The plaintiff says the defendant, her former landlord, refuses to return her security deposit, so the plaintiff is suing. The defendant claims the plaintiff left blood on the walls and destroyed the refrigerator, so he denies owing. He is countersuing for unpaid rent, labor, and lost wages.

Most places will prorate so people just assume that's what happens. Everywhere I rented if we moved in early or had to stay a few days, it was prorated. But I always verified with the landlord first.

my maternal grandmother was a landlord, and my father was also a landlord. My father was lucky with his tenants, but my grandmother always got the worst scum and would always have to go to court. What a nightmare.

A simple Google search, instead of assuming she was right (or watching the show) would have told her. In addition, notice needs to be in writing where I live (do it in a way that can be proved, preferably an e-mail or text). I'm AMAZED at the number of Americans who think they can actually say, "Just charge me for those extra days." If you think you might go over, get it in writing from the landlord that it's okay, and you won't be charged another month. I remember when I wanted to leave a lease early (it was not a good fit), I got the landlord to sign a letter I wrote confirming that it was okay, and there'd be no penalty. He tried to later say I was responsible for the entire lease, and I said, "I don't think so!" The one other time, after getting permission, I subleased it quickly by giving away my last month's rent.

I Would be humiliated if any land lord or any human saw my bathroom or kitchen in filthy conditions. The land lord needs to learn to document his damages. I would have given the lady $500 ding. Sure 'nuff judge called it. $575.

how can holes in the wall be wear and tear, I say leave the place in the same way one gets it, even after 5/10 years,if the home is painted out and clean when moving in , then see to it is in the same way when moving out, carpets I agree about wear and tear, my contract says I must leave the place as is in when leaving, my landlord had repainted the whole flat just before I moved in, so I'm going to repaint it when I leave one day, I have my pride,

🤨 How is it that grown-up renters don't understand how rent is assessed? Tenant laws are listed online FOR EVERY STATE! If folks watched even a few People's Court episodes, they'd be far better educated about leases. (🤭 The landlord did seem like an arrogant jerk. I'm sorry he won any money. Expensive lesson for the lady😕.)

Show pays it, so not really. I don’t know if the judge sticks to the law in whatever state they live in but in many states, that law varies, and is different, so I’m not sure which law the judge applies and for which state when making a decision.

@AllHailKingRose I always wonder about how payments occur on these shows. As for different rental laws, you'd think all would know that info is at right at their FINGERTIPS! Our cellphones have sooooo much info, and it's so easily accessible. I'm 63, and I'm on my phone for info constantly. I'm shocked younger generations don't do the same. Great comments 👌!

Not many are aware of that but that’s the incentive for taking the case to tv. I wonder how they vet the people that know that and aren’t just making up a story so they can split the money.

The Landlord had no physical proof of pics of damage from the Plaintiff. He held back too much of her security. The holes in wall was her fault.

Thought judge came from a construction family. You can't just touch up paint in spots and expect it to not be discernible. Need to paint the entire wall. Would her family members volunteer to do the job for $100?

I don't know what state she is from but I wish she had looked into if she could double or triple the deposit if it was wrongfully withheld because that might have saved her and made it to where he actually owed her money, he did in fact wrongfully withhold a lot of the deposit for things that he had absolutely no proof of or right to do so! I know he has to intentionally have wrongfully withheld it but in this case I do think he wrongfully withheld it, he knew that he had no proof of the hinges on the door being off I actually think he made that up just to withhold more money or for instance the igniter on the stove he saw no physical damage but pinned that on her! I wish she had given proper notice because then she would have walked out with money.

Hey JM, You've been a tenant and a landlord--- & don't know about prorating? I think I've never moved in on the first OR moved out on the last day of the month-- and nobody has ever complained. Did prorating slip your mind? (The plaintiff is right and you're incorrect. The manager wants a place occupied as soon as possible-- and there's no law about that!)

Somebody math not mathing or I misheard which is 100 percent possible. But how would she owe him 575 if he was allowed to keep 437 for rent and 100 for damages. Out of 2625. That means he owe her 2088 minus the 1350 he already gave her equaling a total of 738 more that he would owe her. Please correct me if I'm wrong. Respectfully 🤔

Hi. You would think, right? I guess it depends on how the lease is written. Many places don’t allow holes in the walls, including (of course) hanging tvs. I think there’s a point where normal wear and tear turns into too many holes requiring a LOT of work to spackle and repaint. Take care!
