Police came to my door and requested to search my Car. I said no and they said they would get a warrant. I said OK I will wait. They shined flashlight in the Car and left. Never saw them again.

You dont need a lawyer just go put on public notice something say non military service then a the judge how he had jurisdiction over you and the land. That's there case gone if its non violent

Thank you for the information , I wish I knew that 4 years ago! At that time I had never been in trouble for anything not even a speeding ticket at 48 years old, but one night while shopping in the next town over I got pulled over on my way home , I got arrested was scared to death because I have never had to deal with anything like that and was clueless on what my rights are, lucky they had to throw my case out because it was and unlawful stop and illegal search, I did not give them concent to search my car but proceeded to do so. I was lucky, but all the money that was lost, plus I was treated horribly I now try to educate myself about things of this nature. Thank you for your channel!

Agreed. I was put in handcuffs and taken to jail and i had no idea if i was actually being arrested. Was never read my miranda rights or anything. I received an affidavit completely lying about my behavior but i was forced to plead guilty because the guy who got arrested with me was in trouble for worse (drunken behavior outside a bar) and they wouldnt separate our cases. It was all so confusing and i felt powerless against the police.

In the UK, my dad was falsely arrested in 2015. The police told him ''you have the right to remain silent.'' this is basically a way for the police to strip you of all other rights you have, other than ''the right to remain silent.'' The second the officer told my dad this, he simply said ''i object''

There was a case where the defendant was arrested for violation of probation. He figured he would skate and hired his own Lawyer. He poor sap got 2 years in jail. I was the Court Jailer and he asked me, "What happened?". I told him, "You hired a private attorney who makes more money than the DA or Judge". I said, "Had you gone with a PD, you probably would have gotten a couple of years of more probation. You pissed off the Judge and DA". The was a guy booked for Domestic Violence were bail was $50K. I gave him his phone call and heard him tell his parents to get a bail bondsman. I asked the guy, "Have you ever been arrested?". He said no. I said, "Can your parents afford $5K because that's the fee the bondsman will keep". He said no. I told him, "If I were you, I'd sit in jail until Court. When you appear with no record, you'll be offered deal to plead to a misdemeanor and Anger management. Then you will be released if there were no visible injuries". The guy told his parents he will sit in jail until Court.

Sadly many Americans don’t know how to remain silent after they get arrested. I’ve watched many Live PD videos and people chat and complain and confess after they get arrested. I watch those as a learning experience so I can better prepare and not make the same mistakes they did. I have Aspergers, and I think it’s critical that law enforcement is informed of my disability.

Who would inform them? Why would they believe you if you informed them? A doctor’s note would be after the contact with police. Even with the disability, you would still need to prove your statements to the police were involuntary.

Spot on advice. Keep your mouth shut, the police know who you are and where you live. If they ask where you were on a certain date, what happen, who else was there, why you allegedly did something keep quiet do not answer their questions. Never answer police questions, especially if you have done nothing wrong or witnessed something awful.

So you ask them to list it down for trial while you’re pullled over and do you request the radar certificate while your pulled over? Or are these things you ask for lawyer or P.D to do?

Your advice is good, but my issue is when police show up unlawfully what is your duty as a citizen who is supposedly free. This is actually a noticeable event with police stations conducting investigations, and in some cases brutally, by having the wrong person or having the wrong house. this only covers you if you have reason to be guilty.

How do you know if the cops are there illegally? Just because we think their contact is illegal, does not make it so. My advice goes for the innocent and the guilty. Keep your mouth shut and do what you are told. Let your lawyer sort things out later.

