I'm 66, was an aircraft engineer even working on military. My wife bought me a mini 2 for my birthday nearly 2 yrs ago knowing I always wanted one. I loved to get this thing up and flying, not for sport or anything but to take aerial photos and film. 2 friends who are pilots from forces and a private pilot are drone owners and we conflab on phone regularly, even they are dismayed by new vlos rules. I myself feel very insecure about flying now, it has driven fear into even getting the drone out of the bag knowing that the pleasure I used to get is replaced with fear of doing something wrong. My drone was never out of site as I felt secure if I could see it, now vlos conditions drag me down from my perch so to speak. My friends tell me that I should not worry to much because we all are responsible drone pilots and don't go beyond silly!

I've owned my Mini 3 Pro since October 2022. I have similar fears that affect me so much that I'm seriously considering jacking it all in and selling my drone.

I can understand your frustration and fears, but think of it this way, when you get in a manned aircraft there are checks to do and rules to comply with, if you do those your flight is likely to be safe. Do the same thing each time you fly your drone and take Sean’s advice in this video, fly within the law and use the AMC in the circumstances he describes, as it’s really not here to catch out the responsible UA pilot, but prevent those who think it’s fine to fly the way they want without any regard to the law. Don’t pack it in, go out and enjoy what you can do safely and remember the more hours flying you have the better you will get and the more this will all become second nature to you.

@@simonelliott5956 Im not sure why you've mentioned the checks of a manned aircraft, they're not even in the same ball park as a sub 249g drone. The fact that its sub 249g means its very small, keeping the drone within VLOS is fine but now you have to be able to see the orientation, This means Im only going to be able to fly at a maximum of 40 metres tops, even less when the drone flies higher. So decent panoramic scenic videos will be effected by this. Its all starting to become pointless for me.

@@TooOldForThis1972 All I’m saying is that if your flight checks are done and you’re not flying something that is about to fall apart, you have mitigated the risk of mechanical issues and done your safety checks local to your TOLP and intended flight path to mitigate the risk as best you can, then follow the rest of the law, the AMC points about orientation is perhaps a step further than it’s needed at all times, as is discussed in the video the comment is related to. I have a Mini 3 as my go to drone, along with a Mavic 3 too, both drones are relatively small by comparison to an Inspire and drones don’t easily lend themselves to physical orientation like a plane or a helicopter as easily anyway, because if their symmetrical shape. So to expect you to have orientation visuals at all times is a bit unreasonable and I’d agree with Sean’s assessment, providing you have done your due diligence, hence mentioning a flight check in context.

My situation is very similar to yours (plus I've always had a keen interest in aviation safety) so, believe me, I share your frustration but equally I commend your determination to 'stay legal' . Mine has stayed in the box for quite some time but now that the changes and restrictions are settling into place I'm hopeful that I might be able to get airborne again sometime soon. If not I may just have to go back to paragliding to get my fix! I doubt my wife would be happy about that though.

It may be time to start thinking about regulating and licensing bird flights. There is a cheeky robin in my garden that is always flying at close distance to people and looking in my bedroom window. He also has no regard for where he takes off and lands. As the robin and my drone occasionally occupy the same air space I think we need to consider regulation of bird flights. 😂

It’s seagulls you need to concern yourself with. I fly fairly often at a local trading estate after office hours. Put either of my two drones up, no birds in sight and within 5 minutes I have some interested gulls circling and within 10 they start to mob the drone! Always just bring it down and the soon go but it isn’t me starting a fight lol. I suppose we are the invaders. 😊

All of you with long range drones have gone beyond VLOS. I don't do it in built up areas, only countryside and coast. I think the rules should be relaxed. If you believe the area is very low population it should be allowed.

Unfortunately aircraft like RAF, police and air ambulance helicopters also fly low in the countryside and coastal areas, so flying BVLOS puts them at real risk of collision.

14:01 That's the point! The CAA are trying to argue that you can't rely on screens and telemetry to gauge orientation in case they fail, but if they fail, you will pretty much have an out of control flyaway anyway. Ultimately, if you are flying at a reasonable height of under 100 metres, and you see an aircraft coming into your area of flight, then the only direction you need to fly is DOWN. As far as I'm aware, pretty much any plane or helicopter will be far faster than your little Mavic or Mini, so trying to fly in a horizontal direction is irrelevant..... :)

Hey Ian! I feel like with the AMC the CAA have forgotten that they are supposed to try and regulate and instead just cover their own risk. Which means we have some of the guidelines which do not work. At that point I would always refer back to the law itself as that is what a court and police would look at.

