It is an offence. The offence of criminal damage can occur even without any damage if the threat is made. Aggravated criminal damage is also possible since a gun is mentioned. And the mention of the gun as a threat also breaches gun laws. And the highway act as it's an offence to use a gun within 50 feet of a highway.

Generally real (legal) gun owners do not shout about having a gun and what they are going to do with it, and threats like that could see them removed and never returned.

1:43 - Claims he does have a gun and will use it. Should have called the police at that point. 12:41 - Admits to the police call handler, on a call which they themselves record: "I did say I would shoot the drone down even though I don't have a gun". 13:38 - Claims he now doesn't have a gun and that he was llying and that it was obvious (it certainly sounded real to me when he said he had one). What an idiot. He did it to cause alarm and distress to the photographer.

Section 240 of the Air Navigation Order 2016 makes drones aircraft and threatening to shoot down an aircraft is a crime, even if you 'were joking'. Try going to an airport and joking that you're going to shoot down an aircraft and see how funny they think it is.

He threatened the use of a gun, he can joke about it afterwards, but that's not how 'threats' work in law, you don't get to intimidate someone out of their rights, or money or property, by threatening violence, or force . . . and then later just brush it off as a joke, the threat was made, I would pursue that, at the least report the threat, it's no different to someone threatening to shoot your car if you drive down a public road.

David Zanetti really ought to think on what a poor representation this is of the business he is MD of. Phil and Paola should take him in hand and ask him to behave with some decorum before their family business is damaged by his lack of foresight. Had he approached the photographer in a friendly manner and offered a tour the positive PR would have been a boost to their reputation rather than this disaster.

I got one with a catapult. I upset a bad driver, so he started to wind me up, walking past the house and staring in. The drone was up 4 times in two days over my head. I left the pieces on the pavement. Not seen him since.

"no one does" "It is legal to fly over property at a height of a more than 50 metres, as things currently stand, no one owns the airspace as such. However, privacy and nuisance laws mean it is not legal to film a private property without the owner’s permission or disturb them from the ‘quiet enjoyment of their property’." Since he claims to be 100% right, I'd have invited the guy to put money on it. "Ok, let's go to a solicitor and draw up an agreement. If it turns out that I'm breaking the law, I will pay you £50,000. However, if it turns out that I'm within my legal rights to fly this drone over your private premises, you will be legally required to pay me £50,000".

Just to add, he admitted to the call handler that he threatend to shoot it down despite not having a gun, im guessing to "absolve" himself of a crime but in doing so he literally just admitted to making a threat of violence. It doesn't matter if you have the means in the eyes of the law. I don't think he realizes what a numpty he was there..... I mean, that was recorded if charges were ever to be pushed on it... Some people really need to learn to just mind their own and stay inside....