If you know for a fact that you've done nothing wrong for police to come to your house and your door is blown apart and guns are shoved into your face while men are screaming at you to get down and not move. While your children are being man handled and guns shoved into their faces and the best you have is to shut up and do as your told until when. Until you have the money for a lawyer to sue, or when your head is blown off your shoulders or maybe a bullet to the kid would make your case that much better. The initial contact of police is always in question yet lawyers and judges just let the shit happen. Just let the cops run all over you whenever they want. Before I was 16 I was in more home raids by police than I was years on this earth, ive been shot twice by police before I was 10 years old and yet those cops are or were still cops up until a few years ago. Ive never been able to take these men to task hence my question. But tell me some more about what the fuck I should do. I've gotten nothing but shit from cops even as an adult and I have a squeaky clean record. So I ask again what do you do when cops show up to your house illegally and the lawyers and judges do nothing but help the cops?

So if you called a family member or friend to ask for a criminal lawyer, wouldn’t they need to know at least what you are being charged with to get the right lawyer? Like is it okay to disclose that over the phone ?

I wouldn't be concerned about telling a family member what crime you are being accused of. Just don’t talk about the facts. Good question!

Because what if you get stuck with a public defender for example? So should you invoke the 5th and say “I want “my” lawyer” even if you still need a family member to help you find a criminal lawyer?

I apologize for not being clear with my question, but basically I was wondering when you say to officers “I want [a] lawyer “ vs [my] lawyer” does it matter which wording you choose if you want to ask your family to find you a criminal attorney ? Because technically, couldn’t officers interpret “I want [a] lawyer as in [any] lawyer and get stuck with something like a public defender?

What are the statute of limitations on a DUI in Illinois. Says 18months from what I can find. Mind you I was on court supervision for my first DUI which I blew cause I thought I was sober..096..BS..anyway Reason..I've got trial coming up for a dui that happened Feb 17 2022. I was told by the first SA that if I stay outta trouble for a year I could receive reckless driving. And therefore I went to court every 3 months on time as I was supposed to the last court date a year later I had a different states attorney and she said that there is no deal that never should have been a deal and it is off the table and I basically have to plead out. I told her that I would like to take it to jury trial and I am currently in the process of that I am representing myself and have done my homework. I believe that they have little to no evidence and the case should be easily beat. But if the statute of limitations has ran out then there is no point in pursuing the rest of it just being prepared for it. Any advice would be greatly appreciated

Ordinarily, I abhor attorneys, however.......in this world today, police can not always be trusted. But, in regards to lawyers, an attorney has the duty before the court to provide his/her client with the best representation, and work out a fair resolution or sentencing arrangement, but it must be based upon the facts/truth! My friend was falsely arrested saying to my friend the police said he has a warrant in the car and again was arrested and friend asked to show him the warrant and police told my friend they have it at the office. Next time if they do that again dies my friend have a right to not answer the door? I my friend has a fear now of police

If the police DO NOT have a warrant, you don't need to answer the door. If they DO HAVE a warrant, they are coming in anyway.

I just found out getting summons after last night a police officer said he was towing my truck because registration revoked. My husband started a new job with union this week & I had moved truck to get his tools he needed out of garage. It was sitting at end of driveway half on street, half the driveway with keys in the ignition because I was planning to pullit right back in. When cop informed me he was towing the truck I said please don't I do not have money to get it out and he said no its getting towed. I got in the seat & put in reverse to try to put in driveway b4 tow truck pulled up. The cop pulled me out of truck by my arm while it was in reverse. Not even sure of what he plans to charge me with, but I don't know whether I should file complaint because even if he let me move the car he still could have them tow it. I think. So what was point of pulling me out of car and risking me getting hurt? And what could he charge me with?

My theory is the cop was either intent on showing you who the alpha is, or he was brutally preventing you from getting the truck back on your property, because the city couldn't impound it once it was off the public street. Meaning, you would have cost the city a revenue-grabbing opportunity in the form of fines and fees to get your truck back.

Well, before you hire an attorney you must stop talking with anyone about the case. Answer NO questions. Once you take that step, then hiring a lawyer is not such a time sensitive issue. Many law offices take calls in the middle of the night.