So true! Given the speed difference between drone and manned aircraft, even at close range you can't manoeuvre horizontally to avoid a collision, you descend.And we aways know which way down is at any range.

Thank you Sean, this for me is a base reference video I shall save and refer to for my own actions, been flying Mavics since 2017 and always in very remote locations usually in North Wales and the recent CAA guidance stating eyes always on orientation did wind me up considering the great telemetry with DJI machines that have never failed me, great post many thanks ....

Thanks for the info. I took out my drone yesterday for the first time (mini 2). The first thing I have done is look at all the laws and regulations and have found your channel informative. My experience so far has been to keep the drone close. I first kept it low and experimented with the operation and handling of the device.. what I've experienced with vlos is that it's sometimes hard to judge the distance of the drone to other objects. The example I have was I was descending down and while there was some trees in the area it looked through VLOS that I would have been clear to keep descending, however when pointing the camera down it showed that I was directly above the tree's and had I not used common sense I would have crashed on my first ever flight. I appreciate what the rules are for. However, I do believe you will see more crashes with it if someone new was to completely agree with these rules and do as requested.

Great video Sean, I take the same approach and use the same judgements in my flights and have always done so. Re your driving analogy, it works the same as driving on the autobahn (motorway) in Germany. Most think there is no speed limit and that is true but conditions are the key determinate rather than speed alone. If the motorway is empty, it is sunny and the surface is dry and in good condition and you are sufficiently skilled and conciously alert and in a vehicle that is roadworthy and capable of safely driving at high speed, you may indeed drive at very high speeds compared to the UK quite legally but if any if these conditions change you are liable to prosecution even at very low speeds i.e driving in a busy environment with lots of traffic, foggy/heavy rain, water logged road in a poorly maintained vehicle and you are tired, you could be prosecuted driving at 50kph. Be objectively aware of your skill set, be conscious of your environment, be conversant with your drones capabilities and operations, be aware of the weather and be sensible. A very interesting interpretation of the VLOS, with some very good advice. As an experienced Drone Pilot then you have alot of experience whcih as you mentioned is in your head. A simple check sheet to be used for each flight would provide a documented record to the CAA as to what you consider before each flight including your own tiredness , airspace etc etc. At least if you do not write it down at each flight you can document your thought process to the CAA for each flight you have carried out and not just the one that may go wrong that you suddenly write up like a very long novel

I think it fair to say that, your strategy pretty much mirrors what the rest of us do and did before the VLOS guidance came into being. Just relying on looking at the drone to determine its orientation ignores all the equally viable options you have rightly explained. Short term memory from the very recent footage seen on the controller is far more useful than credit is given. I agree with you that the VLOS guidance is intended to provide a fits all users approach.

Nice video @Geeksvana. I have flown FPV wings for a number of years and really do use a spotter. The spotter can always see the aircraft, but not necessarily the orientation. I have goggles with video feed and telemetry and I know exactly what my orientation is. My spotter knows where I am in the sky and because I am able to tell him where I am going he can track my path. My philosophy is that between myself and my spotter this is within the objectives of the law. I would not like to test it, but I personally think it is reasonable. I would like to see the CAA address the specific genre of VLOS with goggled-FPV and a spotter to clarify the situation.

I’ve been put off buying and flying a drone for the longest time because I’ve seen the regulations as being too restrictive. Just last night I decided to take the plunge and order a mini 3 after considering the relaxations on separation requirements from buildings and people. When it comes to safety, I look at hazards caused by drones in the context of hazards caused by birds. There are so many common birds with greater masses than most consumer drones, and yet we don’t habitually go out and try and curtail their actions in the name of safer skies. I do wander when regulations will be updated, recognising drone hazards compared to the ever present risks caused by birds.

Seems like good sound information. As a new Mini2 owner (and in the day PPL holder) it quickly became apparent in my first few flights how quickly you can lose line of sight.

Agreed! And as a PPL you'll also know about VFR, which IMO is a similar idea to VLOS. I don't know what all the fuss is about.

