Double Check is a company that seeks to bring Chinese style social credit score type regulation to the firearms industry. The want to do this by scanning your social media for "malignant indicators" and advising your FFL to not complete the transfer. Of course they have hired Tim Kennedy to be their spokesperson.

After speaking with Eli, I believe his likeness was used without his knowledge.He assures me that he is not affiliated with double check in any way, and thinks it is a terrible idea. I have redacted that portion of the video to obscure his likeness (this may take time to process). Sincerest apologies for whipping up controversy- I was operating on the information I had at the time. The silver lining is now Eli knows he was being used and can correct it. Hey yall. First I am no way involved with this. I had a single meeting in January at shot show about this and voiced the EXACT same concerns. I am equally as pissed my face and likeness was used with no knowledge. I called and and made sure that shit was pulled off their page. I learned about this about 10minutes ago.

Only after rights have been infringed. Otherwise, no standing. It isn't necessarily a privacy issue, since social media is a public space. Someone will have to be denied a purchase because of social media posts in order to have standing.

@@THall-vi8cp That's assuming you were able to _prove_ that...and assuming you knew you'd been denied on that basis by A: the FFL, and B: as a result of their use of Double-Check. Without those two elements being known to you, you might not even know that you'd _have_ standing to begin with! That, and...social media isn't exactly a "public space" as we tend to treat it. Every site is privately owned while being _open_ to the public. There's no such thing as a "public forum" anywhere on the net, regardless of how they may appear. Web's more like one big mall than it is a street. In the physical world, such places have the right to deny someone entry or and the right to refuse to do business with them. I'd imagine that would muddy things a great deal and make arguments...difficult at best. Plus there's the TOS fine print that nobody reads that could make any standing moot--like an agreement to let the owning company sell your data (including posts) to third-parties. We really just don't have good legislation on this stuff and that means we've got a pretty unhealthy mish-mash of poorly-thought out laws and unsteady court decisions to wade through to get these things dealt with at all effectively in the courts.

@nightrunnerxm393 Private businesses that are open to the general public are public spaces. They can deny entry only for specific and often legal reasons lest they face discrimination lawsuits. There are multiple definitions of the word _public._ One of them is "open or accessible to all." Another is "performed or made openly or in the view of all." (Both of these come from the Collins English Dictionary.) I don't have Facebook, X, Instagram, or other social media accounts, yet I can read most of the material posted on those sites. If that isn't public, I don't know what is. I agree it might be difficult to prove such a case, but an appeal can bring it to light. The DOJ responds to appeals and gives the reason for the denial. Bad social media posts aren't 922(g) offenses, so it would be interesting to see how the reasoning would be explained.

He contacted them and they removed the entire ambassador page. He reinforced several times that he was NEVER affiliated with this company and he is absolutely pissed this happened. He said he made a comment at SHOT this year calling out this exact type of program and that he does NOT support anything like this.

About the whole BRCC and Act Blue thing, first off I have heard them say they do dares and stuff and sometimes the looser has to donate to the democratic party. I went and looked myself at the same site the screenshot that was sent around was taken from, and all of their donations together didn't even add up to $200 if I remember correctly, and was confirmed by another third party. So I think the Act Blue thing is kind of a non issue, just really dumb on their part. About the allegations against Tim Kennedy, I really don't know much about the guy and what he has been supporting, so I'll refrain from commenting on him, though this background checker shouldn't have been thought of.

While some of the most admirable people I've ever met were in the service in one form or another, we who haven't been in the services often forget that the military, police, etc. recruit from the entire population, not just some "good" part of it. What about people that have permits or licenses for carrying a firearm as a security guard, bail agent or private investigator? These people don’t likely have good “social credit scores” but the people making these rules do seem to have a need to hire these armed people

Not sure about other states, but in Arkansas having a carry license exempts you from the NICS check...just fill out the 4473 and walk out with the gun(s). I'm pretty sure that the DoubleCheck thing would also be waived.

There is a strong effort to create a social credit score system in the US and it must be strenuously resisted. In the Commiefornia community College system they have initiated the Aces system where professors rate student on a wide variety of categories. I taught fire science, most students who do well and had a lot of interaction with me would ask for a letter of recommendation which I would often grant. But to rate a student who had very little contact with the instructor is ripe for political correctness favoritism.

18 USC 242 - deprivation of rights under color of law. Since they are wanting to use ATF regulations and firearms statutes requiring a background check, as the vehicle for the deprivation, it would be under color of law. And it would apply to the private company as well. You cannot "tax" or otherwise "review by some arbitrary standard" a constitutional right.

I once watched a "special forces" guy talk about his "assaulters kit" where he made the case that you would only ever need three mags and that "normal" people could never use a kit like his effectively because they aren't military. I can't confirm it, but, he looked a lot like Tim Kennedy.

Tim Kennedy who was special forces thinks that we should jump through hoops and we all should be vetted to buy a firearm. My response to those types. I'm a civilian and never have been military, but we pay you. We make your equipment. We process the fuel you use. We stock the stores you buy from. We transport that what you use and consume. We are civilians and do not to go through a security clearance process just own a firearm and as civilians we use the Internet to vent our frustrations and what we say is really none of that company or Tim Kennedys business or those like him. My opinion on how firearm purchases should be. Go look at a Sears & Roebuck or a Montgomery Ward 1895 catalog. You could order no questions asked or put you money on the counter and say that one is the one I want.

Well said Sir and I agree with your points, Tim Kennedy is a turncoat bro vet. Could have sworn he used to be part of the Leviathan Tribe but see that he isn’t anymore. Both him and the other brand Ambassador Eli “Doubletap”Cuevas both are so ingrained with the Black Rifle Coffee brand doing all sorts of cool stuff with guns in their media but are trying to make a buck off this. Some of the other creators with Leviathan roll with those guys and should re examine their friendships with the back stabbers.

Yeah we definitely need to do a DEEP dive on Tim Kennedy and use any publicly available information that we can twist in order to make a prejudiced decision about whether he’s good enough to enjoy his civil rights. If he’s ever said anything that can be construed in such a way as to raise questions about his sanity then he should be barred from owning a weapon. I’m sure that being ex military is something you could use to make the case that he enjoys killing people. Any information can be twisted and misrepresented.
