My claim has been going on since 2016 (anxiety depression PTSD) first they did C&P for anxiety depression later came back and said they did the wrong paperwork C and P for PTSD add examiner was inept. it’s hanging on some judges desk and I have other medical conditions that I can’t claim because that is just hanging around without an answer hopefully I’ll die and save the government money. Yeah it’s three in the morning I have intractable migraine and my cardiac monitor is going off . well I am service-connected for Cardiac generous at 10% I hate to bitch and whine but it’s just ridiculous

Absolutely Agree..I've seen this work. A buddy of mine had been diagnosed in service with depression at least 20yrs prior to filing his claim. He was able to win his claim--even without having his SMRs (his VSO told him the best route to take was to claim 'Mental Health Disorder,' and allow the examiner to tell him what he had, instead of locking himself into a specific disability). My buddy had been hell-bent on claiming PTSD prior to following the advice of his VSO. It also worked in his favor that he'd sought therapy at a local Vet Ctr for anxiety/depression on/off for the past year or two, prior to submitting the claim. Seeking help, also helps. 😊

it's sad that people and the government say "THANKS TO OUR MEN AND WOMEN IN UNIFORM AND THANKS FOR YOUR SACRIFICE, YET THEY REALLY DON'T CARE". I served my country and THAT IN AND OF ITSELF is a stressor, the long work hours (min 50-60 hour work weeks), arduous duty zones (threat of your barracks being hit my a mortar), missing loved ones for months, sometimes years, the constant moving every 3-4 years or sooner, the terrible lifestyle choices availability for shift workers (poor food choices and workout opportunities) so they (VA) needs to consider THAT alone as being worthy of monetary compensation. The fact you have to FIGHT so hard only does one thing, ADDS MORE STRESS.

I had a terrible C&P psych examiner. I think you were correct on the PTSD label. I told her what my symptoms were, To make a short story long.. I was a Flight Engineer on A/F C-141B during Desert Storm/Shield/Iraqi freedom, etc. We used to fly at night to deliver materials/cargo, etc. More than once after starting our approach we were alerted that scuds were launched close to our area. We took evasive actions. I still get nightmares from those episodes. My C&P examiner said that I had flying phobia. She was telling a 14,000hr, 23yrs flying crew member that I'm afraid of flying. I didn't say anything to her, but I sure wanted to, & it wasn't going to be friendly. They gave me a combined 30% for stuff, all non-combat related. You think going the Acquired Psychiatric Disorder is a better route. Again Thank you for your videos & God Bless!!!

I know this has been many years ago. My husband is a Navy Corpsman during the Vietnam Era. His discharge was in 1976. He was not over seas. But he did work in surgery as a surgical tech at the Orlando Naval Training Center. Had to hold a leg while it was amputated. I think that he should be able to get PTSD. It was traumatic for him. It was one of his first surgery's. He does have depression & anxiety. Sleep apnea has a CPAP & ringing in his ears. He was also stationed at Camp LeJeune with the Marines. Was in Vegas with them for 3 months. My husband is now 70 & don't know if he could have a case. Any help please

So it sounds like specificity can cause issues, because then they just have to disprove that one specific thing. I also saw in other videos that it seems like the VA tries to avoid confirming PTSD, because it's bad publicity. Maybe that's also why the bar to prove the claim is so high. If PTSD ratings are too high, it could have significant impacts on new joins and retentions.

I'm watching closely ! I have a service connected, 20% disability. In the early 80's I went thru TAP school and upon discharge filed all claims according to my medical record. Subsequently filed as trained. The VA denied all my claims completely. I moved and filed again in another location and received (1) claim for 10% service connected. I never bothered filing again as it appeared the examiners could not read a medical record in black and white. Later on I sent a civilian MRI and refiled the claim and got 20%. With 28 years of flying and most of my adult life in the service, i now am suffering with the same problems the VA denied years ago. I'm filing again now I'M retired and going to file again with more documentation. Thanks for the video !

I haven't filed a claim nor was I deployed down range. I was actually in the national guard and when I returned from basic and AIT life was good. But I had a close friend that you could say was my mentor. he served 8 years, was deployed 3 times. So I took to him like a brother. One day he called me in the middle of the night so it's real late so I didn't answer I wasn't sure what he wanted to do probably go drinking or something. Little did I know he took his life that night, on top of that I had 2 of my best friends die around the same time. Make it even worse the one died in a car wreck, and he called me too and I didn't pick up the phone either because I thought the same thing. As for the last one he died from an illness and wanted me to come see him in the hospital but I was so depressed I couldn't bear to go and he died the next day. Losing three of my close friends all in one month and knowing that I could have answered the phone in the outcomes probably would have been different really sent me into a spiral. To lose one friend from suicide that I never stopped would ever take his own life makes you also contemplate on taking the easy way out of this world. I never said anything to anyone at drill about it because I felt like people would see me just trying to use his death for my own personal gain. But here I am almost 10 years later and I still can't let it all go. Probably not claim worthy just one sad story.