Bought a Mini 3 recently as my first serious drone, only been able to have it out once due to weather but this is pretty much my interpretation of the drone laws too. In built up areas, it's definitely more important to maintain VLOS as you can never be sure of what will happen. But if you're out in the middle of futtbuck nowhere and you're aware of your surroundings and immediate obstacles, I think there's much more legal wiggle room for VLOS and you could probably go further fairly safely, since there's nobody else at risk in remote locations. Mountain surfing, for example. Who is it gonna harm as long as you're responsible and aware.

I look at my drone when I'm taking off and landing. The rest of the time, I'm looking at the screen. That won't be changing for me on 99% of the flights I do. The 1% is when I'm flying inside a building, then I'm constantly monitoring the drone.

It would not be considered a safe operation if you were not scanning the airspace around your drone regularly as well as monitoring your screen. To look solely at the small field of forward view from the camera means you are greatly increasing the potential collision risk.

I think your interpretation makes sense for the experienced drone pilot. I would say that in A3 airspace I'm more likely to fly to the limits of VLOS knowing there are no people or properties below & a clear view of the airspace in case of aircraft. Any flight near people or property and I would likely only want my drone to be 200 ft or so away well within VLOS, in urban airspace you are far more likely to attract attention so I am mindful of that. In fact I generally don't do it unless there is a particular reason or shot I need to get.

I think there should be an exception for orientation if your drone is capable of showing its heading via map and camera view. I realize many inexpensive drones do not have this but there should be some distinction made, perhaps incorporating RTH upon signal failure.

@@ScarboroughTourist Me? With the Sub 250 I fly anywhere that interests me. With the Inspire, up until now it has been at a model flying club. I have left that recently though as it was becoming inaccessible for me, so I will fly it out in public and I'll probably do so under Article 16 Authorisation via the BMFA.

Great video Sean - even enjoyed the Geeky moments - firstly I always ensure controller and batteries are fully charged - I use drone assist and then pre flight I reccy the area first and look out for hazards such as tall trees / Buildings - possible livestock spooking - overhead lines - sensitive areas such as schools / hospitals etc - most of which show up in drone assist - I physically check the drone body / arms / batteries for signs of cracking / fatigue /swelling etc . I’ve encountered some helicopters recently (one out in the countryside) and bought the drone down to 5m until the airspace was clear - I have a GVC and A2cofc and pre GVC a PFCo - what I have found sometimes is I occasionally go somewhere to fly and when I get there - if it doesn’t feel right then I don’t bother - the training courses are really useful but common sense is to me - the most important factor - it’s when you watch the “distance nutters” you realise that not everyone will exercise self discipline - as a function check - I occasionally will fly out 200-300 metres and then turn off the controller to check the drone will rth - so far it’s never failed to work - would be interested to know how often people do this - one other point - I check my props pre every flight and wondered how often you change your props ?

I just hold the Mini 2 drone in my left hand and the controller in my right hand with no take-off at all for 25 minutes, job done I am compliant :( Seriously though DJI Mini 2 drones etc will / should be safer to fly at a 100m to even 500m distance with the safety systems these drones provide. I can see that a toy drone without GPS and NO safety systems in a park can cause a risk to children and even adults. I brought a Holy Stone children's drone about the same size as the Mini 2 but classed as a toy drone, but as far as I am concerned collisions are more inevitable with people than my Mini 2 would be. Agree with what you say. VLOS is important, but a drone like a Mini 2 flying across a 1000m long field with unaided VLOS and setting the drone to RTH at a correct height, the drone will come back with signal loss or a press of the RTH Button. Pilots can rely on systems, so why not us? Waiting for the conspiracy theory about Deliveries, I will never agree to Flat Pack Furniture landing on my head ;) 747 Landing on Auto Pilot vs a Mini 2, I'll take my chances and should live through a Mini 2 crash hitting me ..........

