the interior of the bag. The court granted the motion, finding that Jimeno’s consent to a search of the car didn’t extend to opening the closed bag to see what was inside. It held that if police wanted to search closed containers in a car, they had to get permission to search each container. The court of appeals affirmed, stating that, quote, “consent to a general search for narcotics doesn’t extend to sealed containers within the general area agreed to by the defendant,” unquote. The Florida Supreme Court affirmed. The United States Supreme Court granted cert.