Especially do NOT take advice from or talk to other inmates in jail!! Police regularly put snitches in the cell with incoming prisoners who try to extract info in exchange for good time. I’ve rarely heard other attorneys talk about this fact.

A felony is a general term describing offenses that might result in pen time. A state jail felony relates to a more specific level of felony.

Invoke your right to remain silent, ask for an attorney, and shut the eff up. If arrested, you are going to be fingerprinted, photographed, but remain silent. You do not have to go to the police station for an "interview", if they show up at your door and do not have a warrant, you do not have to open the door. If you do open the door, do not go outside with them. Assert your 5th amendment right, ask them to leave. And NEVER allow them to come inside without a warrant!

How about having an affidavit of non military service and heir to a newspaper as the owner on public record? I often work in my car, home and pockets so that's an office of the newspaper. lawyers only have your trust benefits in mind

@@GustitisLaw I was sentence on an allegation that was dismissed against me by the court , during a trial , I was found guilty for raping my wife there were to rape charges however the one which was dismissed the judge sentence me on the alleged facts, and not the one I've found guilty of.

What if you lose everything in a house fire like I did.. I was told that if you do not have proper ID you can be put in jail.. and your ass stays in jail until they can find out who you are.. the only ID I have left is a social security card.. and my photo ID is melted. People are saying that it's fake it's not fake it's melted what can I do about it I have an old marriage license too..

The only problem with what this guy is stating is that if the cops follow the letter of the law and the policies and procedures of the said police force. The rights you have can be a protection but if the cops are nothing but violent tyrants then your rights are going to mean nothing. As many citizens know there are more tyrants than there are law abidding police. So your rights are akin to a raffle you may be dealing with good law abidding cops or you may be unlucky and be dealing with violent thugs.

@@GustitisLaw The solution is in the hands of all Americans they can force tangible change to policing and the justice system so that corruption and bad policing comes to a end. Of course I am realistic and understand that real identifiable change will take a decade or more. In the mean time citizens have to realise as many do that policing is a raffle as is justice. It is niave to talk about rights and a justice system that upholds your consitutional rights as if it is absolute. Their are hundreds and hundreds in prisons who are innocent victims of a corrupt justice system. But it wouldn't be America if there wasn't corruption it has been a cancer that has eaten away any semblance of a fair and just society. It has been that way since the founding fathers bought about the consitution. I personally have never been convicted of a crime and was a public servant for 3 decades I witnessed the corruption first hand and came to the realization that it cannot be eradicated as long as the majority of citizens play go along to get along this why real change is a step by step proposition and would take a decade or more. The first step is a radical change in policing practises policies and procedures and abolishing qualified immunity.

What are your rights after being arrested *Now that there's body cameras and dash cams outside and inside the car* because before there was any solid evidence or proof that a cop was being unjust and corrupt the only rights you had while in police custody were the ones they decided we're your rights, if they decide you don't have any rights and there's no other cops or clerks to set them straight or monitor their behavior your ass was grass back then thank God for body cams you can see the humongous impact they've had on policing and corruption there's a new body cam released every day of cops doing bullshit imagine what it was like back in the 60s and 70$

Let’s say you are speeding and get caught. If you get convicted of the offense, that you clearly committed, you will lose your license for 2 years and pay a huge and unreasonable fine. By your definition, you are a criminal. Do you want to get out of this mess, or not? If you say no, then I question your credibility.

Doesn't matter. Cops make mistakes all the time. Also if they just plain don't like the way you look, they can ruin your life

Shut your mouth! They already think your guilty, don't hand anything for free to a competing side. They dont care about you. I (nearly but thankfully not) got screwed over by the system as an innocent person. Whatever the case, you're aren't going to go in and make the cops unarrest you. They don't care about you, your case isn't special and you're just another criminal to them. EXPLAIN YOUR CASE TO A DEFENSE ATTORNEY, NOT TO A COMPETING SIDE!!