Sean - really helpful video - and that initial warning was really important. Just one small concern - was your studio sinking ? Couldn't help but notice that your 'horizon' was off level..LOL

Great video, as always .This, to me, makes my heart sink as it did with the Dji Phantoms all over again. It kinda feels like the CAA will put further restrictions on the hobbyist community to a point where it will become extinct and only open to professionals who do this for a living. I was considering taking some courses. But I know it will start out cheap enough, but where will it stop? I really enjoy flying, but I don't intend to turn my hobby it into a job, just to fund my hobby. I do agree with new flyers to keep close. I'm no professional, but I have shown a couple of friends who have caught the bug on how to fly and do it safely. This makes complete sense. But like others, who have flown for some years now do have an idea of what's safe and what's not. There will always be people who will do silly and stupid things you can't get away from that, unfortunately. But it does kinda feel like the whole community is paying for those actions of the few. I just wish the CAA would have been clearer and honest with their intentions. You, Sean, and others have approached the CAA over the years, and a lot of the time, they have been as clear a mud on a lot of issues. And when you guys have pressed them in conversations, we have a clearer idea of their terminologies and intentions. Only for them to change their decisions again. I just wish they would they would set out some clear guidelines and stick to them. Maybe even proper courses / licensing for the novice and intermediate in the hobbyist community like DVLA set out for bikes or cars using the provisional licence and so on. Or be completely honest and say we are scrapping the hobbyist. So we all know what we're doing or supposed to be doing. Like others feeling disappointed as I've spent a small fortune on the Mini 3 Pro, and now I'm seriously considering putting it on eBay. As of right now, I know nothing is set in stone with the CAA and until such time as people like yourself, Sean, or others are working for the CAA, it will always be a bit messy in its actions and the community will loose interest. It's already started again. It's a shame. It really is. I would be willing to pay for further courses if they were affordable and would guarantee that my flight restrictions were of a reasonable manner. And I don't mean flying a kilometre away from myself. But to be honest, like most, I don't think I could afford a GVC course or wait another year and watch my kit devalue before me. It's disappointing. But if you can offer some avidvice I'd be very grateful 🙏

My main issue is, do we really NEED the CAA regulating a plastic flying toy?🤔 Sure manned aircraft, I get that, hot air balloons, definitely, micro light aircraft absolutely, paramotors of course they should (they're not though) and larger commercial drones YES! But plastic flying toy RC aircraft, being flown recreationally, is their really any need?🤔 Has there been any safety concerns or issues in the well over a decade of us flying them? RC aircraft in general have been flown for decades, again without issue, more or less self regulated. Would the DfT put the same regulations and restrictions on RC cars and off road model buggies? No of course not, that would be absurd. Can you imagine little Johnny getting his first RC car for Christmas and dad having to go online and get an operator ID for himself, pay a fee and get a Driver ID for little Johnny, who also has to sit an online test to show he's competent to drive his toy car around the garden or park safely⚠️😳😲😁 It just boggles my mind we have to do exactly that nonsense for a little sub 250g plastic flying toy that has all the potential danger of a rolled up piece of cardboard. 😁👍

I think you have lost the plot. The old RC aircraft operators are a different breed to todays dronies. They like real pilots enjoyed the privilege of being able to fly. Drone pilots seem to have a sense of entitlement (it’s the norm these days I suppose) that they can do what they like. The sheer proliferation of drones being operated Willy nilly creates the issue where regulators feel they need to step in. The drone community needs to wind its neck in somewhat and understand that in aviation, the regulators are on a hiding to nothing. Too often they get accused of acting too late. In reality many of todays regulations are written in someone’s blood. So the regulators, when they try and get ahead get criticised by people with 10 minutes in aviation. A drone even a small one can cause enormous damage to an aircraft, you only have to see what a bird can do.

