The plaintiff alleges that the defendant knowingly sold her a damaged dining room set, so she’s suing the defendant for a refund. The defendant claims the plaintiff’s boyfriend picked up the dining room set using an SUV and scratched it during transport. The defendant denies owing anything.

if you’re going to drop 2k (or any larger amount of money that you can’t afford to lose) on a used item that you’re buying directly from another person, you should go to get it and see it yourself. any attorney or human with two brain cells would know that. she gives off the vibe of someone who thinks they’re smarter than everyone else just because they went to law school

Plaintiff says "you don't understand the uniform contract code and I'm also an attorney". Um, what the hell is the uniform contract code? As an attorney, you should know it's called the uniform commercial code, and it applies to merchants, which the defendant is cleary not....hopefully the defendant was able to get her $400 counterclaim for legal expenses - they didn't mention it at the end.

@@travis8665 Then the plaintiff should have gone herself to pick up the set. When the husband accepted and paid, he agreed to the condition of the set. They have eyes and could see for themselves so thr defendant didn't rip them off for damage in plain sight.

She could have asked the defendant to FaceTime her specific pics of the table, but she did not. She corrected the judge on her own show like she knew better, and even called the Act she was quoting from the incorrect name. Ah, arrogance will not get her far

@@AP-xw5px She was arguing with the judge as if she's been in law for 20+ years instead of JM being the one to be there. I work returns at Walmart and this woman reminds me of those that believe that they can return something bought 2 years ago despite the 90 days our sign says as if the rules don't apply to them. They will even go to a different associate at the returns in hopes of getting the answer they want.

@@sammylove7211 not true - in order to be "considered" a lawyer one must pass the bar. You can attend and graduate law school and never be a lawyer if you are unable to pass the bar exam.

@@ThePracticalDog that is only half true there are only four states that allow you to skip law school in exchange for an apprenticeship (California, Vermont, Virginia, Washington) other states like TX require four years of undergraduate school and three years of law school. Law schools generally require a bachelor's degree for admission.

But one still needs to pass the BAR EXAM in every state before practicing law or being a "lawyer", which was my reply and point from the start; and your little factoids don't negate that.

Interesting the plaintiff is a lawyer but believes the UCC applies to private sales? I think she should look in the definition section and specifically the definition of "merchant." Private sellers are not "merchants" with specialized knowledge who's occupation is selling whatever is being sold.

She embarrassed no one but herself by waiving the UCC around. I guess she at least has the defense that she doesn't practice commercial law (she's easy to google). That said, the UCC obviously doesn't apply to private sellers and even if it did, she had a reasonable period to inspect---when her husband was there picking up the goods. Even a merchant can dictate that all sales are final, as long as they give you a chance to inspect it before the sale is complete (as was the case, here).

The couple lied. The wife said the husband would have loaded it carefully bc it’s a gift to her and then a minute later he gets on camera and says his wife restores furniture like a side business. She was she reselling it or keeping it. Maybe I misunderstood.

If she was so sure about the "contract code", she would have understood it doesn't cover a private sale. Plus, the code doesn't apply here, as she would have to prove the scratches made the table totally unfit for use. SOMEONE definitely doesn't understand the code and it's not the Judge.

Moral of the story- DO NOT TRUST SENDING A MAN TO PICK UP ANYTHING YOU HAVEN’T INSPECTED YET! Secondly- I don’t know how long that marriage will last cause he definitely don’t know her or her standards to even call her before leaving with it 🤦🏽‍♀️🤦🏽‍♀️. Last-she needs more law school cause ma’am, private sales don’t have the same privileges and protection as retail company sales. Once you’ve completed your purchase and walked away, it’s over!

He made her look stupid, amidst making herself look stupid. He paid the lady & left with the furniture. And didn’t even send pictures to her. No calls or texts to her. Second, I’m not a lawyer however, I know more about law than she does. I knew the answer to the verdict that she was going to lose before 2 minutes into the case. And it’s ‘commercial’ not ‘uniform’. The lady is not a merchant. It’s a private as is sale. And her husband doesn’t apparently know what she does as a hobby. I doubt she let him live after the case.

Restoration hardware is pretty pricey honestly. Most of their dining room tables (just the table, not even the full set w/chairs) can run 5-6k. Also I’m sure the set the defendant was selling had some added “value” being that it allegedly was no longer being produced/sold by RH and was difficult to find that particular set being sold anywhere and it was branded as “vintage.” Idk if I agree that it would be worth all that money, travel, and effort especially when it wasn’t even in perfect, brand new condition lol but hey to each his own I guess 🤷🏽‍♀️

It would have made no difference. This is arbitration, but they apply the same law. Arbitration is faster but you're agreeing to the finality of the outcome outright. No appeals.

The plaintiff is so full of crap. She tried to replace the truth with a nonsense story. I can't imagine it's a great marriage. The second she decided she was better educated than JM she destroyed her integrity. I hope people see the plaintiffs inability to interpret the law before they hire her services. There are some really bad attorney's out there.

Unrelated to this case: RH does have very unique and amazing furniture and designs, and there are different designers who created these unique pieces. However, my hubby recently worked for the owner/CEO's restaurant, RH Guesthouse, and the owner has a residence there and was there a lot. Him and the staff he hired (managers and other higher ups) are classists and a bit racist. Beautiful restaurant but horrible food. The restaurant doesn't have a liquor license. Anyways, we were going to purchase some furniture from RH since my hubby had an employee discount, but, of course, we decided not to support the company.
