Thanks for posting this, Jim! I never had denials but wanted to share my experience. They do use dirty tricks even during calls and interviews. Ex: “your neighbors said they don’t know you”, or “who are your spouse’s colleagues”. They make up stuff and throw it at you and see how much they can rattle you. If you push back, they’ll even be disappointed. So, I strongly recommend lawyering up and defending your position! US immigration has a presumption of guilt unless you prove them otherwise.

I agree, I have worked both for DoS and USCIS. So the same goes for visa denials. USCIS can go to the notes from other departments and use it to contradict your claims.

Jim, I have a video idea for you! “What to do if USCIS comes to your home with a surprise visit?”. This is one instance where even if I have an immigration attorney, I can’t call them in at 5am (which is when they usually do house visits) and have them represent me. Or can I?

If USCIS shows up and you decide to open the door and let them in without your lawyer, they will try to find any evidence against you. They are not there to help you. They are usually there to say that your husband wasn’t there or that they could not find his belongings. And conclude your marriage is likely to be a scam in their report. Always tell them you are willing to cooperate but you need your lawyer present. They can’t write “fraud confirmed” in their report just because you wanted your lawyer.

I have a similar problem. I filed for for a fiance visa in 2018 for my girlfriend at the time, she lied during the interview then got denied, She got pregnant by another man in her country afterwards so I quit trying with her and decided to marry a different woman that I have been knowing longer. We got married in her country in 2019 and the had the interview at the embassy in 2021. Of course they questioned the both of us about the previous denial about the other woman and then they sent me a letter claiming that me and my wife only got married to circumvent immigration laws so they wanted more evidence of a bona-fide marriage. I sent them all the evidence and they received it and I haven't heard from the USCIS about making a decision on my case since and it's about to be a year and a half since I sent the RFE