Acquired Psychiatric Disorder does not have a diagnostic code in 38 CFR Part 4. Better to get a diagnosis of one of the mental health conditions listed in Part 4 (other the Adjustment Disorder under 9440 - as that is considered a short term disability - 6 months or less) or just get mental health hooked up on a secondary basis to something else that is already service connected. As all mental health is rated under the same rating criteria you're only going to have one mental health rating regardless of how many diagnoses you may have been given due to Pyramiding under 38 CFR 4.14. Take the path of least resistance. The point of the video should be a PTSD diagnosis doesn't matter so long as you can establish service connection for any mental health diagnosis.

The VA gave me 50% for: Other specified trauma, and stressor related disorder. ...including, anxiety, suspiciousness, mild memory loss, disturbances of motivation and mood, suicidal ideation. There are a couple of others that are covered under the umbrella. I don’t know how they can have an umbrella for so many different things. Would it be worth having a talk?

I am currently going through the process for a military related injury. I am in Australia and the requirements are that the fact you were in the service and a t a later in your life you develop a mental disorder Going through the process and not having looked at the decision in the past 2 years I picked up my file and commenced to peruse all the documentation. Not do I only have PTSD I have a spinal injury. During the trial for compensation, I cross-examined the Orthopedic Surgeon who claimed that with such a n Injury I would not have been able to walk and would have been hospitalized. For a Tribunal hearing such evidence would be extremely damaging to my credibility. Then the Shrink's evidence stated that I was dishonorably discharged from the Navy.. The Department of Defense was unable to locate my discharge documents. Prior to my Medico with the Shrink my own Shrink said to time the consultation. I did, It lasted 20 minutes. The low-down SOB of courses denies any such thing. It is one thing I do have left is my Honor. The Shrink handed me a charge sheet that referred to a fight that I had when I was in the Navy. I remembered the instant even after 40 years. This of course was an ambush tactic, "I gotcha Moment" I slowly plod away at my case and found that the charge Sheet I had recently had a Forensic Document Examiner look at the document and has stated that he will give evidence the document is a forgery. . In between years I am a Ship's Master Class (1) I also have a Master's degree in Law With longer 50 years past I am still working at it.. I also purchased the book on Mental disorders (DMC-5 at NO time did the shrink refer to any issues that could be found in DSM - 5 under the heading PTSD. Not only do you have to get around bureaucratic jungle, they lie to your face.

I had similar thought related to documentation. It is one section has no idea what records or any information the other has on file. Assume they know nothing and have a copy potentially with information highlighted in statements, tabs anything to with the written copy that is needed so they don't have to look for it because they will not look hard. The Waco vsa found records and let me know if i had changed statement wording it would have been approved and although had surgery during deployment on record as non service related till I put in my copy of the paperwork.

I'm at 70% however not for my PTSD.....which by the way I have been diagnosed with. Due to being raped in the military by another service member from another branch the was pretty high ranking. I was threatened with my life and I was terrified. But because I can't prove the rape I was denied. Even though they have hospital records from me having to go the the ER the following day due to have an allergic reaction to latex. Its such bull💩. At this point its been over 10 yrs. And I just am tired of feeling like I have to prove it to the VA.

@@HillAndPonton Thank you so much for responding. I really appreciate the support. I read one of the blogs and it says something about proving it with evidence and here's where stiff gets sticky. Its a long story relating to my rape however my best friend witnessed it and was the main reason he stopped and ran. However she was threatened as well cause she joined the military to get her citizenship and was threatened that if she spoke they would have it denied. Not sure how all that works but she was terrified and still is till this day. We've talked about it and she was gonna write a letter stating she witnessed the attack but she got nervous and her husband ended up contacting me saying he was scared for her and I didn't want to make her do anything that made her feel that way so I just dropped the whole situation. I have a ptsd claim in 2006 I was treated by va for depression anxiety and insomnia, but did not have ptsd diagnosis. I have combat action badge and multiple sufficient stressors from my deployment. I was in guard, and received no treatment while deployed. I believe I would have a better chance of proving ptsd than a service connection to another psychiatric disorder. The c&p examiner said I did not have ptsd but had adjustment disorder with depression, anxiety, and insomnia. In recent years my ptsd has increased in severity and the va has finally given me the ptsd diagnosis. My question is I have been told I can do a cue motion on my 2006 claim but am wondering if it may be a dta claim from watching some of your videos and seeing dta is easier to get.