I personally have been flying RC aircraft for decades before I got my first drone, I remember watching my grandad building model planes, gliders etc and adding RC components and flying them, my dad also took me flying his models, so I had a good grounding in safe practise decades before drones came along. So I have a little more than '10 minutes of flying experience', as you suggest. I'm fairly sure I'm not the only drone pilot who has followed that path into the hobby. To state drone pilots are all 'entitled', is completely without basis. I do all my safety precautions, pre flight checks and risk assess every flight, like I'm flying a Boeing 737, with my little sub 250g plastic toy! 😳😲 This 'proliferation of drones' you mention again is without basis. I can honestly say in the last 10 years since I first saw a drone flying in a park, I've seen 3 others, not including the times I've flown with my flying buddies of course. The drone community doesn't need to 'wind it's neck in' as you suggest, the RC aircraft community needs to accept drones are here to stay and only going to get more popular, we need to work together, as a combined force we have a louder voice, divided we're less likely to be listened to... As for the authorities having to step in or being accused of acting too late, by all means let's have them step in if there is a justified reason or safety concern or a drone has caused a death. Have they done any risk assessments, where is the data that shows drones are dangerous? As it stands a sub 250g drone is subject to more regulation and rules than a paramotor in the UK, yet on balance a paramotor is far more dangerous, how many deaths or serious injuries are caused by them compared to drones? Why have the CAA not stepped in, surely even one death or serious injury is far too many? My point is very valid. Yes of course a drone is potentially dangerous and there are idiots who fly them, just as much as there are idiots who drive cars dangerously or ride bicycles recklessly or even pilots who fly aircraft dangerously, there was a well known youtuber who ditched his aircraft for views and clicks recently. There are airline pilots have also ditched their aircraft deliberately. Like you agree birds are just as dangerous, we have far more unregulated birds flying around than regulated drones, how many bird strikes are there that result in an injury or death compared to drone strikes? Where is the balance or proportion? I'm all for having sensible, proportional regulation that increases safety but why over regulate when the data says there is no valid reason? Over regulation just has the opposite effect, it causes pilots to be less likely to comply in my honest opinion!

Speaking of flying ranges...anyone kno what Id need to get my Avata to maintain good transmission between drone and goggles 2 or its Motion Controller, when flying through thick trees, beyond the 150 or 200 meter range [on my own rural lands]? That range is where transmission weakens severly, the HD bars go 1 and then red, and vision is lost or very delayed and confused. We have "Wifi Range Extenders" for our internet range, is there some similar device i could rig for the Avata and its goggles 2? I need to go to about 350 yards thru trees for my purposes. Any suggestions would be appreciated.

Pretty sure that "the flight path in relation to other aircraft" would be legally interpreted as you needing to know the orientation of your drone (hence the CAA's interpretation of that)

The recipient that this comment is referring to is CAA and NOT you Sean. VLOS : Meaning that it's ok if the drone goes down, for any reason, as long as you can see it going down 🥴!!! If the drone crashes either in front of you or a mile away, still ... will crash !!! Along time ago I was flying my cheap lightweight first drone on my neighbourhood and for no reason it flew away (probably from wifi interference), I was no more than 30 meters away but still I couldn't do anything to bring it back, since then I have bought another four drones and every time more and more technologically advanced. Since the beginning I got my flyer ID, along with the Operator ID (of course) and thinking about getting the A2ofc license as well, so instead of enforcing VLOS, wouldn't be better to encourage people to get better equipment and the necessary license so they could have a better understanding of the their surroundings, to enjoy the hobby but also the responsibilities any drone flyer has to keep THIS hobby safe for everyone ?

I've purchased red and green strobes. With them, the Mini 2 is 249.99999g! I haven't tested them yet but, with a green on the starboard side and red on the port, I should be able to tell orientation just by the lights, as well as providing a valuable safety aid. Then there's all the other aiding factors you listed. Quite how far out this VLOS will be, I don't know but I very much doubt it will be over the previous 500m limit.

This is what I've been thinking, if my visual feed fails then I can still use the telemetry data provided however if even that fails then that means I have no control over my drone, it's a fly-away and that's worse than not keeping VLOS and an entirely different issue. However the controller would still tell me the last location of the drone so I can call it into ATC.

My latest build has led strips on each arm 1 strip ontop one on the bottom and on on the front of the front arms and rear of thr rear arms. I have red for both rear green for front right and blue for left front plus my arm guard bumpers are matching those colours certain colour orientation give obvious orientation for my spotter who has very quickly picked this up

But I honestly believe they need to have separate rules for licence holders a2 gvc etc otherwise they are holding the uk commercial pilots back severely 😔

The whole question of VLOS needs to be reviewed. I get the reason for it (avoiding other air traffic) but I believe it is overly restrictive and (in the case of FPV flights) probably unsafe. @geeksvana you are 100% right, if the flight systems fail your drone is doomed anyway. The best you can hope for is a controlled landing. I would argue, that in A3 airspace the requirement for VLOS is unnecessary, because an emergency landing should always be possible without consequence to people or property. I would also argue (as an FPV pilot) that I have far better spatial awareness from the FPV video feed (which covers about 160-170 degree FoV) than that of a spotter. I have better visibility of people and obstacles on the ground and as good if not better awareness of the airspace. I also have the exact same auditory feedback as the spotter. I would contend, therefore, that in A3 airspace the VLOS requirement should be completely removed.

