Enoch Burke will once again appear before the courts today - but members of his family have been barred from attending.
The former schoolteacher has spent nearly 300 days behind bars in total for refusing to abide by a court order restraining him from entering the grounds of his former school.
Today he will be given his third opportunity to purge his contempt of court by agreeing to stay away from the school.
If he does so, he will walk free, if he refuses, the court has the power to order his continued detention at Mountjoy Prison.
On The Pat Kenny Show this morning, Newstalk Courts Correspondent Frank Greaney said the ball is “very much in Enoch Burke’s hands’ when it comes to his time in prison.
“It always has been in relation to these contempt proceedings,” he said.
“He doesn’t even have to go so far as to apologise to the court. All he has to do is give the school and the court an undertaking that he will abide by the court order and refrain from attending at Wilson’s Hospital School.
“If he was to do that, he would be released immediately and if he was to follow through with that commitment there would be no issues.”

Frank said Enoch’s family has been barred from attending today’s hearing.
He said Mr Justice Mark Sanfey last week gave several family members an opportunity to give an undertaking that they would not disrupt the court proceedings.
When they refused to do so, he directed that they be excluded.
“He had no objection to them attending in person; he just wanted a commitment that there would be no disruption or interruptions as we have seen - and I have been witness to many of these occasions where the Burkes have crossed over the judge as he is delivering a judgement.
“Unsurprisingly all of the Burkes objected to their exclusion.”
He said the Burkes claimed that they had not been given proper notice of the decision to exclude, although the judge said they were notified well in advance.
The Burkes also claimed that it is unconstitutional to deny them access to the courtroom.
Enoch Burke also questioned his treatment by the courts when he appeared via videolink last week.
“He claimed that he had been dragged from his cell at Mountjoy,” said Frank.
“He said he was given no advance warning of the application to exclude some of his family.
“He said he felt totally unprepared, he accused the judge of being a liar and again he claimed that he was being punished for his religious beliefs.”
Frank said Judge Sanfey has been at pains to point out that his beliefs have nothing to do with his contempt of court - and today’s hearing is solely about whether Enoch is willing to agree to stay away from the school.
Enoch spent over 100 days in prison in his first stint before being released.
He then returned to Wilson’s Hospital School after the summer holidays and on September 8th he was once again imprisoned for breaching the court order.
“He has spent almost 300 days now behind bars in Mountjoy Prison and as I said earlier, he could walk out the door today or any day if he simply gave that undertaking to stay away from Wilsons Hospital School,” said Frank.
The hearing is due to take place today.

Read up on the sequence of events!! You will notice that there is NO mention in the Court Order of Enochs religious views - he was jailed for disobeying the Cort Order, NOT for any other reason....its really quite simple!

Nope. You can appeal it to the courts of you feel aggrieved and go through the proper process, but what you can't do is decide court orders don't apply to you. He's finding that out the hard way. Anyone who disregarded the court as many times as he did would be in exactly the same place.

People don't go to prison for that. He got sent to prison for repeatedly defying a court order. And he can come out any time he likes. Somewhere along the way he seems to have decided he's above the law. Most rational people would have figured out after 300 days that they're not, but we're not really dealing with rational here, are we?

Translation: _you_ support it. Most other people have no sympathy for people who think that just because they have a faith, the laws of the land don't apply to them. The guy is a religious extremist who can end his incarceration any time he likes. He's _choosing_ not to. I wonder if you'd be quite as supportive if a muslim man did the same thing because he thinks girls in the school should all have head coverings and the court ordered him to stay away from the school? Regardless of how he got there, he was given an order by the court and he willfully ignored it. If you think you have some kind of higher moral imperative and you do that, you take the consequences.

@@suilfisean 99% would be a bit high imo, I'd say a decent majority either support Burke or just see him as being extremely stubborn/principled, those that support the school's position would be firmly in the minority. Progressive Ireland tends to seriously overestimate it's ranks, partly bc of the recent referendums passing and partly just because they live in more of a bubble than the rest of Ireland.

What the Burkes seem to have done - rather effectively at this point I would say, given the amount of misinformed people I see commenting on here - is change the narrative of the situation so that it's _morals vs woke left ideology_ rather than what it _actually_ is - a far less tabloid and drama-filled headline of _man disobeys court order_ - that's what he's _actually_ in jail for. You can _disagree_ with the order of a court, but if you _disobey_ it, there are consequences to that, as he has been finding out for the last 300 days. Most rational people not fuelled by religious dogma would have obeyed the order and brought the employers to court on unfair dismissal grounds - after whatever process was in place to appeal it had been exhausted and the outcome was not to his satisfaction. But he's decided to go another way completely which, technically, you _can_ do, but most people don't because it doesn't really make a lot of sense. Unless you like being in jail. Or unless you like the idea of being a "martyr", which I'm guessing fits the profile of most of that family from what I've seen.

The judges and guards acted appropriately - they don't make the laws and they don't take it a-la-carte for the ones they enforce. Can you imagine if they started making up the rules as they went along? The same people who are castigating them for doing their jobs are the same ones who'd be calling for their heads because the were "loose cannons", "out of control" and a "law unto themselves". As for the "shame" you seem to be throwing around anywhere you think it will stick, why don't you save some of it for the Burke family themselves? Any hearing or proceeding they start baying like ferral donkeys. The constant need for attention, the persecution complex and the religious zealotry point to some kind of mental disorder in my opinion. Whatever your views might be on the transgender thing, to act in such a persistently uncivilized and undignified way at every possible opportunity does not exactly help people to accept your point of view. He disobeyed a court order and that's why he is where he is. You have the right to disagree with it, but you don't have the right to disobey it - _the exact same as everyone else_

Hahahaha 😂 Russia has _actual_ political prisoners. Ireland has a man who thinks court orders don't apply to him. Literally anyone who did what he did - again, that's ignoring court orders - would be in exactly the same place he is. He can come out any time he likes. All he has to do is stay away from the school. Not that hard really, is it?

There's something strange about this case and about the Burke's behaviour. It's difficult to know the truth about what's going on, all I know is that if any of us ordinary people upset the judge in Court we'd be warned and then brought off in handcuffs if we didn't stop. Enoch Burke must have his own cell to be able to stay in prison so long, most prisoners are in a cell with two other prisoners with one onvthe floor in most prisons in Ireland due to overcrowding. This is due to longer sentences and more things being made crimes and immigration without the Government having made provision for this. Also because the useless opposition Sinn Fein haven't fought for the rights of Irish people. Vote No and No on March 8th.

I have been told he was suspended and jailed for behaviour / actions ( standing outside the school in protest? ) he was jailed but the reporting is so bad its hard to know.
