Hamdi v. Rumsfeld | 542 U.S. 507 (2004)
In reaction to the September 11, 2001 terror attacks on the United States, Congress passed the Authorization for Use of Military Force, or AUMF. The AUMF granted authority to the President to use all appropriate and necessary force against people suspected of engaging in terrorism against the United States.
U.S. citizen Yaser Hamdi was arrested in Afghanistan in 2001 and turned over to U.S. military forces. Hamdi was taken into custody as an “enemy combatant,” on suspicion of affiliating with al-Qaeda. U.S. military personnel interrogated Hamdi, then sent him to detention centers in Guantanamo Bay, Cuba, Virginia, and South Carolina. At no time was Hamdi charged with a crime, provided legal counsel, or afforded the opportunity to contest his detainment.

I am in a situation where I am being told I am going to have to go directly to prison without due process. It’s extremely frustrating and scary. I don’t know how valid The law enforcement agents R in this case. I have not received any thing in writing just threats. So if any of you hear about a Big case in Overland Park Kansas you will know that they move forward with it. I’m also scared that there will be no public record or news coverage. The alleged crime they say I committed I have no memory of so I feel like I am an innocent man waiting for the day they arrest me.

The problem is is actually the “War on Terror” not actually being concrete.

What the F is a war on terror? Any war has to be against a known enemy combatant, or an organisation of some sort. A war on terror means that they can wage war on an idea that seems like a bad idea

Why did Scalia opinion was listed as « dissenting » ? Shouldn’t it be « concurring » ?

He dissented on the opinion from oconnor, that the seizure and grounds for everything was valid under the AUMF. But Scalia in a rare instance of not being a cuck is saying that NO, He is a US citizen, full stop, thereby hes granted all rights and shuld be tried in a court as a traitor (if that is what he is) and that the only way to avoid any of the current proceedings would be to suspend habeus corpus in congress. which did not happen.