Sean I fly FPV Quads under the Article 16 Authorisation and I don’t have a camera drone of any sort (ie DJI etc etc) But I am confused by this definition of VLOS 🤔🤔 I can see that you fly and position position your aircraft by VLOS over the area you want to photograph. However once in position you are surely now flying mostly by viewing your screen or monitor ! So at this point you are no longer really flying VLOS I am confused 😟Can you please clarify ?? It is not an issue for me personally but I am interested to know Just a point but when I fly my fixed wing traditional aircraft (not FPV) that is 100% VLOS !!!

I always try to use a spotter who watches the drone and the area around it if flying a Mini. The biggest problem is looking down at the screen and then having to spot the drone again even if it hasn't moved. Not a problem with Phantom size or above drone. I'm not really a fan of using strobes except at nighttime as I feel they draw unnecessary attention to the drone. Normally people don't even know a Mini is overhead.

I avoid looking at the screen by using Litchi. It has the ability to SPEAK the relevant screen info through the speakers of your mobile or tablet. I use an iPad mini4, which is ideal. I set the speech in Litchi to report every 30 seconds, so am always aware of height, speed, distance, etc. without viewing the screen. Hope this info is of help.

I understood, from another of your very informative videos, that if the police approach to speak about your flying, you should land the drone then engage with them. If you do this then how can they prove you could not see the drone or its orientation? Cheers for all these videos. In my conversations with national police, they confirmed that an officer would only ever investigate etc based on legislation. So the orientation should not be the focus as this is only guidance from CAA rather than law. We have a new police Q&A being recorded in 2 weeks and this is one of the questions we cover. Hi sorry to bother you but I am so confused about everything. I am a mountain biker and I have been happily flying my Mavic Air 2 in the open country for the past 3 years. I have a flying ID and an Operators ID. I would like to upgrade to the Mavic 3 Classic and fly it in the countryside as before. It is on sale with lots of retailers in the UK. But having watched a previous video on your channel it appears that this C1 drone has now been banned. Why is it therefore still on sale? If so will a Mavic Air2s be legal. Cheers. Stoozer.

Hey Stoozer! The only part of the Classic or any other C1 drone that has been stopped in the UK is the ability to fly it in congested areas and very close to uninvolved people. So the Mavic 3 Classic is essentially the same class of drone as your Mavic Air 2. Perfectly legal to use as a legacy drone and I think it would be perfect for your described use. The camera is amazing!

I feel exactly the same. I've owned my Mini 3 Pro since October 2022. I have similar fears that affect me so much that I'm seriously considering jacking it all in and selling my drone after only flying it a few times. All those drone associated Christmas presents along with it.

I own a mavic mini 2 I dont see why fpv is a problem as long as you follow the camera's direction and not move side ways and backwards ive been flying for hobby since 2015 if not i don't see a point of owning a drone in the first place if you cant fly it anywhere

Strobes can be used but when discussing VLOS the AMC (which the CAA tells us sits above 722) states strobes alone cannot be relied on for VLOS.

I use my drone for photography, so I mostly fly up to the height limit and then film around or tilt the camera down, I can see the drone on my large Ipad and VLOS. If I see any aircraft low in the area then I land, most of this is common sense, like driving, I get myself one step ahead, being aware of any people who may set up a picnic on my landing zone, it is very important to be aware of what food they have, I don't really want to land my drone on their chocolate cake, that would be a messy waste, I also wear my Hi-Viz to reduce those Karens and Kevins, who try to distract me, my Hi-Viz makes things look a bit professional especially when they see I am a drone pilot with CAA approval, just enjoy what we deserve safely and be mindful.

I’m a newbie to flying drones, only obtaining it tomorrow. However, how would the CAA know if you aren’t following the legislation? I intend to as much as I can follow the rules though. If I a accidentally fly close than 150m to a residential area, who would know? And how do I actually know that I am 150 m away?

You would have to use your judgement and common sense, and estimate the distance you are away. In the end, everything comes down to pilots behaving responsibly and exercising discretion, as they always have done as evidenced by the excellent safety record over the last decades. The CAA's arbitrary and capricious rules only get in the way of pilots thinking for themselves and don't solve any actual problems.

What's the general view with any 'automated'/assisted flight with the CAA? Waypoints, RTH, follow me. My view is, the CAA will deem these flights as 'pilot out of control'; orientation/VLOS.

With regard to VLOS, really loved the content but I do feel some consultation needs to be had with the CAA. I’m not saying I fly outside of the permitted rules but those rules are very frustrating to say the least. I’m not sure exactly what kind of manned aircraft the CAA expect drone pilots to come into contact with as no manned aircraft should be flying below 500ft agl full stop 🛑 unless in exceptional circumstances or have been granted permission by the CAA. I generally fly between 50-150ft so again wouldn’t expect to have contact with anything. Also being a qualified pilot myself, I kind of can’t see the difference in flying an aircraft and flying a drone like the DJI FPV. I can generally see everything I would see if I were flying an aircraft and also with that in mind am more aware of my surroundings etc when flying anywhere. If you were unsure you could stop, hover and rotate around to have a good look out before continuing. I generally fly under the Article 16 rules being fully licensed and insured too. I completely understand if flying in a built up area but flying in the open areas is ridiculous.

Minimal danger in this imho. But I will get crucified for this. I quite enjoy flying over ocean. But....check Flight Radar 24 just ahead of every flight. Then again I am in Ireland not the UK and where I am flying it's only Rescue Helicopters and the very odd GA flights which all show up anyway. If they are not around then what's the problem with a short pre planned flight. I think the hobby is doomed.

I agree with your interpretation. Remember this, there is a burden of responsibility on the prosecution to prove that you are guilty, not for you to prove that you are innocent. Unless the drone is behind a building or way out of sight, it would be the opinion of two different people and the AMC that the Magistrate or Jury would need to consider. Having spent significant time on a Jury I have tell you first hand how difficult it would be for 12 people to reach unanimous verdict when two opinions are in question. How can you prove what someone cannot see?. I doubt whether any VLOS case where the orientation is in question would ever make it to court. Unless you plead guilty of course.

Have you been in a magistrate’s court? They don’t care about evidence or proof, they just side with the police/CPS 99% of the time.

@@DMC888 I spent 4 months of my life on a Jury, I am not a barrister but it gave me a reasonable understanding of how our legal system works. The police/CAA will be seen as an expert witness but they still have to prove that you are guilty. How do you prove what someone can or cannot see? The fact that you end up in front of a judge in the first place means there is a reasonable case against you. The CPS dont spend tax payers money on cases they wont win.

@@matthewdray83 the difference is the Jury, I’m talking about a magistrate’s court. Where a person with often no legal training gets to decide your fate. In this place the word of a police officer is worth ten times as much as the defendant.

@@DMC888 Yes this is true and i agree there is likely to be a bias because the statement of an expert witness is likely to be more credible. The sad part is that justice often relies on your ability to pay for it in terms of legal representation. But that doesn’t mean that rights are any less

Where do you stand (And therefore do you also thing the CAA would stand also...) on extending a flight distance using TWO OPERATORS? For example a drone such as a Mavic 2 Pro or Inspire that supports two controllers, and two operators. Using your shot example of Stone Henge, Could one operator be on one side of stone henge and the other across the way directly opposite. Operator 1 can see the drone up to a point and using communication, operator 2 could take over when it's past operator 1's VLOS and enters Operator 2's VLOS. The battery and distance would not be an issue either as the drone could be taken off from one side and landed on the other. The drone has been in line of sight at all times by an operator in control. I do understand that you can't simply have VLOS spotters every 100m and therefore have line of sight.. the line of sight is meant to be at the operator not a spotter. But in the case of two operators, this would be the case. but a handover of Line of Sight.

This kind of operation is possible at the moment but it would probably require an Operating Safety Case (OSC), from the CAA. That sits above GVC/OA and gives more specialised permissions for operators. Many companies have a lot of very useful OSCs in place that allow them to fly EVLOS with additional spotters etc. It is possible but it is not cheap.

@@Geeksvana Thanks. But like you said in your video, the wording is open to interpretation. If the operator has VLOS up to a point and then the other operator also has VLOS at the handover (overlap) then they become the pilot and fall well within the operating rules of the CAA and if operator 1 never gets control again, then the ownness is on operator 2 to control the drone under the guidelines and land it accordingly.

@@rabbitracinguk that type of flight would no longer be under the open category and would require an authorisation. So the interpretation issue is not relevant. The issue goes beyond one of vlos.

Network Rail (UK) claim this in their website: Only authorised Network Rail pilots and specialist approved contractors are permitted to fly drones near the railway (when conducting railway related drone surveys) having been granted a qualification from a training organisation approved by the Civil Aviation Authority (CAA). How is this the case when apps do not limit drone flight near railways?

Exactly you are prosecuted under the law not the guidance. But not sure the judge has the capacity to take in all of the regulatory arguments and would just lazily Rule within the CCA guidance.

To me, vlos doesn't necessarily mean being able to actually see the drone, but to know the area, know where your drone is and be able to see the airspace around your drone with no obstacles in between you and it. On an overcast day I can still see mine over a km away perfectly safely.

@@Geeksvana I very rarely fly in built up areas, even with my mini, its mostly on the coast or open country. If ever there was a helicopter or something I would hear it long before it became a problem too. Totally agree with what you're saying, especially regarding experience. 😊

It seems rather stupid that I can fly a Mini 3 above my house safely and within the drone code, but if I fly it 150m away over the sea I am not! They need to amend the rules and start to recognise different drones have different capabilities. A mini 3 at 1km is far safer than a toy drone at 120m straight up because of the control system and sensors. Planes/pilots have this differentiation so why not drones?

I have only had my drone for a few months but I am already thinking of selling it as I can only see things getting more ridiculous and the hobby being regulated beyond practical use.

Not saying you are right or wrong. The only thing I will say is if you are going to push the law to the limit you need to be extremely careful you don't go beyond limits. The penalties for doing so especially if something goes wrong can be surprisingly severe. So, what's the limits? Well, we are going round in circles here aren't we.

Realise this reply is over 1 year since the original post. My understanding is that RID is not ATSB and doesn’t communicate with other Aircraft/Air Traffic control, and that the information from RID is only accessible over an internet connection.

I fly my drone within the law but even still my partner is on our local Facebook page and people are still saying that who ever is flying there drone is a burglar and using there drone for criminal activities basically chinese whispers but what I'm getting at is that although it's a brilliant hobby and definitely great for aerial photography I definitely think our government and the caa will end this in the next 2 years here in the uk I.e a drone was flown over a football game a couple of days ago so with the misuse of this and being on the news I can surely see this not lasting that long. But I will keep up with your channel because I know your in the know but remember change your channel to radio controlled cars in the future lol 🤣🤣 😁👌👍 🇬🇧

Something Which helps with VLOS. Instead of being lazy and flying your drone 500,1000, 5000 metres away. Where possible.Take your drone to where you want it to fly and take off from there. I.e. move closer to what you wish to photograph or film.

Sounds easy to do but it's not always possible to get very close to the feature you want to fly around, due to the local environment and site access etc.

@@pdtech4524 Yeah its a bugger in those situations. Just got to keep doing our best, and innovating where possible. Id feel certain, that unless your being reckless and negligent, the chances of coming up on charges would be slim. Id probablystatclear of spitfires if possible.

@@Geeksvana The only reason the CAA and DFT are getting away with what they are doing is because we are saying YES to it, I was also dismayed at the amount of pilots who did not under stand VLOS constantly flying way beyond it as routine, Get your strobe lights and wraps out its the way forward

I'm in the 'just say no', camp also and have been from day 1 when registration was first put out there as a little teaser of things to come... I said, no don't do it, it WILL get worse, MUCH worse and far more restrictive, far more complicated and convoluted. Oh no it won't said the community, let's be reasonable, it's only an online form, takes just a minute and what's £9 surely no issue, right? Flyer ID DEMARES pah easy peasy, let's all jump through the hoop! Like sheep everyone did and the next hoop and the next and so on and so on.... Until here we are and I'm just saying, I told you so!😲😳😁 It's just getting so ridiculous even the CAA are tripping themselves up and don't even understand their own rules!
